I have been disputing this inaccurate account for months now and they keep reporting it, which is harming my ability to get an apartment for my children. Consumer Complaint: I am writing to dispute the accounts on my credit report that are a result of identity theft. I have recently discovered that my personal information was compromised, and as a result, these accounts were opened fraudulently without my consent. The accounts in question are : XXXX XXXX XXXX Date Opened : XX/XX/XXXX Balance : {$3600.00}, XXXX XXXX XXXXXXXX Date Opened : XX/XX/XXXX Balance : {$610.00}XXXX XXXX XXXX XXXX Date Opened : XX/XX/XXXX Balance : {$4000.00}, and XXXX - XXXX XXXX XXXX Date Opened : XX/XX/XXXX Balance : {$0.00}. I want to inform you that I have already reported this incident to the bank, and they have agreed to remove the accounts from my credit report. I request that you remove these accounts immediately from my credit report as well. I am deeply concerned about this situation and fear that this may happen again in the future. I request that you take all necessary steps to prevent this from happening again and inform me of the steps taken. I withhold my consent for electronic communication and explicitly request that all responses be conveyed in written form through the United States Postal Service ( USPS ).

Consumer Complaint: I regret to inform you that I can not accept your decision to dismiss my identity theft claim by attributing it to an error or a misrepresentation of material fact. It raises serious concerns as to how and why you possess the authority to determine what constitutes a material fact. It's worth noting that your role does not grant you the powers of a judge or jury, nor any inherent right to make such determinations. I was the victim & I'm not sure why the CRA is not complying with the law. The other bureaus have followed suit. Im very confused why this one seems to ignore my requests. According to the guidelines set forth by the Federal Trade Commission ( FTC ), when an FTC identity theft report has been filed with a law enforcement agency ( which the FTC itself is ), the protocol is to adhere to the law and investigate accordingly. XXXX XXXX XXXX FRAUD, PLEASE DELETE!!!!XXXX XXXX XXXX XXXX XXXX FRAUD, PLEASE DELETE!!!!!! XXXX XXXX XXXX FRAUD, PPLEASE DELETE!!!!! I am willing to grant you one final opportunity to process my request concerning my identity theft. Failure to do so will compel me to seek legal recourse through the judicial system. In such a scenario, you will be held accountable for the damage caused to my reputation, credit, and the emotional distress I have endured throughout this ordeal. It is highly likely that what constitutes a material fact will become abundantly clear during legal proceedings, and you may be required to compensate me for your negligence. I implore you to take immediate action to resolve this matter within the five-day timeframe mandated by law. Please manage your responsibilities accordingly.

Issue: Problem with a company's investigation into an existing problem

Consumer Complaint: In XXXX XXXX XXXX, I mailed a letter to XXXX ( Credit Bureau Management ) requesting their assistance in removing 5 closed student loan accounts from my credit reports. In the letter to XXXX ( dated XX/XX/XXXX ), I indicated that I was a former customer of XXXX, that I previously had 5 XXXX loans serviced by XXXX, and that the loans had been paid in full and closed. I further informed XXXX of my attempts at asking the credit bureaus to remove the closed accounts from my account history, given that the late payment history in the closed accounts were inhibiting my ability to qualify for other forms of credit. To date, XXXX is the only bureau to honor my request and to remove the closed accounts from my credit report. Unfortunately, Equifax, XXXX, and XXXX will not remove the accounts UNLESS XXXX INSTRUCTS THEM DIRECTLY TO REMOVE THE CLOSED ACCOUNTS. The basis of my request was that the closed accounts were old ( opened between XXXX XXXX XXXX ) and that none of the bureaus had record of the first delinquency dates to validate and justify removal. Only XXXX had that information on hand. Given that I have satisfied the accounts and that they are now closed, I have asked XXXX to tell Equifax, XXXX, and XXXX to delete the closed accounts from my account history. This will help increase my chances of qualifying for a home mortgage, auto loan, and lower auto insurance rates. XXXX Credit Bureau Management responded with a letter on XX/XX/XXXX completely missing the point to my letter and stating that I was disputing the accuracy of the information reported to the credit bureaus. I responded with a second letter ( dated XXXX XXXX XXXX ) basically calling them out on misunderstanding my initial letter. I stated that the intent behind my letter was not to dispute the accuracy of the information reported to the credit bureaus. Rather, the intent behind my initial letter was to tell XXXX to instruct removal of the 5 CLOSED student loan tradelines from my Equifax, XXXX, and XXXX credit reports. The tradelines are OLD and CLOSED. THE BUREAUS ARE WILLING TO DELETE THE CLOSED ACCOUNTS, BUT CAN NOT DELETE UNTIL XXXX INSTRUCTS THEM TO. Based on my research, I know creditors often instruct credit bureaus to remove old tradelines, especially when requested. I asked XXXX again to contact Equifax, XXXX, and XXXX, and to tell them to remove the closed tradelines from my reports. The credit bureaus will remove the tradelines, but they can not remove the tradelines until XXXX tells them to do so. I have confirmed this with the credit bureaus. On XX/XX/XXXX, XXXX replied with another letter again missing the point to my two previous letters. I did not ask them to investigate the accuracy of their reporting. All I wanted was for them to tell the bureaus to delete the XXXX closed accounts from my reports. The bureaus will not delete the accounts until XXXX tells them to do so, and XXXX ( for some odd reason ) will not budge. As a consumer, I feel like I am stuck between a rock and a hard place. I have done my part and have paid off the loans. The least they could do ( as a goodwill adjustment ) is help delete the delinquent accounts and payment history from my reports so that I can get on the road to financial freedom and security. I hate to take it to this level, but have no other options ( outside of securing a consumer protection attorney ).

Consumer Complaint: I have attempted several times to get this company to comply with ( A ) subject to section 1681s3 of this title, any ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; They are refusing to lawfully comply which is also a violation of The Privacy Act of 1974, as amended, 5 U.S.C. 552a, which establishes a code of fair information practices that governs the collection, maintenance, use, and dissemination of information about individuals that is maintained in systems of records by federal agencies. A system of records is a group of records under the control of an agency from which information is retrieved by the name of the individual or by some identifier assigned to the individual. The Privacy Act requires that agencies give the public notice of their systems of records by publication in the Federal Register. Click here to see a list of DOJ systems of records and their Federal Register citations. The Privacy Act prohibits the disclosure of a record about an individual from a system of records absent the written consent of the individual unless the disclosure is pursuant to XXXX of XXXX statutory exceptions. The Act also provides individuals with a means by which to seek access to and amendment of their records and sets forth various agency record-keeping requirements. 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information ( a ) Notice requirements Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title.16 CFR 313.7 - Form of opt-out notice to consumers ; opt-out methods. ( f ) Continuing right to opt-out. A consumer may exercise the right to opt-out at any time. They are also in violation of my copyrighted name and are now committing identity theft by me opting out and not having my express written consent and authourization.
