Yet XXXX is reporting this information.. The reporting of excluded information pursuant to 15USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been " validated ', let 's be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. XXXX and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer reports are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. Consumer Complaint: XX/XX/2024 Notice to Principal is Notice to Agent, Notice to Agent is Notice to Principal Subject : Demand for Removal of Charged-Off Accounts from Credit Report and Credit Profile To Whom It May Concern : I am writing to demand the immediate removal of any and all reporting charged-off accounts from my credit report and credit profile. Upon review of my credit profile and most recent credit report, I have noticed that these charged-off accounts are inaccurately reflected, and I am demanding their suppression and deletion based on specific legal grounds. According to the Internal Revenue Service ( IRS ) guidelines and federal case law, charge-offs are considered taxable income. In accordance with federal taxation statutes and established case law, income is defined as an accession to wealth, clearly delineated under the Sixteenth Amendment of the United States Constitution. Furthermore, case law, such as the landmark Supreme Court case Commissioner v. XXXX XXXX XXXX ( XXXX XXXX XXXX ), solidifies the principle that income encompasses any accession to wealth, regardless of source, and is subject to taxation unless explicitly exempted by law. Given the aforementioned legal precedent and IRS classification of charge-offs as taxable income, it is evident that reporting charged-off accounts as part of one 's credit profile is erroneous and misleading. Charge-offs do not reflect ongoing financial obligations or active credit balances but rather constitute a tax consequence that is separate from the creditworthiness of an individual. I am hereby demanding that the charged-off accounts listed on my credit report be promptly suppressed and removed in adherence to federal law and the established legal understanding that charge-offs should not be part of one 's credit profile due to their classification as taxable income by the IRS. According to the Fair Credit Reporting Act ( FCRA ), credit reporting agencies are obligated to ensure the accuracy and fairness of the information contained in consumer credit reports. As such, I expect your agency to take immediate action to rectify this discrepancy and expunge the aforementioned charged-off accounts from my credit report within 30 days of receipt of this letter. Failure to comply with this request within the stipulated timeframe will leave me with no choice but to pursue legal action to enforce my rights under the FCRA and seek remedies for the inaccuracies present in my credit report. Consumer Complaint: In accordance with the Fair Credit Reporting Act. The bankruptcy reporting has violated federally protected consumer rights to privacy and confidentiality under 15 USC 1681. I asked Equifax to reinvestigate the bankruptcy they are reporting .However, they stated everything was verified and accurate. But how is that possible if I have a letter from the courts stating they didn't report my information. I have also attached the letter from Equifax stating they verified the bankruptcy with the court ( which they are lying and breaking the law ) According to 15 USC 1681i ( 5 ), they are supposed to modify accounts that aren't reporting correctly. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.

Consumer Complaint: Just got off the phone with XXXX XXXX and XXXX XXXX, I was never notified that XXXX XXXX has bought my debt from XXXX XXXX and now my charged off account is in collections, I have the right to privacy and the right to accurate and proper credit reporting on my consumer report I have sent a letter to the company rescinding all agreements I have ever made allowing them to share any of my personal information with anyone and especially never gave them the ok to share my personal information such as name, address, social security with XXXX, XXXX, equifax, nor anyone else, by law they need to notify me in writing stating they will be sharing my private, personal information with anyone! They have never notified me of the above in writing, also the amount owed to XXXXXXXX XXXX is incorrect and inaccurate information and I have the right to proper reporting! In which it is inaccurate reporting and needs to be deleted and removed immediately! It goes against the fair credit reporting act, XXXX XXXX is showing that I have a charge off with them, although I no longer have a charge off with XXXX XXXX they have had sold my debt to XXXX XXXX collection in which I was never ever notified in writing of such change and that they are in possession of my account, non the less the information on my credit report is 100 % inaccurate and false! The account is now in collections with XXXX XXXX it is illegal to report a charge off when it is has become a collection account! Please have XXXX XXXX immediately delete this off my credit report! Have the entire account deleted due to false and inaccurate reporting!!!! the total that I had owed is {$880.00}! I have the right to an accurate proper credit report! It is inaccurate and incorrect in which it goes against the FCRA, bank book keeping must be 100 % accurate at all times down to the XXXX! Have this account deleted immediately!
