Yet XXXX, XXXX XXXX Equifax is reporting this information. The reporting of excluded information pursuant to 15 USC 1681 a ( d ) ( 2 ) ( A ) ( i ) on a consumer report is a clear violation of Metro2 compliance. Provide me with the Metro2 compliance disclosure on reporting transactions to a consumer reporting agency. I need the transactions reporting as late, collection/charge-off status and any other derogatory information deleted from my consumer reports effective immediately. Before you think to reply that this account has been validated, lets be clear that I am not asking you to validate or verify anything. So please do not respond by telling me that as a tactic to waste my valuable time. Some of the negative accounts have been placed in Collection/Charge-Off Status WITHOUT mailing me a copy of IRS form 1099-C Cancellation of Debt. XXXX, XXXX, Equifax and the creditors reporting collections/Charge-Offs, late payments/other derogatory information in my consumer report are in violation of 26 USC ss 6050P Returns Relating to the Cancellation of Indebtedness By Certain Entities. If this derogatory account information is not deleted from my consumer reports within 30 days, I will be forced to officially file IRS form 3949A : Information Referral AND IRS form 211. According to 15 USC 1681i ( 5 ), they are supposed to modify accounts that aren't reporting correctly. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.

Consumer Complaint: About XXXX months ago I reviewed a copy of all ( 3 ) of my credit reports ( EQUIFAX, XXXX, and XXXX ) where I noticed accounts that are reporting inaccurately. It is showing misleading information, as it is showing me late on a few accounts from XX/XX/2022 to XX/XX/2022, but to my knowledge this is incorrect or an error not of my own doing. I have spoken to the creditors via mail and simply just asked for the accounts to be updated to PAID/PAID AS AGREED, NEVER LATE if the proper evidence can not be provided. I have been getting either no response or unsatisfactory responses with quick " investigations '' that provide know documentation. I been submitting complaints to the CFPB. This misleading data is causing a great harm to not only my credit score, but my employment is in jeopardy as I'm required to maintain exceptional credit as a government employee with a Top Secret Clearance. After recently seeking legal counsel regarding consumer laws, I was made aware that these inaccuracies are a violation of the Fair Credit Billing Act ( FCBA ), 15 US Code 1666-1666j " the creditor must provide the consumer with PROOF that they were indeed late but they HAVE NOT. It also fails to comply with 15 U.S. Code 1681 " to report fair and accurate information ''. Per CRSA enacted, CDIA implemented laws, any and all reporting must be deleted if not proven certifiable fully true, correct, complete, timely of known ownership and responsibility to the consumer. I DEMAND evidence of the investigation beyond a computer automation that simply states " Investigation is Closed '' Please provided the documentation steps required by law indicated which individuals and measures that were taking to prove the Creditor 's claims. I beg of you, a quick search of my credit prior to XX/XX/2022 will show my credit worthiness and consistency of on time payments and fulfillments for over 2 decades. Please eradicate any and all derogatory aspects of reporting and at the MININUM I simply request to rectify as PAID/PAID AS AGREED, NEVER LATE on the below listed accounts. These bureaus are violating multiple FCRA, FCBA laws and it is very detrimental to my credit score and putting my employment in jeopardy. I'm a first responder for the US Government and I'm sick as how errors and lack of due diligence by a creditor can easily and dramatically affect someone's financial livelihood. Consumer Complaint: The Fair Credit Reporting Act, specifically 15 USC 1681 section 602, asserts the importance of consumer reporting agencies operating fairly, impartially, and with respect for the consumer 's privacy. XXXX, Equifax and XXXX are consumer reporting agencies, and as a consumer, I have the right to ensure the protection of my private information. This right is supported by 15 USC 6801, which states that financial institutions have an ongoing obligation to respect customer privacy and safeguard their nonpublic personal information. In accordance with 15 USC 1681 section 604 a section 2, a consumer reporting agency can only provide a consumer report if instructed to do so by the consumer in writing. Neither of these financial institutions ( XXXX XXXX XXXXXXXX XXXX, XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX ) nor Equifax, XXXX and XXXX have my consent to share this information, written or otherwise. Therefore, any consent previously given to these entities is now revoked. Moreover, 15 USC 6802 ( b ) ( c ) stipulates that a financial institution can not disclose nonpublic personal information to a nonaffiliated third party without informing the consumer of their right to opt out of such disclosure. These financial institutions ( XXXX XXXX XXXXXXXX XXXX, XXXX XXXX XXXX XXXXXXXX XXXX, XXXX XXXX XXXX ) failed to inform me of this option. Additionally, 15 USC 1681C ( a ) ( 5 ) prohibits consumer reporting agencies from including adverse information in a consumer report if it exceeds seven years from the date of the report, except for records of crime convictions. The adverse item being reported without my permission is a violation of the law. According to 15 U.S. Code 1681s2 ( A ) ( 1 ) A, it is unlawful to furnish inaccurate information to a consumer reporting agency if one knows or has reasonable cause to believe it is inaccurate. Furthermore, 15 U.S. Code 1681e requires consumer reporting agencies to implement reasonable procedures to avoid violations of section 1681c and limit the provision of consumer reports to authorized purposes. XXXX, Equifax and XXXX are not fulfilling these requirements. Finally, as stated in 12 CFR 1016.7, a consumer has the right to opt out of reporting services at any time. Therefore, I am exercising my right to opt out of their reporting services.
