Consumer Complaint: Heres a letter Ive used in the past : Subject : Complaint against XXXX Dear Consumer Financial Protection Bureau, I am writing this formal complaint against XXXX in hopes of seeking resolution regarding the reporting of negative claims on my consumer credit profile. I believe that certain claims have been inadequately or un-demonstratedly asserted, and I am deeply concerned about the accuracy and integrity of their reporting practices. My primary complaints are as follows : 1. Failure to Ensure Accurate Reporting : I firmly believe that XXXX has not taken adequate measures to ensure that my consumer credit report profile is reported factually, ethically, and in compliance with federally-defined timeliness. The reporting should also be physically verifiable and validated, adhering to the mandatorily utilized Metro2 Data-filled Field Formatted Reporting Standards without any omissions or deviations. 2. Deviation from Established Reporting Standards : Based on my understanding of CDIA 's CRRG manual ( see CRRG 3-4 ), any deviation from the Metro2 standards jeopardizes the integrity of the data. I am concerned that XXXX may not be adhering to these established standards, which raises questions about the credibility and reliability of the reported information. 3. Lack of Documented Proof : Despite my attempts to contest the reported information, XXXX has not provided sufficient documented proof confirming the accuracy and compliance of the negative claims asserted against me. As a consumer, I have the right to demand evidence of reporting appropriateness and adherence to regulatory requirements. I request that the Consumer Financial Protection Bureau take appropriate action to address my concerns and ensure that XXXX rectifies their reporting practices promptly. Specifically, I demand the following : - Immediate removal of any unproven or inadequately reported negative claims from their records and future reporting until they demonstrate provable adherence to reporting standards and regulatory mandates. - A comprehensive review of XXXX reporting practices to ensure that they comply with federally defined timeliness, accuracy, and completeness standards. I trust that the Consumer Financial Protection Bureau will handle this matter promptly and diligently, safeguarding my rights as a consumer. I appreciate your attention to this complaint and look forward to a positive resolution that restores the accuracy and integrity of my credit history. These accounts should not be furnished on my consumer report as they are in VIOLATION!!! 15 U.S. Code 1601- Congressional findings and declaration of purpose ( p ) The term unauthorized use, as used in section 1643 of this title, means a use of a credit card by a person other than the cardholder who does not have actual, implied, or apparent authority for such use and from which the cardholderreceives no benefit. Under, 15 U.S. Code 1681b Permissible purposes of consumer reports ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In according with the WRITTEN INSTRUCTION of the consumer to whom it relates. I NEVER gave any consumer reporting agency WRITTEN CONSENT to report anything on my consumer report which violates my rights as a federal protected consumer. NO CONSENT IS IDENTITY THEFT. Consumer Complaint: In accordance with the Fair Credit Reporting act, there is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. The List of accounts below has violated my federally protected consumer rights to privacy and confidentiality under 15 U.S.C. 1681, 15 U.S.C. 6801-6805, The Privacy Act of 1974 as well as inaccurate reporting per the IRS Publication 4681. XXXX XXXX XXXX accounts : Account # XXXX : Account # XXXX :. According to the IRS Publication 4681- A Charge off is a certificate of Indebtedness that is now considered income, which needs to be reported on my Income Tax. Income can not be reported to your credit report. You must also update to paid as agreed and/or remove the information listed above. Equifax, XXXX, and XXXX are consumer reporting agencies and I am the Consumer. There is 100 % improper use of the credit report. Equifax, XXXX, and XXXX HAS VIOLATED THE FCRA, AND I'M HIGHLY UPSET ABOUT THIS. I FOUND MANY INACCURACIES ON MY CREDIT REPORT. INCLUDING ACCOUNTS THAT I NEVER GAVE YOU WRITTEN PERMISSION TO ADD ON ANY INFORMATION TO THE CREDIT REPORT! I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( XXXX XXXX XXXX ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( XXXX XXXX XXXX ) the financial institution and the Consumer reporting agencies Equifax, XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to Equifax, XXXX, and XXXX, ( XXXX XXXX XXXX ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( XXXX XXXX XXXX ) Never informed me of my right to exercise my nondisclosure option.15 U.S.C 6805 states ( a ) In general Subject to subtitle B of the Consumer Protection Act of 2010 [ 12 U.S.C 5511 et seq. ], this subchapter and the regulations prescribed thereunder shall be enforced by the Bureau of Consumer Financial Protection, the Federal functional regulators, the State insurance authorities, and the Federal Trade Commission with respect to financial institutions and other persons subject to their jurisdiction under applicable law, as follows : ( 8 ) Under subtitle E of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5561 et seq. ], by the Bureau of Consumer Financial Protection, in the case of any financial institution and other covered person or service provider that is subject to the jurisdiction of the Bureau and any person subject to this subchapter, but not with respect to the standards under section 6801 of this title. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Equifax, XXXX, and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. No agency shall disclose any records which is contained in a system of records, by any means of communication to any person, or to another agency, except pursuant to a written consent of the individual to whom the record pertain to ( PRIVACY ACT OF 1974 )

Consumer Complaint: I am writing to express my serious concern and dissatisfaction regarding the mishandling of my personal information that was sold and bought illegally. I am a victim of the Equifax data breach. I also attached proof that Equifax has admitted that I am in fact a victim of this data breach, indicating that my personal information was impacted by this incident and Equifax has done nothing but closed the complaint XXXX Equifax did NOT address the issue about me being a victim of the data breach or address what I instructed them to do in regards to my consumer report. I was given a ridiculous explanation that has absolutely nothing to do with the problem. I can't believe that the credit reporting agencies are making millions of dollars by taking advantage of me and other consumers too. My information has been compromised and being used without my knowledge and Equifax is allowed to get away with this? How is this even possible? How can I trust that this will not happen again? My information is FOREVER compromised. This alarming and very scary situation that I am in is unfair and my family is even at risk. Strangers know where I live. They can impersonate me to obtain accounts, credit, etc with MY INFORMATION and I am being treated like I am NOTHING, an UNIMPORTANT CONSUMER with RIGHTS! My entire credit report from ALL reporting agencies is inaccurate. How can I trust this company or any other credit reporting agency with each report furnishing different information throughout each report? As a protected consumer with rights, which agency is correct? I don't know! The agencies don't seem to know either. Equifax also mentioned the adverse XXXX XXXX account that I instructed them to delete and remove from my credit report in accordance with the Fair Credit Reporting Act, Equifax and XXXX XXXX continues to violate my rights under 15 USC 1681 section 602 that states I have the right to privacy. 15 USC 1681 section 604 section 2 also states a consumer reporting agency, Equifax, can not furnish an account without my written instructions under Under 15 USC 1666b a creditor, XXXX XXXX, may not treat a payment on a credit card account under an open end consumer plan as late for any purpose. Equifax has done nothing and has not removed or deleted this account as instructed and indicated by law. This continuous violation of my rights from Equifax under the FCRA is unacceptable and illegal. As stated before, I request XXXX. Immediate Removal of Furnished Information : I request that Equifax take immediate action to remove/delete any and all information pertaining to XXXX XXXX from my consumer report. This is in line with my explicit opt-out directive given to XXXX XXXX ( Equifax has knowledge ), which covers both written and unwritten, verbal and non-verbal authorizations, as per 15 U.S. Code 6802. 2. Compensatory Damages : In the event that XXXX XXXX willfully continues non-compliance with 15 U.S. Code 6802 by failing to honor my opt-out request, As a consumer, I have legal rights to seek compensatory damages. I request that XXXX XXXX and Equifax pays a minimum of { {$1000.00} } for every offense of willful non-compliance. XXXX. I am requesting Equifax to prepare detailed report requesting the information regarding the steps your agency took regarding my information that was sold and bought illegally as a result of the Equifax XXXX XXXX and disclose to me : ( XXXX ) the categories and/or specific pieces of personal information they have stolen about me, ( XXXX ) the categories of sources of my personal information that was stolen, ( XXXX ) the purposes for stealing my information, ( XXXX ) please identify what person or people, businesses, organization, or location was my information sold, disclosed, or accessed illegally. Please include what method of verification and a description of the investigation in a report that can be mailed to the address listed above. As a protected consumer, I look forward to Equifax finally handling this matter professionally and with the utmost diligence according to the laws set in place for consumer protections, and without discrimination or retaliation because I am filing a complaint to protect myself and family due to the data breach of my personal information. My safety, my life, my reputation, my livelihood, and all credit information on my report is personal and are now exposed making my entire family 's lives UNSAFE, DANGEROUS, and EXPOSED to complete strangers!
