Consumer Complaint: I am writing to file a formal complaint against Equifax for what I believe to be multiple violations of the Fair Credit Reporting Act ( FCRA ) and related privacy laws. As a consumer with rights protected under federal law, I am formally opting out of any and all authorizationswhether written, verbal, or otherwise impliedthat I may have previously provided to Equifax, as is my right under 15 U.S.C. 6802. The FCRA, specifically under 15 U.S.C. 1681b, outlines the permissible purposes for which a consumer reporting agency may furnish credit reports. This section requires that I provide explicit written consent before my credit report can be released. Furthermore, 15 U.S.C. 6802 ( b ) states that my personal information can only be furnished if I am given a clear and conspicuous opportunity to opt out, which was not provided by the financial institutions listed on my credit report. Additionally, pursuant to the privacy regulations found in 16 CFR Part 313, notably 313.1 and 313.7, I should have been provided a form of opt-out notice, as well as a continuing right to opt out of such disclosures. Equifax, as a non-affiliated third party, should not possess or disseminate my personal information without my explicit consent. The inaccuracies present on my credit report, which I have detailed and circled in the attachments accompanying this complaint, include but are not limited to dates, amounts, and account statuses. Each financial institution that has reported to Equifax has assured me through their privacy notice terms and conditions that my information would not be shared with third-party companies, yet it appears that this has not been the case. I am aware that the FCRA provides for statutory damages of up to {$1000.00} per violation, as well as the potential for punitive damages and the recovery of attorney 's fees and costs for willful noncompliance ( 15 U.S.C. 1681n ).
