Consumer Complaint: To whom it may concern i have sent letters to the consumer credit agencies XXXX, Equifax and XXXX.Stating that they were reporting the wrong, old, past the statue of limitations accounts and inaccurate information on my consumer credit report. According to 15 U.S. Code 1681s2 - Responsibilities of furnishers of information to consumer reporting agencies ( a ) Duty of furnishers of information to provide accurate information ( XXXX ) Prohibition ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ( B ) Reporting information after notice and confirmation of errors A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate. Consumer Complaint: Dear Sir/Madam, I am writing to file a formal complaint against the credit reporting agency XXXX for their refusal to place a block on a fraudulent auto loan, reported by XXXX XXXX XXXXXXXX XXXX on my credit file, even after I provided ample documentation proving the fraudulent nature of the transaction. I discovered an unauthorized auto loan from XXXX XXXX XXXX listed on my XXXX credit report. Understanding the severity of the situation, I acted promptly and followed the correct procedures to rectify this issue. I filed a police report, submitted a Federal Trade Commission ( FTC ) Identity Theft Affidavit, and obtained a letter from XXXX XXXX XXXXXXXX confirming the fraudulent nature of the loan and their agreement that the loan was not entered into by me. A copy of each document has been provided to XXXX. Despite my efforts and in clear violation of the Fair Credit Reporting Act ( FCRA ), specifically Section 605B ( 15 U.S.C. 1681c-2 ), which mandates that credit reporting agencies must block the reporting of information that the consumer identifies as information that resulted from an alleged identity theft, with the requisite documentation provided, XXXX has denied my request for a block on this fraudulent loan. I believe XXXX 's refusal to honor my block request constitutes a blatant disregard for my rights as a consumer and demonstrates an improper and potentially harmful handling of my sensitive credit information. This has caused me significant stress and has the potential to adversely affect my creditworthiness and financial health. According to FCRA section 609 ( e ) ( 15 U.S.C. 1681g ( e ) ), upon providing a valid police report to a credit reporting agency about alleged identity theft, the agency must promptly block the reporting of such information. Furthermore, under FCRA section 611 ( 15 U.S.C. 1681i ), the agency must conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate due to fraud and correct the error. As I have complied with all required steps, including providing the necessary legal documentation, I request the CFPB to investigate this matter promptly and ensure that XXXX adheres to the appropriate sections of the FCRA. I seek an immediate block of the fraudulent information on my credit report and assurance that my rights as a consumer are upheld. Additionally, I request that XXXX send me an updated copy of my credit report post-removal of the fraudulent account to verify that corrective action has been taken.
