Consumer Complaint: Subject : Request for Rectification of Privacy Breach in Consumer Credit Report Dear Equifax, I am writing to address a significant matter pertaining to the unauthorized inclusion of certain accounts in my consumer credit report, which I believe constitutes a breach of privacy and identity fraud. Pursuant to the South Carolina Consumer Protection Code, specifically 37-20-110, any addition of items to a consumer report requires explicit consent from the consumer. Furthermore, in accordance with the Fair Credit Reporting Act ( FCRA ) [ 15 U.S.C. 1681 ], the information in a consumers credit report is considered non-public personal information. I want to emphasize that I did not provide authorization for the reporting of accounts that are currently negatively impacting my credit reputation. These unauthorized accounts include those with derogatory remarks, accounts in charge-off or collection status, and accounts negatively impacting my payment history. The continued reporting of these unauthorized accounts by Equifax not only violates my privacy but also raises concerns about identity fraud, which is a direct violation of the South Carolina Identity Theft Protection Act ( 37-20-170 et seq. ). I hereby request that you promptly rectify this situation by removing the aforementioned unauthorized accounts from my credit report, in compliance with the aforementioned laws. Failure to address this matter appropriately may be considered willful negligence under the FCRA. I appreciate your immediate attention to this issue and expect that you will take the necessary steps to rectify the breach of privacy in accordance with the relevant state and federal laws. Consumer Complaint: Hello, I sent the attached dispute to Equifax XXXX and they have yet to investigate. On XXXX I sent the attached response to their stall letter. It is now past the well 30 days allowed from my initial dispute sent XXXX. I have also found out that I was apart of Equifax data breach and they are doing nothing about it. Equifax is not complying with the regulations of the FCRA and many other federal laws. Can the CFPB investigate this? Imaging how many other people they are affecting this way. This is unfair treatment to consumers and should not be allowed.
