Consumer Complaint: According to the Fair Credit Reporting Act ( 15 USC 1681a and b ), consumer reporting agencies must fulfill their responsibilities with fairness, impartiality, and respect for the consumer 's right to privacy. The Privacy Act of 1974 prohibits the disclosure of records without the individual 's explicit written consent. Equifax, XXXX, and XXXX have not obtained my consent for the report of the bankruptcy on my credit profiles. These companies need to remove this reporting due to inaccuracies in reporting and violations of Metro 2 compliance. Attached are court statements and an FTC report for identity theft as evidence. As per 15 USC U.S. Code 1681c-2, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information resulting from alleged identity theft, no later than 4 business days after the date of receipt by such agencies.

Consumer Complaint: This consumer reporting agency has failed in their obligation to limit the reporting on a consumers consumer report in the purposes listed under section 1681b. The law states 15 U.S. Code 1681e - Compliance procedures ( a ) Identity and purposes of credit users Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. These procedures shall require that prospective users of the information identify themselves, certify the purposes for which the information is sought, and certify that the information will be used for no other purpose. Every consumer reporting agency shall make a reasonable effort to verify the identity of a new prospective user and the uses certified by such prospective user prior to furnishing such user a consumer report. Consumer Complaint: Initially I had a hard inquiry on my credit report from XXXX XXXX on XX/XX/2023 when someone used my identity to try to start a line of credit with them. I was able to speak with XXXX XXXX and after a few weeks they sent me a letter stating the application was fraudulent and they would be sending out a letter to the credit bureaus requesting deletion. After this happened I put a credit freeze and fraud alert on all 3 of my accounts with the credit bureaus. Now on XX/XX/2023 the name of the inquiry has changed to XXXX XXXX XXXX XXXXXXXX XXXX, it has the same date as XXXX XXXX and everything. Soon as XXXX XXXX sent me the letter stating it was fraudulent the name of the inquiry changed but with the same date. I dont know how this company magically appeared on my credit report when I have it frozen and a fraud alert on it. It only showed up on my Equifax and XXXX as XXXX had removed the fraudulent hard inquiry from XXXX XXXX XX/XX/2023. Im not sure why a new name is popping up on my inquiry list for the exact same date. I spoke with the Company XXXX XXXX XXXX in XXXX NC, and a guy named XXXX, the finance manager said they hadnt pulled my credit and I wasnt in their system, yet theres a hard inquiry on both my Equifax and XXXX stating otherwise. He told me that he couldnt give me a proof of deletion letter as that would be admitting they pulled my credit when they didnt. Yet theres is proof that I showed them via email, where their companys name is on my credit report under hard inquiry. I have not given this company or any company to pull my credit. I am not sure what is going on, I thought everything was handled when XXXX XXXX sent me the letter admitting it was a fraudulent pull, now this inquiry has popped up 3 weeks later but with the same date as the XXXX XXXX XX/XX/2023, but now the XXXX XXXX inquiry is magically disappeared with no letter from either credit bureau stating a removal, only thing happened was a change of name.

Consumer Complaint: Equifax has incorrect information ( last name, address ) for my account and has locked and frozen my credit report account with them as I can not verify my identify against their incorrect information. This has prevented me from getting a mortgage since mortgage companies could not pull the frozen report, even though I have Excellent credit over XXXX across all 3 credit reporting agencies. The other 2 credit agencies, XXXX and XXXX, have my correct information- my correct up [ dated married last name and new address so I had no issue with their accounts and pulling those credit reports. I have followed Equifax 's only process to solve their incorrect information by mailing them scans of all my personal identification ( social security card, passport and drivers license ) however they have still not been able to update and correct my information to unlock my account and unfreeze my credit report. I am requesting your support in correcting my account information with Equifax within 2 business days as it is preventing me from getting a mortgage and owning a home and work with Equifax on updating their policies to align more with the other credit agencies, XXXX and XXXX, on staying up to date and proactively correct and update account information instead of using inaccurate information and causing the customer to escalate to have it corrected.
