Consumer Complaint: XXXX XXXX XXXX XXXX XXXX, PA XXXX Equifax Information Services LLC XXXX XXXX XXXX XXXX, GA XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX XXXXRe : CFPB COMPLAINT REGARDING IDENTITY THEFT AND NON-COMPLIANCE** Dear CONSUMER FINANCIAL PROTECTION BUREAU, I am writing to file a formal complaint with the Consumer Financial Protection Bureau ( CFPB ) regarding the identity theft committed by XXXX XXXX XXXX and the subsequent non-compliance with federal laws governing the reporting of consumer information. This complaint concerns the unauthorized furnishing of information on my consumer report, particularly the account sold to XXXX XXXX XXXX for collections. **Incident Details : ** 1. **Opt-Out Letter : ** On XX/XX/XXXX, I submitted a legally binding Opt-Out letter to XXXX XXXX XXXX revoking all verbal and non-verbal written consent for the furnishing of my consumer information on my credit report. 2. **Identity Theft and Non-Compliance : ** Despite my legal notice, XXXX XXXX XXXX willfully ignored the Opt-Out letter and proceeded to sell the account to XXXX XXXX XXXX for collections XXXX This action is in direct violation of XXXX5 U.S. Code Statute 1681 and the procedures outlined in Section 605B regarding identity theft. 3. **Failure to Block Information : XXXX XXXX XXXXXXXX failed to comply with 15 U.S. Code 1681c2 , which mandates the blocking of reporting any information resulting from alleged identity theft. The sale of the account to XXXX XXXX XXXX further demonstrates a complete disregard for federal law. **Relevant Laws and Violations : ** Legal Violations : 1. 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information : XXXX failed to comply with my Opt-Out notice, resulting in unauthorized furnishing of my information. 2. 15 U.S. Code 1681 - Identity Theft : XXXX engaged in identity theft by willfully ignoring my legal notice and selling the account for collections. 3. 15 U.S. Code 1681c2 - Block of information resulting from identity theft : XXXX XXXX XXXX, XXXX, Equifax, and XXXX failed to block information identified as resulting from alleged identity theft within the mandated time frame. Requested Actions : 1. Immediate Removal : I request the immediate removal of the account related to the identity theft from my credit reports by XXXX, Equifax, and XXXX. XXXX. Investigation : I urge the Consumer Financial Protection Bureau to conduct a thorough investigation into the actions of XXXX, XXXX XXXX XXXX, XXXX, Equifax, and XXXX to determine the extent of identity theft and FCRA violations. XXXX. Penalties : If the investigation confirms identity theft and FCRA violations, I request the imposition of appropriate penalties against XXXX, XXXX XXXX XXXX, XXXX, Equifax, and XXXX to ensure accountability and deter similar actions in the future. 4. Consumer Complaint: Im writing this complaint to inform you that Im federally protected as a consumer under the Fair Credit Reporting Act & Fair Debt Collection Practices Act. Im aware my consumer rights have been violated from this corporation by using offensive activities towards me as a consumer, such unauthorized use that didnt serve me any benefit pursuant to 15 USC 1602 ( p ) unauthorized use. 12 U.S.C. 1431 says Banks ( financial institution ) can only Borrow money which leads to expose the truth that pursuant to 15 USC 1602 ( g ) it defines creditor. This definition defines creditor as ONLY a natural person. THIS MEANS IM THE ORIGINAL CREDITOR OF THIS ACCOUNT. The term credit pursuant to 15 USC 1602 ( f ) means the right granted by a creditor to a debtor to defer payment of debt or to incur debt and defer its payment. This means you must be granted the right to have credit. Pursuant to FDCPA 15 USC 1692d ( 1 ) it is a violation to use means to harm a consumers reputation. In regards, to this account it has damaged my reputation tremendously. Also pursuant to 15 USC 1692e ( 2 ) ( A ) it is a violation to falsely represent any amount of ANY DEBT. 15 USC 1681a ( 2 ) ( A ) ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report. F.C.R.A STATES its not supposed to include ANY info on my consumer report. 15 USC 1681a ( ii ) communication of that information among persons related by common ownership or affiliated by corporate control ; or which explains no affiliation with ANY third party such as the credit bureaus. 15 USC 1681a ( iii ) also states again you have the right not to have ANYTHING REPORTED. 15 USC 1681a ( 2 ) ( B ) any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar ; meaning the law states everything thats from my credit card is supposed to be excluded. Pursuant to 15 USC 1602 ( l ) the term credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. As per Congress, you violated me & this corporation is criminally liable pursuant 15 USC 1611 because this corporation willingly knew that there were conducting a credit transaction which is FRAUD. Pursuant to 15 USC 6801 ( 3 ) is a direction violation of my protection against unauthorized access to my records and information has been violated resulting in substantial harm to me. There is no way to possibly investigate any alleged dispute when the FCRA states there is no dispute to conduct 15 USC 1681a Definitions ; rules of construction ( 3 ) ( e ) explains in depth a Credit Bureau or alleged creditor doesnt have the authority to Investigate investigative consumer report this term means a consumer report or portion thereof in which information on a consumers character, general reputation, personal characteristics, or mode of living its obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he acquainted or who may have knowledge concerning any such items of information. So, this means there is no way any credit bureau or alleged creditor can lawfully investigate. Pursuant 15 USC 1681a ( e ) it is prohibited to utilize any information from alleged creditors or consumer reporting agency. Pursuant to 15 USC 1692a ( 6 ) DEBT COLLECTOR means ANY person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of ANY debts, or who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another. Consumer Complaint: I have attempted on multiple occasions to file a dispute against the creditor XXXX XXXX. This credit is violating my rights according to the Federal Credit Reporting Act because it is reporting inaccurate information as well as inconsistent information across the three major bureaus ( Equifax-6 missed payments, XXXX14 missed payments, & XXXX-14 missed payments ). Equifax is denying my ability to dispute these inaccuracies stating a dispute is already in progress. However their records show otherwise. XXXX is also not allowing me to dispute these inaccuracies & inconsistencies. They also continue to deny me an updated copy of my credit report. I am also having an issue with XXXX XXXX. On my XXXX report, this creditor is reporting this account as a charge-off, yet is also reporting the account as open, with one missed payment which is completely inaccurate and inconsistent. An account can not be both charged off and opened at the same time. This same account was removed from my Equifax account because of their inability to validate the debt. Yet this account is reporting on XXXX as a charge-off and closed. I am entitled to a complete and accurate credit report. These credit reporting agencies are refusing to do their due diligence and properly investigate my disputes when it is clear these accounts are reporting inaccurately. They are all violating my consumer rights! This is damaging to my reputation and is hurting my chances of buying a home. This account needs to be removed immediately.
