Consumer Complaint: I sent out a letter out on XX/XX/2023 to transunion with my identity theft letter. Here my tracking number XXXX. They credit bureau failed to investigate my investigation back. This not make sense According to the law 15 U.S 1681i- Procedure in case of disputed accuracy. If the completeness or accuracy of any item of information contained in a consumer 's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer.

Consumer Complaint: Once I seen these account I asked them to verify due to fraudulent and unauthorized transactions and identity theft, 15 U.S. Code $ 1681c-2 a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt. These accounts should not be furnished on my consumer report as they are in VIOLATION!!! Under, 15 U.S Code 1681b - Permissible purposes of consumer reports ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the WRITTEN INSTRUCTION of the consumer to whom it relates. I NEVER gave any consumer reporting agency WRITTEN CONSENT to report anything on my consumer report which violates my rights as a federal protected consumer. NO CONSENT IS IDENTITY THEFT. As a consumer I am demanding the deletion of the accounts listed IMMEDIATELY!

It is still active after 60 days of promised removal. Midland Credit stated the same. It was to be removed from my credit and is still active after 65 days. The collection for XXXX XXXX still states in the collection process when it should read IN DISPUTE. Thank you

My right to make assure my information isn't shared which is aided by 15 USC 6801, that it is policy of the Congress that financial institutions have an affirmation and continuing obligation to respect the privacy of its customers and to protect the security of those consumers nonpublic personal information. ( Furnishing of information to credit agencies ). 15 USC 1681 section 604 a section 2, In accordance with written instructions the consumer reporting agencies may furnish a consumer report. XXXX and XXXX do not have my written consent to furnish this report. any and all verbal, nonverbal, written or otherwise, consent to XXXX and XXXX have been revoked. 15 USC 6802 ( A ) ( B ), Financial institutions may not disclose nonpublic personal information to a nonaffiliated third party unless- the consumer is given an explanation of how the consumer can exercise that nondisclosure option. ( Furnishing of information to credit agencies ). I was never informed of my right to exercise my nondisclosure options. 15 USC 1681C ( a ) ( 5 ), consumer reporting agencies may not make any adverse reporting other than reporting of conviction of crimes which antedates seven years. This account is an adverse item they are reporting without my permission which is against the law. 15 USC 1681S-2 ( a ) ( 1 ), A person shall not furnish any information relating to a consumer to any consumer reporting agencies if the person knows or has reasonable cause to believe that the information is inaccurate. 15USC 1681E, All consumer reporting agencies shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purpose listed under section 1681b of this title. She had apparently taken loans and credit cards out in my name, and has me around {$30000.00} in debt. I have frozen my credit and filed fraud complaints with the 3 major credit bureaus. I tried to file a police report and report it to the local prosecuting attorney, but since we are still legally married they wouldn't let me fill out a complaint for the identity theft.

I asked for this information when Midland Credit called me and they never sent it. They call me repeatedly throughout the day from different numbers. This is a form of harassment. 15 U.S.Code 1692k ( a ) ( 1 ) - Allows for any action of damage. AFFIDAVIT Notice, it is a fact, affiant is aware pursuant to 15 U.S.Code 1692k ( a ) ( 1 ) allows civil liability rewards for any damages, which may include stress, harassment, XXXX, XXXX anguish, and other damages all caused by violations of FDCPA due to Midland Credit Managements abusive and deceptive business practices.
