Consumer Complaint: JUNK DEBT BUYER - IN VIOLATION OF THE FDCPA - IN VIOLATION OF MY FEDERALLY PROTECTED CONSUMER RIGHTS Midland Credit Management at XXXX XXXXXXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX, CA XXXX has been sending me collection notices and they are reporting a collection account - Account # XXXX - in the amount of {$310.00} the collection has been reported as a balance, a collection account, and an open account. I do not know this company. I have never done any business with this company. This company does not have a contract with my signature. This is Aggravated Identity Theft. I have included several violations that you, Midland Credit Management, owe me in my Bill of Particulars.

( Please see a copy of certified letter send to Midland requesting that they verify the debit. ( Please see a copy of printout from USPS showing that Midland received the certified letter requesting the verification of the debt )

Consumer Complaint: XX/XX/XXXX : credit card amount due of {$3800.00} was sold to Midland Credit Management , Inc . XX/XX/XXXX : Midland Credit Management sent letter with transfer details and current balance : {$3800.00} Conversations with collector occurred : told Midland Credit Management XXXX Inc.I did not have the complete funds to pay off the balance. Was told I could offer a settlement XX/XX/XXXX : I wrote Midland Credit Management offered settlement amount of {$900.00} and sent check with offer. Clearly asked Midland Credit Management to inform me if the one-time payment settlement amount was acceptable, and if so to confirm in writing. Also, started if it not acceptable to please return the check. XX/XX/XXXX : Midland Credit Management cashed check ( # XXXX ) for {$900.00} Follow up call was then made by Midland Credit Management asking for full amount of balance owed {$3800.00}. Upon speaking to representative who first denied receiving the settlement letter and check, but then asked me for evidence, which I subsequently provided by reading the letter to the representative over the phone and provided details of payment paid. Representative then back tracked and said it was not settled and they would return the funds. Funds were never returned. Nor were they deducted from the balance owed XX/XX/XXXX, I followed up with a letter to Midland Credit Management outlining the situation and stating the debt was settled XX/XX/XXXX : Pre-legal notification letter from Midland Credit Management treating to forward the account to an attorney for the full amount owed {$3800.00} XX/XX/XXXX : I wrote Midland Credit Management to again outline that the amount was settled, they cashed the check, did not return the funds, and did not even take the money they took off the original balance owed. Midland Credit Management call me nearly every day and continue to write letters to me, now threatening.

How could that be when the account doesn't have any payment history, no open date, no terms of original contract, no DISPUTE history noted yet it was confirmed as accurate by the credit agency XXXX. The agency 's name : Midland Credit management, Actt # XXXX, amount : XXXX. This collector didn't care enougt to give me the information i ask for but passed me by and reported it on my credit report as accurate and justified as complete and accurate. Never mind all the missing informatoin. This has seriously hurt me and my families credit worthiness. Consumer Complaint: None of the options best fit the description of my complaint. I was sued for a credit card debt with XXXX XXXX by Midland Credit Management XXXX Inc, ( MCM ). I paid the debt XXXX. I did not know that the letter of satisfaction was never filed with the court until I tried to close on the sale of my house in XXXX of XXXX. I reached out to MCM on XXXX and on XX/XX/ they sent a notice of satisfaction to the wrong the court. ( Magisterial Court instead of the XXXX XXXX Court House ). Since then I, my attorney, and the XXXX XXXX Prothonotary 's office have reached out to MCM and the legal office ( specifically for Attorney XXXX XXXX ) multiple times to request the document be filed in the correct court with the correct docket number. As of today, they have not. The sale of my home is still pending, I could easily lose the buyer, and am beyond frustrated. Midland has been exceptionally difficult to deal with from my first encounter with them. I don't know what else to do at this point.

Consumer Complaint: On, or about XX/XX/21 I received an email from XXXX XXXX XXXX stating that they closed and charged-off my XXXX account then sold the fraudulent debt to Midland Credit Management XXXX Inc. , despite ongoing litigation. On, or about XX/XX/21 I called Midland Credit Management XXXX Inc., but the representative I spoke with said, Midland was not in possession of the account at that time. So, I advised the representative to refuse the account once presented because it is a fraudulent and involved in ongoing litigation. And, if Midland does take possession of the account, Im going to name Midland Credit Management , Inc. as a defendant during litigation as well. On, or about XX/XX/21 I received an email from Midland Credit Management XXXX Inc. stating that they had purchased the fraudulent XXXX account from XXXX XXXX Bank, despite our previous conversation. So, once again, I called Midland to explain the situation, but I was blown off by the representative I spoke with. The representative did say, Midland Credit Management , Inc. will investigate my claim and get back to me. Then, with some prodding, I got a response date of withing 90 days. Consumer Complaint: I believe that I am a victim of identity theft. Due to the CoronaVirus Pandemic, we are all facing which has me sitting still at home and I saw the recent news about the multiple XXXX XXXX breaches. I decided to look at my credit reports from the 3 major credit bureaus and found that someone had used my Identity. I have no idea how the theft took place. I also have no knowledge of any suspects. I did not receive any money, goods, or services as a result of identity theft. I contacted the Credit Bureau and told me to file an Identity Theft Report which I did. I did not receive an actual proof, physical firsthand documentation of the payment history and proof of last payment and these violations persist on my credit report. I just had to escalate to CFPB.
