Consumer Complaint: Dear Midland Credit Mgt ; XXXX XXXX ; cfpb ; I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. Consumer Complaint: On or about XX/XX/2023, I received a suspicious email from Midland Credit Management , Inc., a debt collection agency in XXXX XXXX, CA. The email stated, " Welcome to MCM. Your XXXX XXXX XXXX account has a new home. As a new consumer, we'd like to offer you an opportunity to discuss flexible payment options, including bi-weekly payment options, to resolve this account. '' It indicated that the account was transferred from XXXX XXXX XXXX ( original creditor ) to Midland Credit Management , Inc ( servicer and owner ) with a balance due of {$930.00}. However, the notice failed to include notifications required by 15 U.S.C. 1692g ( a ) ( 3 ) - ( 5 ) and FDCPA 1006.34-1006.42. On XX/XX/2023, I received another electronic notice from Midland Credit Management , Inc. escalating their debt collection practices. The email was a pre-legal notification stating that if I failed to pay by XX/XX/2023, " Midland Credit Management XXXX Inc. is considering forwarding this account to an attorney in your state for possible litigation. Please make arrangements to resolve your account. Once you have completely fulfilled your payment arrangement, you will be released of the obligation. '' The notice did not include required dispute disclosures. In addition, it is suspected that Midland Credit Management , Inc. has been placing harassing phone calls since XX/XX/2023, through a blocked number ( " unknown caller '' ) to avoid dedication. Approximately two days after the electronic notification on XX/XX/2023.

Under 15 USCS 1666b a creditor may not treat a credit card account under an open end consumer credit plan as late for any purpose.

Consumer Complaint: I am filing this complaint on behalf of XXXX XXXX XXXX XXXX A Limited Power of Attorney designating me as his representative is attached. My client 's father, XXXX XXXX XXXX XXXX fraudulently opened multiple credit card accounts in my client 's name, XXXX of which was with XXXX XXXX. On my client 's behalf I disputed this account with XXXX XXXX and requested they initiate a fraud investigation. In the midst of this, XXXX XXXX sold the account to a debt collection agency, Midland Credit XXXX. XXXX subsequently reported this account to my client 's credit file and, despite multiple disputes on the basis of identity theft, has refused to delete the account. To credit report and attempt to collect on an illegitimate debt which resulted from identity theft is a classic example of " fruit of the poisoned tree ''.

Consumer Complaint: Debt was a result of identity theft. A police report was filed in 2015. It was submitted to the original people ( XXXX XXXX ) as well as several others that were fraudulent. It was already removed from my report. Somehow several collection companies including this XXXX Midland credit management, keep reopening this fraudulent debt and have been harassing me with mail and calls. I have told them to stop, they will not stop and refuse to stop. I just called again today and they argued with me and told me they were not going to stop.

Consumer Complaint: I have faxed over documents to Midland Funding on XX/XX/2022 for a debt validation for {$610.00} per the Fair debt collection practices act, 15 usc 1692g. I requested they office provide me with competent evidence that I have any legal obligation to pay them. They have failed to provide me that information, instead they provide what looks like an old bill from an unknown address.
