Someone changed my account information as well and Discover is blaming me for it. I don't appreciate being treated unfairly due to my XXXX and having to pay an amount that I can't afford and I'm not paying it Any longer I didn't charge up over XXXX XXXX dollars. Discover needs to be held responsible for their actions and stop treating me different do to my XXXX it's against the law and not allowed. According to the letter Discover closed the account due to the inability to access tax records for prior year, I was never notified by Discover financial services of their XXXX attempt. I have in the past had some issues with identity theft, therefore I have a Fraud alert with my account ( SS, Credit ) for my protection. I offered to assist Discover in this matter per IRS representative no information is released without the consent of social security holder. my approval is requested prior to any release of information. I have contacted IRS and they dont have any records of Discover financial attempts or requests. Consumer Complaint: DISCOVER FIN SVCS LLC Account number XXXX Account status Closed Date opened XX/XX/XXXX Account type Credit Card Balance on XX/XX/XXXX Credit Limit {$6900.00} {$6500.00} I am a victim of identity theft ; my personal information was stolen and used to obtain loans and credit cards. However, I was in XXXX from XX/XX/XXXX to XX/XX/XXXX when the fraud did not happen nor I have not benefited from any of this. I provided proof that I was XXXX ( identity theft report, the accounts, paper work from the government of my XXXX and validation letters ) to the creditors and all XXXX credit bureaus ( XXXX, XXXX and XXXX ) XXXX and XXXX was completed but not XXXX which they continue to keep reporting to the credit bureaus. I notified the credit bureaus several times and kept getting the same response ( verified ). They have not provided no evidence to prove that these accounts belongs to me. No signature that matches my handwriting or coming into any of their facilities ( of course i was in XXXX ). I have tried every method going back and forth which is giving me no justice at all. This has caused me XXXX, XXXX and XXXX I would like the accounts removed immediately. I provided all my evidence to prove that it wasn't me even down to the signatures on loan documents. All of my rights has been violated according to The Fair Credit Reporting Act ( FCRA ) The lawsuit will be filed due to the utter lack of response from your XXXX. When someone is the victim of identity theft, it is simply a nightmare trying to get false information removed from a credit file. I have contacted all of the false creditors listed on my credit file. I have challenged all of the false listings on my credit file. Nothing ever happens to fix the situation. Over 90 days ago I wrote XXXX in question and demanded proof that I am their customer. I asked for proof of the alleged debt, including specifically the alleged contract or other instrument bearing my signature. So far none of them has been able to provide such proof to me. I have sent follow-up letters to each of them and there is still no proof. I have attempted phone contact, but I simply get transferred around and nothing ever gets accomplished. I have fully investigated my rights in this matter. Under the doctrine of estoppel by silence, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I may presume that no proof of the alleged debt, nor therefore any such debt, in fact exists. I have copies of the certified letters and dates prepared to bring to court if needed. Also, under the Fair Credit Reporting Act, these disputed items may not appear on my credit report if they can not be supported by any evidence. Under the Fair Credit Reporting Act, if they can not verify the debt within 30 days, then it must be removed. Your letters to me claim to have " verified '' the debt, but this is in fact not true under law. Simply contacting the alleged creditor and asking them to match up numbers in their database is no sufficient verification for identity theft. Of course the information matches up. Someone clearly used my information without my authorization while i was in XXXX XXXX for being such a pain in the posterior to me. I have provided more than sufficient evidence to get these false accounts removed. This matter could've been settled simply by your agreement to remove the false information from my credit file with the evidence I provided. I will also be aggressively pursuing the full judgment that I can go against XXXX for violation of the Fair Credit Reporting Act and Defamation as well.

Consumer Complaint: A CREDIT CARD WAS OPENED FRAUDULENTLY UNDER MY NAME WITH DISCOVER. AS SOON AS I FOUND OUT ABOUT THE FRAUDULENT CREDIT CARD I CONTACTED DISCOVER AND I ASKED THEM TO CLOSE THE CARD, AT THAT TIME I GAVE THEM MY CORRECT MAILING ADDRESS, EMAIL AND A PHONE NUMBER. DISCOVER NEVER UPDATED ANY OF THE INFORMATION I GAVE THEM. THEY APPARENTLY MAILED A FINAL BILL TO THE ADDRESS THAT DOES NOT BELONG TO ME. I HAVE NOT RECEIVED ANYTHING FROM DISCOVER AT MY CORRECT ADDRESS THERE IS NOW 4 MONTHS NEGATIVE REPORTING ON MY CREDIT PROFILE FROM DISCOVER. THE CHARGES ARE FRAUDULENT, THE ACCOUNT IS FRAUDULENT. I HAVE ALSO REPORTED THIS TO THE LOCAL POLICE STATION AND TO FAIR TRADE COMMISSION, AND TO THE CREDIT REPORTING BUREAUS.

Consumer Complaint: My name is XXXX XXXX XXXX and I am filing this complaint against XXXX on my own behalf, as a Natural Person and Federally Protected Consumer, without any connection or involvement with a third party. I sent a validation of debt letter as well as a cease and desist to Discover Financial Services which they received on XX/XX/2021. Their response failed to meet my demands. I requested if their information did not meet my demands, to remove the balance from the account. They have not done that. I am consumer, alleged obligor, natural person and original creditor, as originator of consumer credit transaction lent Discover my accounts payable social security credit card number as cardholder and card issuer to accounts receivable secured consumer credit application and received access device Discover card. I as a natural person possessing an open-end credit plan was injured by Discover. Discover was directed to cease collection efforts and communication with third persons in honor of my right of privacy and confidentiality per 42 USC 408a ( 8 ). Discover took adverse action and closed my account without my consent unfairly. cardmember agreement specifies it is subject to governing law of federal regulation for which the right invoked was exercised in good faith. Discover despite forfeiting its right to collect for the adverse action take continues to deliberate report personal information to third persons without my consent. I have advise third persons that I revoke the right to report from Discover and for them to honor my right of privacy. XXXX XXXX has complied. All others have sided with the furnisher regarding my consumer information alleging that the debt is verified in violation of 15 USC 1692b ( 2 ). Discover is now civilly liable to me.

Consumer Complaint: This is the second communication in regards to Discover who I was sent a letter via email. The phone number I contacted did not go through to a individual. ( Attempted 12 times in one day ) I subsequently called the number to see if the manager would correct the problem. My health condition is serious and I explained that I wrote down the amount of the settlement amount. The customer service manager made statements that were false and misleading as they did before. I was not told they would settle for 50 % as the manager explained that a disclosure would be required. Then in the following statement made the comment that 50 % was offered but expired in XX/XX/2021. I'm presently on permanent XXXX but did take notes and the representative when I requested 50 % and representative said it would be required to be approved. I told the representative that I would like to make it happen now to settle the account. It is at the point where they placed words into my mouth by confusing me. I suffered a serious head injury and can not understand when the agent has attempted to confuse me and places several numbers out. The one number that was said repeatedly based on notes was 65 %. The amount of 50 % would have been agreed upon with the time required to settle the matter. While this is what I can get and needed a few months was represented in a manner that confused me.

Consumer Complaint: Dear Sir or Madam, 1. DISCOVERBANK Account Number:XXXX**** Please correct this inaccurate information on my credit report. I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 30 days late on this account in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX as wells 60 days late on XX/XX/XXXX and XX/XX/XXXX. I immediately disputed this information with DISCOVERBANK and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. 1666a. Regulation of credit reports ( a ) Reports by creditor on obligor 's failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section 1666 ( a ) of this title, a creditor or his agent may not directly or indirectly threaten to report to any person adversely on the obligor 's credit rating or credit standing because of the obligor 's failure to pay the amount indicated by the obligor under section 1666 ( a ) ( 2 ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section 1666 of this title and has allowed the obligor the same number of days ( not less than ten ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. ( b ) Reports by creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section 1666 ( a ) ( 2 ) of this title, unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. 1666b. Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). I DEMAND to see proof that I was mailed my statement to the correct address notifying me of both payment due date and delinquency of payment on the account. If you can not provide 100 % Verifiable proof and proper documentation that the CREDITOR fulfilled its obligations under the ( FCBA ) and ( FCRA ), I therefore demand these late payments be removed from my account or I will be forced to be in contact with the Attorney General of my State and the Consumer Financial Protection Bureau. I therefore am submitting my written request to you to conduct an investigation. Per the FCRA, you have 30 days to conduct this investigation and respond to my request. Consumer Complaint: On XX/XX/2021 I deposited a check issued from tax products group and a XXXX business day hold was placed on it. Fair enough. On XX/XX/2021, the check cleared and was available in my discover account finally. Attempted to wire transfer to my XXXX XXXX account XXXX dollars because I owed that much in bills so I was aiming to use that bit for bills. When attempting, I received an email from discover stating there was a freeze on my account and to contact them immediately. I called and they stated that due to a business decision they were closing my account. I asked them about my funds and they said they would not release any funds until a 90 day investigation which is insane. I even stated to them that they violated their on deposit agreement. Nothing in the deposit agreement stated holding funds from a closed account what so ever. So I called and called and finally got a hold of somebody who said the only thing that I could have done was to get in touch with the check issuer and ask them to recall the funds. Well the day after I spoke with discover I called the tax groups number and they said being that the check had been cleared and the deposit was successful that discover took the money already ( not to mention XXXX of the funds were sent to my XXXX XXXX the day AFTER account closure. I read over and over the deposit agreement and it simply stated that funds would be released to the account holder at the time of closing. I filed a complaint with their executive ioffice and got no aswer. This isnt right I didnt do anything but attempt to do things that my account was allowed to do which is initiate a wire transfer. Ive talked to them about a transfer of my funds to my XXXX XXXX but said no. Ive tried and tried and seems like they dont plan on being fair with me. I struggle on a day to day basis with everything I owe and other things like say care with I work XXXX hours a week just to put food in the table.
