Consumer Complaint: I'm filing this complaint on behalf of my XXXX XXXX XXXX son. My son opened a Discover Card account while he was in college. At that time,XXXX, he had a part time job and I wanted him to start building his credit. His stated annual gross income was {$2000.00} and Discover gave him a {$750.00} line of credit. My son now has a {$6600.00} line of credit and he has never asked for an increase. My son 's profile on the Discover Card website indicates that he still has a stated annual gross income of {$2000.00}. My son is now out of college and looking for a job. In the course of looking for a job in the past year, he has reached his credit limit. On XX/XX/2023 my son and I conferenced called Discover Card to try to negotiate a reasonable payment plan. After speaking to XXXX agents and over an hour on the phone, the best Discover Card would do would be to lower his APR to 16 %. I do not find this acceptable and I don't understand how a person with a stated stated annual gross income of {$2000.00} can get {$6600.00} in credit.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Investigation took more than 30 days

Consumer Complaint: COVID hit California and my son was enrolled in XXXX XXXX XXXX University and the University shut down and the students were sent home. Discover Student Loans took my Son out of the Deferred Status to the Repay Status. So, XX/XX/XXXX we made the payment of XXXX on time. Then in XXXX I paid in advance for XXXX, XXXX, and XXXX of {$200.00} ( when XXXX, 3 months so I overpaid by XXXX ). Still in XXXX the continued to bill me at XXXX, then billed me for XXXX another XXXX. So XX/XX/XXXX I paid the XXXX, Then I paid a payment on XX/XX/XXXX another {$100.00} Still ahead by XXXX, now add XXXX of which was included in my XXXX payment of the {$200.00}, so now I am ahead by {$140.00}. I pay over the phone and choose the advance pay option, but they obviously are not noting the account. So, they keep billing me the XXXX, I don't make another payment until XXXX of {$160.00} because I have paid in advance for XXXX and XXXX, still leaving reserves. The automatically billed me for XXXX and XXXX of which the payments were returned because I did not know they signed me up for automatic payment. Should not matter because I was already paid through XXXX, then in XXXX I paid {$260.00} because they said I owed them the money, but in fact at this point from XX/XX/XXXX to XX/XX/XXXX I paid a total of {$780.00} which is {$96.00} over the payment schedule they gave me of XXXX each month.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: Unfortunately, I am a victim of identity theft as a result of a data breach. When I learned of this, I began reaching out to the institutions and banks reflected on my credit report, all of which I have no affiliation with outside of the fact that my information was fraudulently used to open up a plethora of accounts under my name. I have been successful in the process of disputing these accounts and outstanding balances with XXXX out of XXXX accounts, which have since been removed from my credit report as a result of my actions and efforts to prove that I was not the individual involved in opening the accounts. However, I have been in the process of disputing credit with DISCOVER BANK, XXXX XXXX XXXX XXXXXXXX XXXX XX/XX/2022 and have yet to have my case resolved with these agencies. With Discover Bank specifically, I have submitted copies of police reports, an FTC report, proof of identification and personal statements, and have expressed my frustration with their lack of attention and ability to identify my account activity as fraud, yet they continue to write back to me saying that " unless I have new or relevant information to support my claim, '' they can not move forward with my dispute. I feel this is unfair on their part, I have taken all actions and have provided all documents necessary yet they sustain that nothing more can be done. As for the XXXX other entities, they have approved my dispute and XXXX calendar days have passed since their approval yet the derogatory information still appears on my credit report. I feel that I have taken every step possible in moving forward and I no longer know what to do to restore my credit.

Issue: Problem with a purchase shown on your statement

Subissue: Credit card company isn't resolving a dispute about a purchase on your statement

Consumer Complaint: Discover is refusing to properly reassert and CORRECTLY INVESTIGATE dispute. I was told on XXXX by The Discover Fraud Department that they will not reassert my dispute without new information. Counts as follows ; 1. Due to not being able get in touch law enforcement. RESPONSE : I called and spoke with the police department ; they said they have received no phone calls or messages from Discover, but would speak with them if they call. 2. That I viewed activity on a XX/XX/XXXX and XX/XX/XXXX and did not report until XX/XX/XXXX. RESPONSE : I called in on XX/XX/XXXX, XXXX, XX/XX/XXXX, XXXX, XXXX, XXXX, XXXX, and XX/XX/XXXX all reporting that my card was lost and my account needed to be locked. I received correspondence emails stating that Discover was sending me a new card, crediting my account and locking my account. BUT I NEVER RECEIVED A NEW CARD AND MY ACCOUNT WAS NOT REPORTED. 3. That I made payments from XXXX to XXXX prior to reporting fraud. I DID NOT MAKE ANY PAYMENTS UNTIL XX/XX/XXXX. 4. My name and phone are spelled incorrectly on all fraudulent charges. PLEASE LOOK AT THE BILLING AND SHIPPING ADDRESSES. THEY ARE WRONG!!!! Under the federal Truth in Lending Act ( TILA ), credit cardholders can only be held liable for unauthorized charges up to {$50.00}. Because Im facing charges of more than {$1700.00} Discover can not demand payment of this unauthorized charge or any related fees. I did exactly what I was supposed to do under these circumstances. When she received her credit card statement, I reviewed it immediately. Then, I quickly disputed the unauthorized charge multiple times. As soon as Discover was notified about the disputed charge, it was obligated to perform an investigation under the federal Fair Credit Billing Act ( FCBA ). At first, it appeared that the charge was handled correctly because the charge was reversed and removed from my account. But when the charge reappeared and I re-disputed, the credit card company violated the FCBA by : -Failing to perform a proper investigation, -Failing to consider the evidence XXXX provided XXXX -Failing to provide proof of the contract or receipt that XXXX allegedly signed in support of the charge, -Permanently reinstating the charge that was previously removed, -Refusing to provide an adequate written explanation of its decision and supporting documents to justify the reinstated charge, and -Continuing to demand payment of the charge and associated interest and fees. -Unlawfully charging XXXX for a transaction I did not authorize, -Failing to investigate and correct the charge, -Falsely claiming it did investigate, Billing me for amounts I dont owe, and -Trying to collect the unauthorized charge while adding interest and other fees.

Issue: Problem with a purchase or transfer

Subissue: Card company isn't resolving a dispute about a purchase or transfer

Consumer Complaint: I got an email from what seemed to be XXXX with a number to call and that there was a request for money : when I called they claimed my Discover Card associated with my XXXX account had been used to make large purchases, and the only way they could try and recoup the money was for me to go out and buy 3 gift cards at {$500.00} each from XXXX and XXXX. When I questioned the legitimacy, they called me back from the XXXX # on back of the Discover credit card. They stayed on the phone, and after the first two purchases and scan to them ; the 3rd XXXX purchase was declined, and they were no longer on the phone. XXXX claimed that the {$1500.00} purchase had been confirmed via email, also claimed that my email must have been compromised. I promptly changed my password. When I called the same XXXX number, from the back of the card, back myself, I was told that this was a scam, and that there was no way for me to be reimbursed or the charges to be cancelled. I have since removed any payment form from XXXX.
