Consumer Complaint: I reviewed my credit report on XXXX at XXXX, XXXX and XXXX. I discovered I have a fraudulent collection account appearing on my credit report. This is not my account and I have submitted fraud claim to XXXX, XXXX, and XXXX. You are to remove this fraud account immediately before i pursue legal action. Under federal regulations this does not qualify as a " valid verification of debt ". I have previously sent you a request to validate my debt under the Fair Debt Collection Practices Act and all I received was an itemized list of the alleged charges you claim I owe you. This does not meet the Federal Trade Commissions guidelines of what constitutes proper debt validation. In addition, in the case of Spears Vs. Brennan ( IN THE COURT OF APPEALS OF INDIANA, No. 49A02-0003-CV-169 ), the court ruled that : 15 U.S.C . 1692g ( b ) ( emphasis added ). On XX/XX/1996, nineteen days after the date of Brennans debt collection letter, Spears counsel Shepard sent Brennan a letter declaring that Spears disputes your debt collection-related allegations, denies the same, and demands strict proof and verification thereof. Record at 21. As such, Brennan should have ceased his debt collection efforts immediately upon receiving that letter. Instead, Brennan proceeded to obtain a default judgment against Spears on the debt collection claim before he had mailed Spears the necessary verification and, thus, violated 15 U.S.C. 1692g ( b ). Brennan maintains, however, that there was no violation of the FDCPA because he sent adequate verification of the debt [ to Spears ] in the XX/XX/1996 notice of claim. Brief of Appellee at 13. Specifically, Brennan claims that a copy of the consumer credit contract between Spears and American General attached to the notice of claim provided sufficient verification of the debt within the meaning of 15 U.S.C. 1692g ( b ). We can not agree. The contract in no way provides sufficient verification of the debt. A review of the document reveals that it identifies only the terms of Spears loan, including a 17.99 % annual interest rate and the original loan amount of {$2500.00}. The loan agreement contains no accounting of any payments made by Spears, the dates on which those payments were made, the interest which had accrued, or any late fees which had been assessed once Spears stopped making the required payments. Indeed, the existing unpaid contract balance at the time Brennan sent the debt collection notice was at least {$350.00} more than the original loan amount.

Consumer Complaint: 5 years ago, I purchased a XXXX ridgeline with XXXX XXXX the loan was with XXXX XXXX acceptance for {$11000.00}. I've been making payments on the vehicle for about XXXX and when I asked how much I still owe them I was told {$11000.00}. The ended taking back the vehicle. They called and harassed me at various hours of the morning, so I blocked the number and now another company is calling me called Jefferson Capital Systems LLC saying I owe them money. Each time they've called me they have threated to take my property and take money from my account. They've sent letters to my house, having people knocking on my door, and scaring my kids. I have no idea what these might do next. They've been lying about serving me papers about having me in court. I've never seen anyone but my kids because I'm not home. I am in Georgia trying to setup a business and I can't focus because of this company. My wife has calls me a few times and she is also worried about these people. I don't know what to do so I researched what to do and filed a complaint.

Consumer Complaint: This account is not my account. I have previously disputed this account and it was removed. Then was later added back. My identity has been stolen multiple times. Around the same time this account was open there was approximately four other cell phone accounts, open and a three month period. Obviously fraud. I previously asked them to send me a debt validation letter in the mail and they sent me a bill. They can not provide me with my whole Social Security number, and they have the original address on the original account incorrect. Wrong apartment number. Id like this removed from your credit report immediately

Consumer Complaint: Disputed online about the validity of the collection account. Stated verified online. Now the dates changed and they won't let me dispute online. When I contacted XXXX by phone today XXXX/XXXX/23, the cs rep said the collection company only has to say that the account is valid. Not that there is any documentation of proof. Thus being extremely lax on the FCRA. They put the burden on the consumer. They said to take it up with creditor for proof. Debt collector in this case is Jefferson Capital.

I sent over the attached documents to validate the debt on XX/XX/23, but Jefferson did not respond, in the 10 days given from XX/XX/23. It is not XX/XX/23 and still no response. I noted to kindly tender a {$1000.00} dollar payment if no true bill or the validation of the alleged debt was sent to me within those 10 days and no response was sent by Jefferson Capital.

Consumer Complaint: A XXXX XXXX branch has repeatedly placed fraudulent credit debt collection accounts for an amount that i do not owe, is highly inaccurate, and i am not accountable for. I had a XXXX phone account that was payed and ended in XXXX. The final bill was {$310.00} and I payed it and later ended my service. The company proceeded to illegally give my email, current account and following current number I had rights to by the service contract while it was still in use to another person. Then proceeded to bill and place a false report on my Credit for an amount of {$730.00}. This was taken down in XXXX due to fraudulence and inaccuracy by XXXX As XX/XX/XXXX they place another false credit report of a account debt collection for {$710.00} through another state. I have already tried to contact the company and deal with the problem during XXXX and I even did ask for a corrected amount to the account that I had payed during the final {$310.00} and to get the account info they where using and they not only denied services when I co-operated while willing to pay a reasonable amount to resolve the issues in a proper manner for services that i didnt even have. But Their info was also entirely incorrect on their company side down to who's name was on the phone number tied to the account to inaccurate amounts while having my ID in their services falsely blacklisted with incorrect info. I am at the point where I will no longer try to co-operate with them and would rather sue them for fasely ruining my credit and report their illegal actions.
