Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: I am filing a complaint against Jefferson Capital Systems who has illegally accessed my personal financial information and used it for their own gain. They have underhandedly used the following set of USC Codes to obtain debtor information in order to collect on a debt that I do not owe : 15 USC 1692e, 1693-1693r, and 1693e. 15 USC 1692e of the Fair Debt Collection Practices Act, states that debt collectors are prohibited from using false, deceptive, or misleading representations when collecting a debt. The Fair Credit Reporting Act, as outlined in 15 USC 1681-1681u, sets standards for credit bureaus and third-party debt collectors to maintain consumer credit information. It also requires them to provide debtors with accurate credit reports and dispute inaccurate information. Furthermore, the Unfair or Deceptive Acts or Practices Act ( UDAP ), as stated in 15 USC 45-56, prohibits Jefferson Capital Systems from engaging in unfair or deceptive practices when collecting a debt. This includes misrepresenting the nature of the debt or the amount due.
