Consumer Complaint: 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party, unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' The companies never informed me of my right to exercise my nondisclosure option. Also,15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information ; any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. These accounts are adverse items that are reporting without my consent which is against the law. Furthermore, these adverse items also violate The Privacy Act of 1974 and 16 CFR 313. I sent a letter on XX/XX/XXXX exercising my consumer right to opt out and these companies completely ignored me and are continuing to furnish my personal information without my consent.

Consumer Complaint: Violation of Code 15 USC 6802 and 6805 ( a ) - Opt-Out Reporting Dear Sir/Madam, I hope this letter finds you well. I am writing to file a formal dispute regarding a violation of Code 15 USC 6802 and 6805 ( a ) related to the opt-out reporting requirements outlined in the aforementioned codes. I recently discovered that Jefferson Capital System which is third party debit collector which XXXX the original credit sold my information to, Jefferson Capital System has failed to comply with the opt-out reporting obligations as mandated by Code 15 USC 6802 and 6805 ( a ). These codes require financial institutions to provide consumers with the right to opt out of certain information sharing practices and to report their compliance with these opt-out requests. Despite my explicit request to opt out of information sharing, [ Name of Financial Institution ] has continued to share my personal financial information with third parties without my consent. This violation not only infringes upon my right to privacy but also undermines the trust and confidence that consumers should have in financial institutions to protect their personal information. I have made multiple attempts to address this issue directly with Jefferson Capital System, but their response has been inadequate. They have failed to acknowledge my opt-out request and have continued to share my information without my consent. In light of this, I kindly request your assistance in investigating this matter and taking appropriate action against Jefferson Capital System for their violation of Code 15 USC 6802 and 6805 ( a ). I believe that their non-compliance not only disregards my rights as a consumer but also sets a dangerous precedent for the protection of personal financial information. Consumer Complaint: I'm experiencing the same problem, but with a different company. Please refer to my cfpb complaint # XXXX dated XX/XX/XXXX where you will find the exact same circumstances that cause this complaint. While I trust the integrity of your filing system, I'll repeat the narrative here from the referenced complaint : " On or about XXXX XX/XX/XXXX I was notified by my credit union that my checking account had been overdrawn in the amount of {$1100.00}. When I went to the XXXX XXXX to get an explanation I found that XXXX had erroneously charged me for prematurely terminating the terms of my phone lease for 3 phones. This was an error on their part. I had enabled auto-payments for my bill, so they withdrew the funds and left me with the overdraft [ and associated fees ]. When I called XXXX XXXX XXXX to dispute the erroneous charge the representative told me that he wasn't sure why the charge was made ( because I certainly didn't terminate my lease! ). I asked how soon the charge could be returned to my account and he told me it would be 7-10 days. I explained ( that ) their action resulted in the overdraft of my account, and I need that money to pay my rent and other bills. I told him the 7-10 day period was not acceptable, and asked if some type of exception could be made due to it being their error. I told him I was concerned about the erroneous charge refund policy, but more concerned about the situation I was left in due to the error. He told me there was nothing he could do. I again asked if there was some type of exception for me as a XXXX customer, or if there was someone else I could speak with ( escalate the call ), he said no and ended the call. I have been in XXXX XXXX my entire professional career ( over 35 years ) and [ XXXX ] this interaction was a perfect " learning opportunity '' for that young man, but apparently that call was not monitored or reported because I was never contacted by anyone in XXXX 's XXXX XXXX leadership. I can not describe th feeling of helplessness. My first action was to terminate the auto-pay to XXXX ( I was also required to submit a stop-payment order for them because they subsequently tried on two occasions to again withdraw those same funds! Is that legal? ). I then had to request a loan to pay my rent which they quickly approved because the representative heard my conversartion with XXXX. Not once did they acknowledge their error, or offer me an apology for the shoddy service I received as a XXXX customer. Some days later I changed my service provider. I was sent communications from two different collection agencies on behalf of XXXX that were disputed through XXXX and invalidated. The results from the dispute with XXXX. XXXX were posted on XX/XX/XXXX, and with XXXX XXXX on XX/XX/XXXX. Today I received communication from XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, MN XXXX, also on XXXX 's behalf. I am aware that many companies sell debts to collection agencies. In my opinion this company has purchased a " bad '' debt that has been twice invalidated. I feel XXXX is harassing me with these collection attempts that are a result of their error and terrible of their ( former ) XXXX customer. Can XXXX be compelled to stop these collection attempts? They wouldn't let me clear my debt up. They then said they sold it, I asked to who, they refused to tell me so I could settle my debt with them. The refused to tell me anything. They informed me that this is still being worked on and that they did receive my email along with my Social Security XXXX Letter. and that I have to wait another two weeks- which would of been way over a month from the file of their civil complaint and not allowing me proper response time to the court. Today, XX/XX/XXXX I contacted XXXX XXXX again because still I have yet to hear back from their attorney XXXX XXXX this Wednesday XX/XX/XXXX will be 1 month from their date of file. The agent asked me to hold on the line and see what information he could find. He placed me on hold for XXXX minutes and came back that his manager is going to let this case proceed with litigation. I explained again that Im unable to pay ; that I'm permanently XXXX and only receive Social Security. He said... O well and put me back on a voicemail for XXXX XXXX.

Consumer Complaint: XX/XX/2023 Jefferson Capital Systems called twice. The first call I was told they were going to dispute claim and send me paperwork. Then on XX/XX/XXXX they called me again and said I have a debt collection and I told them I do not have an account with them and have filed a dispute and I told them what I was told on prior call, that they were suppose to be filing a dispute. I was told again they were sending me a fraud package and it would take 30 days to receive it. I was told to complete paperwork and send it back. They say this debt originated from a company called XXXX, I have no clue who this company is or what this debt is for. Now I have 2 collections accounts from Jefferson Capital on my credit reports. Also I have disputed an address and a phone number on my credit report that do not belong to me with the credit companies. I need help in getting this off my credit report, this is identy fraud. On XXXX I spoke with XXXX and they directed me to file complaint with you, because their investigation about the dispute was verified as accurate which is incorrect.

I have never had any account with JeffersonCapitalSystems. Also, I have no relationship with them.They cant provide me with any agreement that I may have signed with JeffersonCapitalSystems simply because it does not exist.. This is clearly a fraudulent act on the part of JeffersonCapitalSystems. Because of their ruthless and illegal practices my credit score, as well as my life, has been impacted negatively. According to my records, I did not receive written notice of the debts from XXXX XXXX XXXX XXXX XXXX, and my right to dispute under the Fair Debt Collection Practices Act. As a result of their most recent actions, I have suffered great harm to my credit score as a result of these alleged debts being reported as collection items. Please note that I have filed a previous complaint against Jefferson Capital Systems , LLC in 2015 ( XXXX ) about the same issue regarding written verification of the debt and the right to dispute.
