States I have the right to privacy. 15 U.S.C 1681 section 604 A section 2 : It also states a consumer reporting agency can not furnish a account without my written instructions. 15 U.S.C 1681c. ( a ) ( 5 ) Section : states no consumer reporting agency may make any consumer report containing any of the following items of information. Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. 15 U.S.C 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.

Consumer Complaint: on XX/XX/XXXX, a payment through XXXX was made for the purchase of one golf cart through what I believed was a legitimate company located in Pennsylvania. We exchanged several phone calls and then I decided to purchase. After the seller would not contact me back, I phoned the company headquarters in Texas at which time i was told that if was fraud. It appeared the companys website had been cloned. ( The website is still up and active by the way ). I filed a fraudulent claim with both XXXX and Capital One. Capital One would credit the dispute and then reapply. After several months of trying to resolve the issue, Capital One sent a notice that the charge was no longer disputable due to the amount of time involved. XXXX had responded saying my case " was won '' and that Capital One should be contacted to find out where the funds were. At times, I even contacted XXXX, above Capital One without any success. I have filed a complaint with the West Virginia Attorney Generals Office as well. I am out the funds. I do not understand why XXXX could not have reversed the funds in the account. They have not been very helpful. Again, the website is still active, in fact the same crooks have a new website selling Kayaks. Consumer Complaint: On XX/XX/XXXX I received for at least the 12th time an offer from Capital One to apply to their Platinum Card. I decided to try again for this card as the last time they stated they could not approve me due to " not being able to verify my identify via phone ''. The same happened again, where i received a denial email and the call rep i spoke to said " they couldn't reach me by phone and to file a dispute with the credit bureau ''. My phone number is correct XXXX on ALL THREE Credit Bureaus, i actually verified this 20 minutes before i decided to apply. In addition, I hold a CAPITAL ONE Checking and SAVINGS account to which Capital One has my personal information. In XX/XX/XXXX, I also obtained a mortgage as well as another credit card with their competitor in XXXX XXXX and a car loan in XX/XX/XXXX. Capital One continuously DENIES be based on the only factor of " could not verify identify/reach by phone ''. I have disputed this several times, considering the information they have is completely outdated and their system is never updated. If the FEDERAL GOVERNMENT and LENDER can verify my information for a MORTGAGE and have the correct phone number, as well as other lenders, than this is a capital one issue in their systems. I am tired of being told that I am the one who has the issue and to contact the credit bureaus. I have already contacted them this first time this has happened. I applied for Capital One Card THREE Times once on or about XX/XX/XXXX, XX/XX/XXXX and then most recently on XX/XX/XXXX, as well as capital one auto finance in XX/XX/XXXX all with the same denial Yet their pre qualify mailer they have already soft pulled my credit and have my information as well as from my checking account info with them. As of this complaint I now have THREE hard inquiries on my credit bureau due to this and THREE Adverse Actions in the period of a year. I have incurred the same issue with Capital One denying me for the same reason, when the issue is completely on their end and my credit DOES qualify. This is deceitful business practice!

Under 15 US code 1666b a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. Kohl 's violates this right on my credit report.

Consumer Complaint: Capital one bank had promotion for opening a new saving account during XXXX. They advertised that getting a new account bonus {$500.00} for depositing {$50000.00} or more of external funds within 15 days of account opening and maintain {$50000.00} or more in your account for at least 90 days. I opened that account on XX/XX/XXXX and transferred fund XXXX from my external XXXX account on XX/XX/XXXX. I kept fund ( which above XXXX ) till XX/XX/XXXX ( which is over 90 days ). However, I only received XXXX XXXX bonus on XX/XX/XXXX ( which is the lower tier of the promotion ). Then I called customer service on XX/XX/XXXX. The customer service told me that the reason why I could not get the {$500.00} bonus is that in Capital one term the 90 days starts after the 15 days opening period is over. For example, I opened the account on XX/XX/XXXX, the 90 days period started on XX/XX/XXXX. This does not make sense to me because there are only two requirement on its promotion : 1 ) putting fund into the new account in 15 days after the account is opened. ( I met ) 2 ) keeping the balance at least 90 days ( I met ). The promotion never mentioned that starting date of 90 days period starts the XXXX day after the account opening date. Even though the customer service apologized to me and agreed that this does not make sense, she could not do anything due to capital one system setup. I think this is false advertisement which mislead customer.

Consumer Complaint: Capital One Credit Card is reporting an alleged debt owed for card XXXX XXXXXXXX on my consumer reports. This debt is reflecting as charged off. Pursuant to Federal law, once a debt is charged off, the consumer is supposed to receive a 1099 in order to report that amount as income. It is also Federal law that income is illegal to report on a consumer report. Therefore, once Capital One decided to charge off the debt, it should have been removed from all consumer reports. In an initial complaint to Capital One, I addressed 2 credit card accounts at the same time for the same reasons. Capital One fully acknowledged one account ( XXXX XXXXXXXX ) stating that it was sold to a 3rd party debt collector. That account was also a charge off account. Capital One has since ceased reporting that account on my consumer report and deleted it but refuses to remove the 2nd credit card account which is also illegally reporting. My consumer report only reflects Capital One as the creditor and only furnisher of illegal data of this alleged debt and not XXXX XXXX whom they claim they sold the debt to. I have attached the letter from Capital One clearly stating that the account was sold to XXXX and that the account ending in XXXX XXXXXXXX was deleted from my credit files per the request of Capital One. Account XXXX XXXXXXXX is no different and should also reflect the same remedy. My credit is being tarnished and discriminated against due to this illegal and misleading reporting by Capital One. Capital One 's negligence is causing me undue hardship and adverse actions. I have not been able to get approved for credit to provide for my family.

Consumer Complaint: Capitol One allowed a checking and savings account to be opened fraudulently even though I have locked my credit with all three credit unions and put on a fraud alert. No new accounts were to be opened without verifying with me per the fraud alert, but CapitalOne either saw the alert and ignored it or did not bother to check. Capital One does not provide a 24/7 hotline, or even an easy to find contact to report such fraudulent activities. There is a general number, but to actually speak with somebody you need to enter an account number, which I don't have, because I don't have an account. Capital One should have immediately flagged this account as suspicious : when a new account is created and then the contact phone number and email address are immediately changed that is a major red flag that any reasonable person would have picked up on, but Capitol One completely ignored this activity. XXXX : XX/XX/2023 XXXX, am woken up by a text message saying " Thanks for giving Capital One your mobile number ''. A few emails are received at the same time : 1 : Welcome, your new 360 Performance Savings account is open. 2 : Congrats! Your new 360 checking account is open. 3. Success! Re : your CapitalOne profile changes. One or more phone numbers on your CapitalOne profile have been updated. These were quickly followed up with : XXXX 1. We've updated your phone number 2. Your email address was updated With all of their automated systems, nothing about creating an account then immediately changing the phone number and email address raises a single flag?

This/these lines of credit must be restored forthwith.
