Consumer Complaint: On XX/XX/2023, i applied to a promotion from Capitol one to apply for their savor one credit card. The promotion promised {$200.00}. In return for {$500.00} of spending in 90 days. I was approved for the card and charged over a XXXX dollars on it. When I called yesterday, XX/XX/XXXX, I was told by a supervisor XXXX ( ID # XXXX ) that I didnt qualify for the bonus. When I asked why she said read you terms and conditions. When I pressed for further explanation, she repeated the same thing, and offered no other details. I offered to send her a copy of their promotion but she wasnt interested. The terms in the promotion ( see attached ) seem very straightforward and as far as I know I met them. Whatever the reasons Capitol one is using to deny the promotion payout is to me irrelevant considering the advertising they use to lure consumers in only to deny them their offer later.

Consumer Complaint: I have repeatedly reached out to XXXX XXXXCapital One Card to understand and reconcile a fair minimum payment that is due each month, but they refuse to lower my minimum payment. The minimum payment they expect each month is extremely high, egregious and unbelievable. I asked if I could pay {$560.00} each month for the remaining 11 month interest free promotion and they said no. I need to still eat and pay my mortgage, electricity etc. It's like they are forcing me to pay off my card in less than twelve months by having me pay {$830.00} per month. I've repeatedly shared I'm not dismissing my responsibilities and they are still getting a substantial amount of money each month. I didn't pay {$830.00} for the month of XXXX and I was only able to pay {$600.00} for the month of XXXX. I have a 100 % on time paying rate and now my credit score is going to be adversely effected by what's going on with XXXX XXXXCapital One Card. This is not honoring a true 12 month interest free promotion card. I don't know what this is or should be called. I have never had issues with a credit card before in my life like what I am experiencing now.

Consumer Complaint: On XX/XX/XXXX a bill of exchange was sent to Capital One through certified mail, documents received XXXX Second notice sent XX/XX/XXXX with bill of exchange payment, Power of Attorney and tender accepting all titles, rights, interest, and equity owed to XXXX XXXX and transfer principal balance to the principal account for {$2700.00}. If not honored Capital One was required to apply the entire payoff balance ( {$24000.00} ) to the principal account, send vehicle and title to the agent acting on behalf of the principal. Third notice sent XXXX with tender to transfer the principal balance to principal account and was giving five business days. With no response Capital One is now in a breach of contract. Capital One sent documents showing information pertaining to the principal account of fraudulent activity. Copies of the agreement between XXXX XXXX and the dealership ( XXXX XXXX XXXX are different from the contract sent from Capital One. I did not sign any paperwork with Capital One and the copy does not match, my signature was forged, and paperwork was typed in. Also, the price given at the dealership is not the same on paper, a warranty was added to the vehicle without my acknowledgement or signature. Capital One Auto Finance not only breached the contract by not honoring their duties as the Federal Reserve Act Section 16 they also committed fraud ( identity theft ). This has really ruined my life because I have been unbale to go to work. According to Federal Reserve Act section 29 ( a ) First Tier. Any member bank which, and any institution-affiliated party ( within the meaning of section 3 ( u ) of the Federal Deposit Insurance Act ) with respect to such member bank who, violates any provision of section 22, 23A, or 23B, or any regulation issued pursuant thereto, shall forfeit and pay a civil penalty of not more than {$5000.00} for each day during which such violation continues ( b ) Second Tier. Notwithstanding subsection ( a ), any member bank which, and any institution-affiliated party ( within the meaning of section 3 ( u ) of the Federal Deposit Insurance Act ) with respect to such member bank who A. commits any violation described in subsection ( a ) ; B. recklessly engages in an unsafe or unsound practice in conducting the affairs of such member bank ; or C. breaches any fiduciary duty ; 2. which violation, practice, or breach A. is part of a pattern of misconduct ; B. causes or is likely to cause more than a minimal loss to such member bank ; or XXXX results in pecuniary gain or other benefit to such party, shall forfeit and pay a civil penalty of not more than {$25000.00} for each day during which such violation, practice, or breach continues. ( c ) Third Tier. Notwithstanding subsections ( a ) and ( b ), any member bank which, and any institution-affiliated party ( within the meaning of section 3 ( u ) of the Federal Deposit Insurance Act ) with respect to such member bank who 1. knowingly A. commits any violation described in subsection ( a ) ; B. engages in any unsafe or unsound practice in conducting the affairs of such credit union ; or C. breaches any fiduciary duty ; and 2. knowingly or recklessly causes a substantial loss to such credit union or a substantial pecuniary gain or other benefit to such party by reason of such violation, practice, or breach, shall forfeit and pay a civil penalty in an amount not to exceed the applicable maximum amount determined under subsection ( d ) for each day during which such violation, practice, or breach continues. ( d ) Maximum Amounts of Penalties for Any Violation Described in Subsection ( c ). The maximum daily amount of any civil penalty which may be assessed pursuant to subsection ( c ) for any violation, practice, or breach described in such subsection is 1. in the case of any person other than a member bank, an amount to not exceed {>= $1,000,000} ; and 2. in the case of a member bank, an amount not to exceed the lesser of A. {>= $1,000,000} ; or B. 1 percent of the total assets of such member bank

I sent them a letter regarding the inaccuracies in my report such as date of last activity, date opened, date reported, payment status etc. They took more than 30 days to complete the investigation and they claimed that they did a thorough investigation. However when I checked my report, I did not see any changes made at all. The inaccurate information are still reporting. My rights has been violated numerous times. 15 U.S.C 1681 section 602 A. States that I have the right to privacy. 15 U.S.C 1681 section 604 A Section 2. It also states a consumer reporting agency can not furnish an account without my written instruction.

Consumer Complaint: Capital One offered a great opportunity for a CD. Offer was 5 % APR for 9 month term. I opened the account on XX/XX/XXXX and requested a transfer from XXXX of {$190000.00} to fund this CD. CD was never funded and I have no idea why. Ive contacted them several times. Was told they have had a lot of issues opening these account and that they would look into it, give them 30 business days and they would have an answer. Yesterday, XX/XX/XXXX was 30 days. I called today and they still have no answer as to why the funds transfer did not complete. They have no answers and will escalate yet again. In the meantime my brother opened a CD and has earned $ XXXX. Ive lost out on interest because of their issues. Not right for them to offer and not fulfill. Consumer Complaint: Im not sure which month but someone accessed my account and used a checking account to pay the bill and it kept coming back as nsf and the amount that was paid was charged back to the account which was more than what I originally owed and they added it on to the balance so it caused my payment to go way up so I couldnt pay and they refused to refund that amount that they charged back. I could understand if the account was used if that money that came back as a nsf but they never gave that money available to use and nothing else was charged to the account so my {$500.00} credit limit is not {$1500.00} which is impossible because how can they charge me triple what my credit limit is if they never have the money available while processing the nsf ach that someone did on my account. I want all that money refunded that was charged to my account. Not only did they charge the excess money on my account but they blocked me from disputing or even accessing my account. They wont let me in my account at all now or talk to me because I dont receive the text messages or phone call to my phone number from them for some reason. I can get everyone elses messages and phone calls but not theirs. I just want that money removed from my account so I can pay off my credit card and be done with them. I also want the late fees and everything removed from my credit report since I didnt have access to my account to even pay for it.

In addition to the opened accoiunt, a credit card application through Capital One was still in process. I checked my credit report and found hard inquires from Capital One for these accounts. I have been assured that this bank account and credit card are either closed or canceled, but I have not received the promised letter to me and the credit bureau regarding this fraud, and it remains on my report. I have disputed this several times with XXXX without any notable investigation or success, although I have had success with XXXX.

Consumer Complaint: On or about the XXXX of XX/XX/2023, CAPITALONE Replied and Justified a Charged Interest on a Balance that was paid in Full prior to the Due Date in Which Interest was Charged. To Date the CAPITALONCE held the XXXX Payments for {$1000.00} with a Fee of {$3.00} and gave an Investigation Number # XXXX. The Second XXXX Payment $ XXXXthat was held was for with a Fee of {$300.00} and gave an investigation Number. CAPTIALONE held the payment for an addition three ( 3 ) Days in both transactions even though the payment was in their possession. See the Attachment. It was only after a Call was made that the CAPITALONE credited the payments, however still charged the Interest and reported the inaccurate amount to the Credit Agencies. Then after another Follow-up Call CAPITALONE correct the balance, however never resolved the Interest that was Charged. I am requested for CAPITALONE to honor the Contract Agreement. as their action constitute a Breach. It would be a displeasure to File a Civil Suit to Recover the Overcharged Interest as to their Breach, However the Cardholder is willing to take legal measure if needed.
