Consumer Complaint: I have held several capital one credit cards for about three years now and have been on auto pay with payments coming out of the same XXXX XXXX checking account to cover the minimum payments for each credit card. Between XX/XX/2022 and XX/XX/2022, Capital one was accepting payment on two of my credit cards but rejecting payments from two other cards ( platinum and Quick Silver ) thus returning the payment and charging late fees ; moreover, reporting late payments to my credit report. They took zero accountability and blamed XXXX XXXX bank claiming that XXXX XXXX had blocked payments on the two cards that had never had any issues before receiving payments unless it was due to insufficient funds ( in this case my account had money available to cover the bill ). The other two cards received funds from the same account without incident. When I spoke to two XXXX XXXX branch managers an bout my account they assured me that there werent any blocks against Capital one nor was it due to any insufficient funding. Capital one refused to refund the late fees and to update the credit bureaus on the error. payment on two of my credit cards but rejecting payments from two other cards and charging late fees ; moreover, reporting late payments to my credit report. Consumer Complaint: Ive been XXXX from XX/XX/XXXX up until XX/XX/XXXX and upon my release Ive obtained a capital one trust bank checking account and I realized through the credit wise feature attached to my capital one bank account That there was a charged off amount for {$460.00} that I have no clue about. It seems a credit card was open using my info. This situation is clearly fraud. I have not contact capital one as of yet. I am filing a claim with CFPB first before I give capital one a call. I want this matter handle as soon as possible please. When I call capital one I would be able to give capital one the claim number created by CFPB. I have no clue who used my info to obtain a credit card while my time being XXXX. It has been 30 days and you are in VIOLATION of this law because I am a victim of identity theft!! Please delete these items IMMEDIATELY! These accounts should not be furnished on my consumer report as they are in VIOLATION!!! Under, 15 U.S Code 1681b - Permissible purposes of consumer reports ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the WRITTEN INSTRUCTION of the consumer to whom it relates. I NEVER gave any consumer reporting agency WRITTEN CONSENT to report anything on my consumer report which violates my rights as a federal protected consumer. NO CONSENT IS IDENTITY THEFT. Consumer Complaint: I received several emails from Capital One today, starting at XXXX XXXX saying an account had been opened, password updated, and phone number changed. There were also numerous spam emails that came during this time. I called Capital One at XXXX. They said a new Capital One Venture credit acct. was opened today. Luckily, no charges were made yet. They created case # XXXX and determined it was in fact fraudulent activity. I reported fraud to all credit bureaus and froze my credit. Capital One would not give me any info about the person trying to open the acct in my name such as the phone number and mailing address they used. One of the spam emails that said another acct. was opened in my name said it came from IP address XXXX. I am currently going through and reporting many emails as spam that say I have created accounts for many random places in all sorts of countries.

I notified Capital One in XXXX XXXX XXXX XXXX all through XXXX of XXXX them to verify these alleged late payments and that they are inaccurate-they sent me notification back as verified. I looked at my credit report once more, and still these late payments are listed and reporting on my experian credit report. Please see below what is on my credit report CAPITAL ONE ( Capital One Spark Cash Select for Business ) 5 LATE PAYMENTS Credit usage 60 % Balance {$600.00} Balance updated XX/XX/XXXX Credit limit {$1000.00} It's normal for the credit card balance you see on your credit report to be different than the XXXX on your credit card statement. Since credit card companies typically only report your balance to credit bureaus once a month, recent payments and purchases may not show up until your credit report refreshes. I have spoken to supervisors, at Capital One sent notarized letters to CapOne still no results, they have infringed on my rights for far to long, Cap One has a new card for me, ,because my old one expired yet refuse to send it as retaliation for me speaking up for my right. - This is against the law for them to report inaccurate information on my report.
