Consumer Complaint: I am opting out of Capital One and XXXX sharing my financial history. Capital One agreed not to share my financial information with non affiliates. XXXX is not an affiliate of Capital One and is not the true credit bureau the CFPB is and they do not furnish consumer reports. XXXX is a for profit company and does not have my consent to share my financial history with Capital One. 162.6 Reasonable opportunity to opt out. ( a ) In general. A covered affiliate must not use eligibility information about a consumer that the covered affiliate receives from an affiliate to make a solicitation to such consumer about the covered affiliate 's financial products or services, unless the consumer is provided a reasonable opportunity to opt out, as required by this subpart. ( b ) Examples. A reasonable opportunity to opt out under this subpart is : ( 1 ) If the opt-out notice is mailed to the consumer, the consumer has 30 days from the date the notice is mailed to opt out. ( 2 ) If the opt-out notice is sent via electronic means to the consumer, the consumer has 30 days from the date the consumer acknowledges receipt to elect to opt out by any reasonable method. ( 3 ) If the opt-out notice is sent via e-mail ( where the consumer has agreed to receive disclosures by e-mail ), the consumer is given 30 days after the e-mail is sent to elect to opt out by any reasonable method. ( 4 ) If the opt-out notice provided to the consumer at the time of an electronic transaction, the consumer is required to decide, as a necessary part of proceeding with the transaction, whether to opt out before completing the transaction. ( 5 ) If the opt-out notice is provided during an in-person transaction, the consumer is required to decide, as a necessary part of completing the transaction, whether to opt out through a simple process. ( 6 ) If the opt-out notice is provided in conjunction with other privacy notices required by law, the consumer is allowed to exercise the opt-out election within a reasonable period of time and in the same manner as the opt out under that privacy notice.

A charge was placed by XXXX for a {$7.00} membership fee that I never agreed to or signed up for. I contacted Capitol One to advise of this and ask to dispute the charge several weeks ago. This dispute, after being on phone for some time was never initiated or a record was not even kept of this part of the call. There is a record that I did call in and ask about doing so, however card # is XXXX. I do not feel I should have to ash for same assistance and have to keep up on what was promised and keep requesting over and over. If this is happening to me how many others are being abused like this as well?

Consumer Complaint: Capital One denied speaking to me when I have voice recordings of me speaking to a rep who advised that the late payments would be dropped since I'm experiencing financial difficulties due to Covid-19. Capital One referenced a bankruptcy in the previous complaint which is irrelevant information and only ployed in the response to try to justify character of default. In response I have submitted documents showing that Capital One has also been affected by the pandemic and had to close down most of the brick and mortar 's to compensate for today 's economy which is why they should further understand the position that I am in. Making me go through great measures to obtain Covid-19 protected status should not be as I am a loyal customer. Capital One has also been affected by XXXX this year resulting in XXXX customers data breach the company has also lost {$190.00} XXXX in revenue as Capital One it's self is going through Covid-19 hardship in 2023. Last year Capital One did the same thing and inaccurately negatively affected my credit even though I spoke to a rep, after going through great measures Capital One admitted to the wrong doings and ultimately removed the late payments.I am not sure if Capital One is unable to see my records of speaking to them because of a data breach but the late payments need to be removed as per their Covid-19 protocol service should be fair across the board if not then it can be viewed as discrimation which is a violation of my customer rights per ECOA Regulation B is currently reporting to all three credit agencies XXXX, XXXX and XXXX both XX/XX/2023 and XX/XX/2023 late payments.

Consumer Complaint: End of XX/XX/2023 and early XX/XX/2023 I had many credit inqueries. Just recently I noticed many credit card denial and approval letters get delivered to my physical address. The letters were specific to credit cards and one home equity loan. Of the 6-8 letters I received ( including ones from Walmart credit card, XXXX XXXX XXXXXXXX XXXX XXXX, and XXXX XXXX XXXX ), all were denied but 2 credit cards. I've contacted XXXX XXXX XXXX and they have instructed me to freeze my credit accounts and notify you all regarding the breach in my identity. I have a long list of actions remaining but hoping your awareness will help contain the issue. Please advise on any actions you require of me. Thank you!
