Consumer Complaint: XXXX XXXXXXXX XXXX XXXX and Capital One sent me a fraudulent cashier 's check from my closed out checking out almost twelve months after the account was closed. The fraudulent cashier 's check could not be cashed despite Capital One 's policy regarding their bank issued cashier 's check. The check was issued directly from Capital One and they knew that it was not funded at the time that they mailed it to me. As a result the Capital One cashier 's check bounced multiple times. Capital One representatives repeatedly lied about the check and its replacement status. I've communicated to several Capital One representatives including the CEO 's office that they should immediately send a replacement check to the same address information they had for the for the destroyed fraudulent check. To date I've had to suffer numerous lies from Capital One representatives and I have not received the cashier 's check requested or reimbursement for the bounced check fees incurred from their fraudulent check or any compensation for the damage that their fraudulent actions have caused.

Consumer Complaint: On or around XX/XX/2023 Consumer sent 'validation of debt letter ' to Capital One Bank stating that Principal would continue to perform obligations of agreement upon validation of lawful debt. Principal was current on payments and in good standing with credit accounts. Principal had six accounts with Capital One, and all six accounts were closed in retaliation for the validation of debt request made by Principal. Capital One then reported late payments to Credit Reporting agencies without informing Principal of reporting within 30 days of reporting which violates 15 U.S.C. 1681s2 ( b ). Capital One failed to validate the debt and caused injury to consumer by reporting the negative information to Credit Reporting Agencies. Capital One also refused to accept and without notice of dishonor endorsed payment coupon delivered by Principal which is a UCC 3-414 and discharges the indorser.

Consumer Complaint: This has been ongoing since XXXX XXXX XXXX At this point it is my understanding that the investigation part is complete at Capital One Bank but they the security team is still holding my funds. The lack of response from Capital One is astounding. We are taking about a deposit that Capital One accepted into an account that was not mind of over XXXX and at the time the account that it was put in was closed. Capital one sent me a copy of what the transfer looked like and it clearly had my name on it. The originating bank has asked for the funds back ( XXXX ) but to this date capital one has still not sent back my funds and will not give me a date or time of when that is going to happen. So while my case says it is resolved they are still holding my funds. Please see previous complaints filed and all of the information is described there. I was told by XXXX with Capital One that there is no timeframe for which Capital One is held to return my funds and feel that this is not ok. Please help me hold Capital One accountable to someone as they continually have media coverage about how they are doing these type of things

Consumer Complaint: I am writing to dispute and bring to your attention what appears to be a potential violation of the Fair Credit Reporting Act ( FCRA ), specifically 15 U.S. Code 1681a. My concern pertains to my credit utilization. According to 15 U.S. Code 1681a ( 2 ) ( A ) ( i ), a consumer report does not include information solely as to transactions or experiences between the consumer and the person making the report. Upon reviewing my credit report, it seems that my credit scoring may fall within this exclusion. Additionally, 15 U.S. Code 1681a ( 3 ) states that a consumer reporting agency shall not furnish to any person a record of inquiries in connection with a credit or insurance transaction that is not initiated by a consumer, except as provided in section 1681g ( a ) ( 5 ) of this title. I would appreciate clarification on the procedures followed in relation to inquiries on my credit report. To assist in your investigation, I have enclosed a copy of my credit report highlighting the relevant information and discrepancies. I kindly request that you conduct a thorough review of the matter and provide a written response within the time frame specified by the FCRA. If it is determined that there has been a violation, I request that the necessary corrections be made promptly to ensure the accuracy of my credit report.
