Consumer Complaint: On XX/XX/2023, Capital One contacted me to verify if I had used my Credit Card XXXX at a grocery store named XXXX. They reported that the card was used twice for {$36.00} and {$74.00}. I responded that I had not, that I was not familiar with a store by that name, or any charges made there. Capital One then requested I initiate a fraud report, cancel the card, and allow them to replace it. I followed their direction, spoke to a fraud representative to confirm the last legitimate charges I had made, after which the representative informed me they would investigate & resolve the fraudulent charges. When I inquired about when the fraudulent charges would be credited back to my account I was told the credit would occur after the investigation. Capital One then locked the card and informed me I would receive a replacement. Approximately 7-10 days later I received the replacement card XXXX. About a month after the incident I contacted Capital One about the charges & credit and was told it was still ongoing- XXXX XXXX on the phone. I made two additional attempts ( XXXXXXXX XXXX each ), on each instance I received the same response except on my last attempt I was informed the merchant had 90-days to respond. It has now been over 90-days. The fraudulent charges have not been credited. I have not heard a word from Capital One about the " investigation '' or lack thereof. Since I pay off my entire balance on most months, I have presumably paid off the fraudulent charges as well so as to not be charged interest. And, yesterday, when I attempted to search for the merchant ( XXXX ) in the charges on my Capital One application, the app offered no results. Essentially, the matter is forgotten at Capital One despite being unresolved and in violation of their card agreement terms related to unauthorized/fraudulent charges. Aside from the horrific customer service and borderline predatory aspects, I believe this may be a violation of the Fair Credit Billing Act ( FCBA ). Fortunately, I saved screenshots and the statement both of which show the fraudulent charges. I also have every subsequent statement to support my assertion that they were never credited back to my account. I respectfully request the CFPB 's assistance in this matter.
