Consumer Complaint: KOHLS/CAPONE & XXXX I am writing this letter received a credit alert that an account for XXXX on XX/XX/XXXX and a charge for a XXXX machine was purchased and called them and it was delivered reported it to the bank and theyre investigating it. Another alert for hard inquiry was taken for the KOHLS/CAPONE on XX/XX/XXXX. I would like to have these fraudulent accounts shut down also filed an identity theft report on these and placed a credit freeze and alerts on all reports.

Consumer Complaint: I am filing this statement to provide an account of the interactions and communications with Capital One regarding the validation of a debt, verification of claim, and the provision of a copy of the contract. On XX/XX/2023, I initiated contact with Capital One by sending a formal letter in accordance with my rights under the Fair Debt Collection Practices Act ( FDCPA ). In this initial letter, I explicitly requested the following information : I requested a detailed accounting that explains how the debt was calculated, verification of a signed invoice or lawful claim against me, and a copy of the contract that binds both parties. These requests were made in accordance with my legal rights under the FDCPA, and I awaited a response from Capital One to fulfill these obligations. Subsequent to my initial communication, I reiterated my requests on XX/XX/2023, in an effort to ensure clarity and proper documentation. On XX/XX/2023, Capital One responded to my requests, stating that they were unable to provide a copy of the contract. They explained that the credit card application had been taken over the phone, and as such, no wet ink signature had been collected for the credit card agreement. This response raised concerns, as it failed to provide adequate validation of the debt and did not address the other elements of my request. To further address the matter, I requested verification of the debt once more on XX/XX/2023, hoping for a comprehensive and satisfactory response. However, on XX/XX/2023, Capital One once again responded, indicating their inability to provide the requested information. Throughout this process, my primary goal was to obtain proper validation of the debt, verification of the claim against me, and a copy of the contract that binds both parties. These requests were made to ensure transparency, adherence to the law, and my rights as a consumer under the FDCPA. Despite multiple communications and requests, Capital One has not provided the necessary documentation to meet these legal requirements. As such, this situation has not been resolved to my satisfaction, and I remain concerned about the validity of the debt and the lack of transparency in this matter. I believe that the actions and practices outlined above may constitute violations of my rights under the FDCPA, and I am committed to seeking a just and lawful resolution to this issue. I respectfully request a thorough investigation into these matters and a resolution that aligns with the principles of fairness, transparency, and adherence to the law.
