Consumer Complaint: I, XXXX XXXX, entered into a consumer credit transaction with Comenity Capital/Forever 21 on XX/XX/2019. Pursuant to 15 USC 1666b a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. XXXX is reporting multiple late payments on my consumer report for the following account : Account Number : XXXX, which is a violation of 15 USC 1666b. I am demanding that Comenity Capital/Forever 21 return any fees that were improperly collected for this billing error. Furthermore, Comenity Capital/Forever 21, never disclosed to me that they are a debt collector and that they were attempting to collect a debt which is a violation of 15 USC 1692.

Consumer Complaint: Last month i sent out some documents to XXXX XXXX and XXXX credit reporting agency about a late payment that saw on my credit report. I submitted all the right documentation for the CARES ACT forgiveness to show that the alleged late payment should not be counted against me since i was affected negatively by the pandemic. When i submitted a CFPB to the agencies they are ignoring me and saying they don't recognize me as a consumer. The pandemic has hurt alot of us and the Cares Act is in place to help us ease the suffering especially financially. Please help me bc it doesn't sound like they will honor the cares act. I called the furnisher of the XXXX credit card in and they refused to validate and remove the other late payment. I explained to them that i didn't even know i had a credit card with XXXX due to misleading advertising when i was in the store. I thought i was signing up for a members reward card and they gave me a credit card instead. Now The account is open and in good standing at the moment but they will not honor the CARES ACT here and remove the 30 days late payment. Please help this is causing me stress and severely hurting my credit.

Subissue: Debt was paid
Consumer Complaint: Comenity Bank has called my cellphone at least 7-9 times between the hours of XXXX and XXXX. This debt was already paid this month, and the phone calls are too annoying. I am trying to work so that I can pay off my debt. They seem to want me to not work, and play phone tag with them all day.

Issue: Fees or interest
Subissue: Problem with fees
Consumer Complaint: Paid full amount due by the due date and the next month they charge an interest fee. And so every month you try to pay the full amount due ( the interest fee ) and its impossible because they charge an interest fee the following month again. And if you thought you were done and didnt catch their little scheme they charge late fees for the interest on a XXXX balance account. Sounds like fraud to me! According to their statement : HOW TO AVOID PAYING INTEREST. Your due date is at least 25 days after the close of each billing cycle. We will not charge you interest on purchases if you pay your entire balance by the due date each month. We will begin to charge interest on new purchases made under a Low APR, Equal Payment or Budget Payment Credit Plan from the date of purchase.

Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Investigation took more than 30 days
Consumer Complaint: Please remove the accounts I have listed here. These companies have had more than 90 days, which I have given them more than enough time and 3 dispute letters were sent to resolve this and they have failed. Now it is time to DELETE the accounts per the FCRA. Some of these companies send a template response back that I should wait LONGER. This is unacceptable. The FCRA gives them 30 DAYS. They have taken over 90 ; this is a violation and they are required to remove all of the accounts that they have failed to investigate. There is no way that the FCRA should be ignored and I have to suffer, especially during a time when credit is needed for employment, dwelling, insurance, and more
