Consumer Complaint: Dear Sir or Madam, XXXX. XXXX Account XXXX Please correct this inaccurate information on my credit report. I recently pulled my credit report from your XXXX and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me XXXX days late on this account in XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. I immediately disputed this information with XXXX and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( XXXX ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( XXXX ) and ( XXXX ) sections ( XXXX, XXXX. XXXX, and XXXX. ) as stated below : XXXX. Correction of billing errors ( b ) Billing error ( XXXX ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. ( XXXX ) A computation error or similar error of an accounting nature of the creditor on a statement. ( XXXX ) Failure to transmit the statement required under section XXXX ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than XXXX days before the end of the billing cycle for which the statement is required. ( XXXX ) Any other error described in regulations of the XXXX. XXXX. Regulation of credit reports ( a ) Reports by creditor on obligor 's failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section XXXX ( a ) of this title, a creditor or his agent XXXX not directly or indirectly threaten to report to any person adversely on the obligor 's credit rating or credit standing because of the obligor 's failure to pay the amount indicated by the obligor under section XXXX ( a ) ( XXXX ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section XXXX of this title and has allowed the obligor the same number of days ( not less than XXXX ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. ( b ) Reports by creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section XXXX ( a ) ( XXXX ) of this title, unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. XXXX. Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section XXXX ( b ) of this title is mailed or delivered to the consumer not later than XXXX days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the XXXX, XXXX and XXXX. The following accounts were listed on your report and I have demanded from them a full accounting and XXXX years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( XXXX ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the XXXX, you are required to conduct an investigation on this account if I request it. I DEMAND to see all XXXX XXXX verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( XXXX XXXX ( a ) ( XXXX ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( XXXX ( b ) ( XXXX ). I DEMAND to see proof that I was mailed my statement to the correct address notifying me of both payment due date and delinquency of payment on the account. If you can not provide XXXX XXXX Verifiable proof and proper documentation that the CREDITOR fulfilled its obligations under the ( XXXX ) and ( XXXX ), I therefore demand these late payments be removed from my account or I will be forced to be in contact with the Attorney General of my State and the XXXX XXXX XXXX XXXX. I therefore am submitting my written request to you to conduct an investigation. Per the XXXX, you have XXXX days to conduct this investigation and respond to my request. Consumer Complaint: In XX/XX/XXXX I contacted XXXX Credit Card owned by Comenity asking what my entire balance due was to pay off the credit card. They responded on XX/XX/XXXX that my balance due was XXXX and that they would close my account at my request. On XX/XX/XXXX I paid them XXXX ONLINE. The next month I got a bill for XXXX which was two late fees. I contacted the XXXX and they got no response from Comenity and closed my case last month. I contacted Comenity in XXXX and again in XXXX. They refused to remove the charges saying that my payments was late in XXXX, and then they added XXXX 's fees because I didnt pay in XXXX either. I argued, and sent proof that they sent me a letter stating what I owed and that I paid it. They still refused to remove the charges. Today, XX/XX/XXXX I got a bill for {$200.00}. So since XXXX I have been billed an additional XXXX on a paid off account. I cant retrieve any messages that i did not download because they delete messages after 120 days

Consumer Complaint: XXXX Visa card serviced by comenity charged me twice in the month of XXXX for payments- once for {$810.00} and another time for {$970.00}. I only approved/made the payment for the amount of {$970.00}, the {$810.00} was taken without my permission. Since then, its been a mess. They claimed to send a refund check in the amount of the {$970.00} and applied the balance of {$810.00}. I have not gotten a refund check. As a result my personal checking account has overdrafted three times and I still have not gotten a refund check to date ( XX/XX/XXXX ) This month my XXXX statement balance for the card included the amount of {$970.00} in addition to the other things I purchased. After calling they claim I owe both amounts as the because I did technically not pay the XXXX statement of {$970.00}. But this amount was not owed to them, it is owed to me. They claim they have sent out another refund check and that I owe the {$970.00} plus whatever else was charged. Im still waiting on the {$970.00} refund check. Something is not adding up and I have reached a road block in communication with them regarding this after several message and a long call. Please assist of you can.

Consumer Complaint: I have a credit card with XXXX XXXX XXXX XXXX XXXX I make payments on the due date but sometimes after XXXX. I am charged a {$35.00} late fee for payments made after XXXX. My most recent statement I have {$310.00} in fees charged in 2021. I may have made a payment the next day once or twice I'm not saying every fee should be waived however I think its wrong to be charged a {$35.00} fee for making it after XXXX when 95 % of other cards you have until XXXX pm to make a payment before being assessed a fee I contacted the credit lender and they said because they are in a different time zone it goes by there time zone. I am looking for resolution from your office this is unfair to the consumer I feel like it is an extra way for them to take advantage of the public and charge these fees. All creditors should operate with the same practice of XXXX PM.

Consumer Complaint: Big issues with Comenity Bank. I recently Received a hard credit pull to purchase a home and was informed that my Excellent credit has been dropping because of Several unpaid payments to an old Credit card I have not used in almost 5 months. When Looking into the XXXX XXXX Credit card issue I discovered that After I had paid off the card in full on XX/XX/21 for the full amount of {$220.00} XXXX placed the card away in my safe hand have not used it. After paying off the card in full, Comenity Bank then added on an unknown Financial charge fee of {$4.00} a week later, because they added on a balance they then proceeded to add on Late fees and minimum interest charges without contacting me directly for the next several months. Months later on XX/XX/21 I finally received an email showing a new balance of {$22.00} on my card and my credit score had dropped due to the companies sketchy business practices. I have Statements showing the card was paid in full and And after contacting the number on the card [ XXXX ] and asking for the card to be closed I had to call XXXX times before a woman by the name of XXXX, badge XXXX finally was able to actualy close my card.
