Consumer Complaint: During the process of preparing to close on a mortgage loan, I discovered Comenity Capital Bank ( Utah ), is reporting in error That I still owe {$6700.00} dollars and has stopped reporting credit activity since XX/XX/2022. They said they are implementing a new payment platform and will not report any payment activity for cardholders. I have a XXXX balance and owe nothing, yet it appears on my report to the three agencies as though I maxed out my credit card and have not made payments since XXXX. Now the loan officer said this is tremendously hurtful to my credit and will cause me to pay more points and pay higher interest on a mortgage loan. I have contacted repeatedly and begged for them to report accurate payments and although they agree that I have been an excellent customer there is nothing they can do.

Consumer Complaint: I have three store cards with Comenity Bank, Torrid, Ulta, XXXX. In XXXX, I received a debt consolidation loan, and paid them all off in full. This was XX/XX/XXXX. All the other credit card debts I paid off at the same time have been updated for quite a few weeks now. The only ones that haven't are the Comenity Bank accounts. I've checked the three accounts multiple times and they are all at {$0.00}, but they are not reporting this to XXXX. On top of this, they've been a nightmare to be a consumer for. High interest rates, random unrequested credit increases, servers being down and having to jump through hoops to pay bills, and always taking more time than any other credit company to take payments out of checking accounts. It's not logically to pay a bill on Friday morning, only to have the money taken out the following Wednesday or Thursday. This is all just bad business practices. I plan to never get another account with them as they seem predatory with how they behave as bank.

Consumer Complaint: Thank you XXXX XXXX Customer Advocacy, For finally acknowledging that my last payment to XXXX was on XX/XX/2019 in the amount of {$43.00} you stated in your response letter that you are unwhiling to make any changes to my account with the credit bureaus and you are reporting accurate information in accordance with the law! At this time I am NOT asking XXXX to correct anything with the Credit Bureau I am only wanting information on what laws and or procedure your company has operated under that XXXX has been able to make these changes to my account without my permission. Resulting in falsely manipulating the statute of limitation. As you stated in your response letter my last payment was XX/XX/2019 making XX/XX/2019 the first month of delinquency. Now you stated do to return mail is the reason XXXX updated my account to paid as agreed going back from XX/XX/2019 until you reported the account 30 day again how/why? even after you sold the account XXXX reported 15 more paid as agreed payment! Again you stated ( Due to returned mail, the account was previously updated and brought current. ) please explain in detail this procedure XXXX initiated without my knowledge or consent so I may follow up in accordance with the law. ( Due to returned mail, the account was previously updated and brought current. ) how/why does return mail changes the payment history on account from being late never paid to paid how?

Issue: Getting a credit card
Subissue: Card opened as result of identity theft or fraud
Consumer Complaint: COMENITY BANK/ EXPRESS Violated section 605B. Block of information resulting from identity theft. I sent off a complete fraud packet to XXXX credit reporting agency as well as XXXX XXXX and XXXX. The fraud packet was complete and met the requirements of section 605B of the fair debt collection practices act. The above referenced bank received a full investigation packet including the Federal Trade Commission affidavit and the identity theft affidavit completed and notarized from XXXX. Comenity Bank Failed to conduct a proper investigation of the fraudulent accusations submitted as a dispute to XXXX. Upon notifying Comenity bank about the fraudulent activity and the investigation that was conducted by XXXX, the bank stated to me that they did not receive The packet from XXXX and that they also wouldnt except the federal universal identity theft affidavit if it was presented. Since the company did not have or possess the complete packet which included all of the information pertaining to the fraud that was committed. This company couldve never conducted a proper investigation to conclude that this account is in fact mine. COMENITY BANK/ EXPRESS Violated section 623. Responsibilities of furnishers of information to consumer reporting agencies. ( 1 ) Prohibition This section clearly states, reporting information with actual knowledge of errors. A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has a reasonable cause to believe that the information is inaccurate. Comenity Bank was notified by the consumer and was also notified by XXXX credit reporting agency of the fraud and was provided documentation that they were reluctant to review because it wasnt on there personal paperwork. Due to lack of a proper investigation this company felt the right to still validate the debt and caused the consumer more irreparable harm as well as punitive damages in addition to the other fraud damages. The company was given knowledge of these errors and the potential fraud that caused it and yet they still felt the need to report this information to the credit report without a proper investigation.

Issue: Fees or interest
Subissue: Problem with fees
Consumer Complaint: Comenity Bank underwent a system upgrade which rendered its online site unusable for over XXXX months. I made a credit card payment through my bank 's online payment system. XXXX rejected the payment for unknown reasons, yet still charged me interest on the balance and a late fee. A phone XXXX helped me make the payment after that. XXXX removed the late fees, but have charged me around {$80.00} in interest after I made my payment on time but it was recorded as late because they rejected it. Emails to XXXX get canned responses saying the fees were calculated correctly. XXXX XXXX is there should be no late fees at all since I made a good faith effort to pay my balance in full before finance charges would be assessed, but a problem with their system prevented the payment from going through.
