I also mailed in a letter to the creditor asking for documentation showing my signature or consent to open this account under my information over 43 days ago which I HAVE NOT RECIEVED. This creditor has failed to provide me with supporting documentation verifying the debt and ownership documentation, in accordance with the Fair Debt Collection Practices Act ( FDCPA ). Consumer Complaint: Dear Sir/Madam, I am writing to formally dispute the debt collection actions taken by your agency regarding the debt allegedly owed by me. I have discovered numerous violations of consumer credit and banking laws, which have resulted in significant harm to my financial standing, mental well-being, and business operations. I kindly request that you address these violations, rectify the damages caused, and provide appropriate compensation for the distress caused. XXXX. Illegal Sale of Debt : 2. It has come to my attention that you unlawfully sold my debt without providing me with the required 1099-C form, both to me and the IRS. Consumer Complaint: Wayfair/ ( Comenity Bank XXXXBread Financial ) reported 30 days late on XX/XX/XXXX on all three credit reports which was incorrect. The item is inaccurate because payment was made on XX/XX/XXXX, 18 days later than the due date of XX/XX/XXXX Per the U.S. Code 15 1666b - Timing of payments - A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. The credit card company had not uploaded statements to my online account or sent them to my email or mailed to my home address since XX/XX/XXXX ( See attached screen print ), which is a violation of US code 15-1666b. Due to the non-mailing of statements the late payment reported in XX/XX/XXXX should be removed. I sent the company a certified letter by U.S. Postal mail on XX/XX/XXXX, however I never received a response. Federal law late payments should be reported on consumers report only if they are past due 30 days or more.

Consumer Complaint: Comenity Bank XXXX fraudulently opened a credit card for me without my knowledge or consent. I called Comenity Bank XXXX to cancel the card. However, they asked me for personal information such as social security, address, phone, and date of birth before they would cancel, and I'm concerned about providing additional sensitive information to an unscrupulous and fraudulent company. I hung up and do not know what to do to close this card. Comenity Bank XXXX also conducted a " XXXX inquiry '' on my credit report without my knowledge or consent. I've successfully removed the inquiry from my XXXX and XXXX credit reports. However, XXXX will not remove the hard inquiry from Comenity Bank, despite me filing a fraud report and requesting credit protections.
