Consumer Complaint: Please find the attached document supporting this issue. I had a credit card that ended up with Bank of America in the end, it was with someone originally. This was in XXXX. Fast forward to XXXX, I received a 1099 C 12 years later. I called B of A and they told me that the last payment I made was in XX/XX/XXXX. They also stated tha the file was closed on XX/XX/XXXX. I wrote a letter asking not to amend the 1099 C but to rescind it under the Internal Revenue Bulletin 2016-48 T.D. 9793. That document is attached and from the IRS web site. It has the old rules which are that there was a 3 year rule that the 1099 C were to be issued 36 months after the last payment. The new rules which I believe they are using eliminated the 36 month last payment rule in the IRS bulletin. Please see the attached ruling has the old and the new rule. Someone at B of A that sent the letter was not versed in this complicated issue. I under the old rules I should have received that 1099 C years ago not 12 years later and the company using new rules. It is hard to be up to date on old rules but this is what my particular situation. I have done my research. Had I got the 1099 C back when I was suppose to I could have excluded this from my income base and the fact the the IRS allows and exclusion based on insolvency. I was at that time.

Consumer Complaint: To whom it may concern : I have been a Bank of America Client since XXXX and I opened a Privacy Assist account in XXXXEver since my account has been charged XXXX every month and the service had been disconnected that same year. I called Bank of America several times and transferred me saying that they were not responsible for the refund, so I have been back and forth form the bank to the Privacy Assist help line. So, XXXX x XXXX XXXX ( one year ) and XXXX x XXXX = XXXX ( 12 years ). I am asking for your help, so I can collect my money back and things would be fare and square. Thank you.

Consumer Complaint: I filed a dispute with Bank of America prepaid card offered by California unemployment. I was asked to send in a police report as well as copies of my id so that it can be used to compare images from atm and or teller withdrawals. My claim was denied and none of the info provided to validate my claim was reviewed. Had atm withdrawals been reviewed and compared to my drivers license Bank of America would have seen that I was a victim of identity theft. My account had been completely taken over and funds stolen. Once I learned about those funds that were supposed to be available to me I called and my account was frozen due to previous suspected fraud. I went into a branch and verified myself yet my claim was not throughly reviewed, no temporary or provisional credits have been applied to my account and the investigation has lasted over 90days. I have provided my lease to verify my proof of residency throughout the time frame from when my card was initially issued and funds depleted from my card. Yet Bank of America refuses to do due diligence and investigate my claim and instead readily deny claiming I must have given someone permission to steal from me

Consumer Complaint: We have been customers of Bank of America for over 20 years. Today XX/XX/XXXX my husband tried to use his debit card this morning to buy coffee and it was declined, the cashier stating that it says that his debit card may have been reported stolen. I called the Bank of America where we have 3 checking accounts and 3 saving accounts and 6 credit cards and they said that they are closing all of our checking and savings accounts today because bank of America is deciding to end its relationship with us. They didnt give me any specific reasons for this, and after I called a few more times to see if I can get more answers I found that they were only closing the checking and savings accounts and not any of our credit cards. I went into a branch to talk to someone and withdraw a little bit of cash a few hours later and they called the bank and they gave them the same reason of why my account was being closed. I was unable to withdraw any funds from any of my accounts which left us with no money. They stated our direct deposits from our jobs that we had coming in there for the last 10-15 years and all the bill pays would be rejected. Both my daughters accounts that I am a signer on were also affected and closing. My XXXX XXXX XXXX daughter was a victim of fraud from a job she attempted to apply to almost exactly a month prior, I called to ask if this was the reason and that we were the victims of it and the department was still unable to give me any information about it stating they would close our accounts and mail us any balance due. We are now left just waiting with no access to cash and auto payments being rejected. I am due to give birth in 2-3 weeks and bank of American cant give me an explanation of why my funds are not accessible and why they are deciding to not do business. I asked if I did something wrong to just tell me and maybe I could give more explanation. The money in there is from our payroll jobs that we have been getting deposited there for the last 10-15 years.

Consumer Complaint: For background : I recently experienced fraud on this account ( my phone was stolen, which contained this card in XXXX XXXX ), and BofA followed typical procedure and cancelled the old card and sent me a new one. For the past several weeks, when I attempt to go online to schedule a payment, I get an error messaging stating that I need to call customer service. After waiting a very long time on hold on the first call, an agent scheduled my payment but said that they were not sure why this was happening to me. They committed to getting back to me within 2-3 days. Two weeks later, I had not received a response, so I attempted to use the online feature again, and it still was not working. When I called, the second agent that I spoke to ( despite calling the exact XXXX # that the website indicated I should call ) tried to convince me that bill pay was XXXX because I had missed a payment ( how is that an acceptable solution? ). I informed her that I had not missed a payment, to which she insisted that I was wrong without providing any details. I then read the past two statements to her ( statement date, previous balance, amount due, due date, evidence of payments, confirmation numbers, etc ) and explained to her that what she was saying wasn't possible because the statement date for the charge in question was AFTER the date that she said the payment was due - said another way, I did not owe any money on the date she mentioned, and the charge that she was claiming was overdue is not due until XXXX XXXX, for which I have a scheduled payment and was able to provide a confirmation number. She did admit that she was incorrect, which is just unbelievable for a bank this large and systemically important, but then still could not solve my bill pay issue. At this point, it feels like Bank of American is trying to make paying bills difficult so that they can generate late fees. I'm happy to be wrong, but the evidence is not convincing that there are other motivations.

Consumer Complaint: XXXX - took out a primary loan as well as a " soft second '' with Bank of America to purchase a primary/only residence Between XXXX and XXXX mortgage payments became difficult to impossible to make due to difficulties with the mother of my children. My options were either leave myself or evict my children and their mother. I could not afford rent as well as the mortgage nor could I evict my own children. XXXX - struggled to make payments on the " soft second '' ( as well as the primary ) XXXX - made a payment " soft second '' after missing several payments XXXX - Bank of America " charged off '' the " soft second '' loan XXXX - the last tax document issued with respect to the " soft second '' was submitted to the IRS was for the XXXX tax year Prior to foreclosure, the primary loan changed servicers to " XXXX '', who did get in contact with me regarding foreclosure mitigation. No contact was made regarding the soft second, which I was unaware was charged off. At the time, I thought that loan was lumped in with the primary loan re : who was servicing the loan and handling the eventual foreclosure. I had no reason to think otherwise, given the situation and that both loans originated with the same company. XXXX - foreclosure XXXX XX/XX/XXXX - foreclosure complete, with the transaction amount being over {$2000.00} more than the amount owed on the primary loan and about {$10000.00} less than the market value noted on the 1099-A. There is no record of any of the excess being applied to the " soft second '' loan, which had been charged off two years prior. 2023 January- the charged off " soft second '' changes servicers from Bank of America itself to Capital Management Services I was not notified of this change. In addition to not notifying me of this change, Bank of America gave the new servicer a contact address that I have no association with ( the address is for a strip mall in a town where I have never lived ) despite Bank of America having sent correspondence to where I lived in XXXX, which is in the same building where I currently reside ( just across the hall from the last address -- it is a 3-unit home ). Right around this time, I was in the process of trying to secure a pre-approval for a loan to purchase a home with my wife ( in no small part as means to improve my children 's custody situation ). We went through " hard '' credit checks, and so on. Because of debt on my wife 's side of things, we have to pause our search to improve our DTI ratio and the issue with my loan remains hidden. XXXX - I still am unaware of the change in services for the " soft second '' ( or that it still exists as I thought it went with the foreclosure ). The discrepancies are found when we go to apply for pre-approval after improving the DTI ratio and my wife receiving a promotion. Traversing the Bank of America phone system to try to find out what happened to this secondary loan is almost impossible because the account number is not recognized by their phone system nor is my SSN. Bank of America Collections has some record of the account, but only that it has been sent to a new servicer. They seem certain that it was some kind of loan taken out for home repairs or the like as they can not figure out why I would think that it would be associated with the foreclosure, even though it was taken out to purchase the home along with another Bank of America loan. When asked for the note, etc., associate with the loans as well as a copy of the agreement ( s ) sign, they are unable/unwilling to provide any information. They say they will send the payment history. They told me that the collections had been sent to an outside servicer and provided the number. I called the new servicer and found that Bank of America had provided them with the incorrect address. I requested the send me information regarding this debt. I received a notice/bill, but no information regarding how the service was transferred, etc. I have subsequently requested any and all information they may have on this debt. Somewhere in all of this, Bank of America neglected to ethically handle the " soft second '' both by charging it off without notice, despite a recent payment, as well as not applying any excess in the sale to the second mortgage and not getting fair market value for the house to absolve the majority of the soft second along with the primary loan. They also neglected to provide the new servicers information to me and provided that servicer an incorrect address such that I was unaware that the debt had changed hands.

I can recall clearly I was on the phone with the Bank of America EDD fraud /claims department for an hour or so because my account had the departments number verified and on my account AS MY OWN NUMBER. IN my own words the lady had said she has been working at the department for years, as she was a 2nd tier specialist, and said that she has never seen this ever happen. It took them hours to try and remove the departments verified number of my account. Around that time and on, all my accounts from my edd online account to my chase account, XXXX, my emails and my phone numbers and passwords were fraudulent. I had to change emails and phone numbers and passwords And now it has just been a habit since getting my funds stolen under my nose. And still I have been contacting them about my claims that many representatives have said they have been going over for more then a year now. With no result and resolution my accounts that was hacked into and fraudulent transactions/withdrawals occurred Alot of these situations where not in my favor and since of it all I have lost more then what was fraudulently stolen from me, ths goes to me having a good stable job with 2credit cards and a bank account with SAVINGS ACCOUNT to me not being able to have any more credit cards, in debt, and not being able to have a bank account! Anywhere because my identity was and is stolen No I have only one prepaid bank account Luckily I was able to with debts and collections because my situation hasn't been really looked into although everytime I speak with them it is still open claim and even though everytime a complaint is filed for me and under investigation going on more then a year or don't favor and remember how I had my identity stolen.

Consumer Complaint: On XXXX XXXX, my work check was illegally stolen from bank of America, I was told it was for a account that closed a year ago, however I paid all arrears, even had two deposits totalling XXXX XXXX XXXX, then XXXX, XXXX XXXX, get nothing ever taken out. I was never alerted to owning anything on this account on the calls placed XX/XX/2023 no banker saw anything owed. I'm XXXX XXXX IN THE UNITED STATES AND XXXX. I received my work check through direct deposit and XXXX was stolen without warning from BofA. I went to the Branch in XXXX and spoke to XXXX XXXX who stated the money would be returned with 3 to 5 business days, he then stated no letter was ever sent out then he illegally generated a letter as we see it shows populated on XX/XX/2023. Deceptive banking practices. XXXX also XXXX XXXX XXXX XXXX XXXX advisor. Pull under FOIA his computer activity as you will see he promised me a refund due to never contacting me or making any payment arrangements.

Consumer Complaint: I, the consumer and natural person, was denied credit by Bank Of America when I applied for a auto loan in the amount of {$30000.00} on XXXX XXXX. Adverse action against a consumer is AGAINST THE LAW according to the Equal Credit Opportunity Act which is codified in 15 U.S.C 1691c and is pursuant to civil liability under 15 U.S.C 1692k. Bank Of America is in violation of 15 U.S. Code 1642, U.S. Code 1681m and 12 CFR 1002 because I, the consumer, made an application in good faith, but credit was not issued.
