Consumer Complaint: On Sunday, XX/XX/2022 I was at work at XXXX XXXX from XXXX and realized that I was missing my phone in the middle of my shift. I bought a new phone, and when I went to re-login to my apps, there was {$2100.00} removed from my savings and sent off to XXXX XXXX as XXXX and sent to an unauthorized user I have never met before. I have tried to talk to XXXX XXXX and the XXXX is non-refundable so I reached out to Bank of America. They stated that because someone didnt take all of my money and I have had some huge transactions before, that they cant replace my money. But I have no idea why all my money wasnt taken and am just thankful it wasnt. I also showed proof of receipts from XXXX XXXX and had just recently received my tax income and used it to spend on bills. Other than that I have never made such a huge transaction and would never send XXXX ti anyone, let alone someone I dont know. I am seeking extra help in the matter.

Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: In XX/XX/2023, I received an email stating that I had opened an account with Bank of America. Two accounts had been opened online fraudulently in my name. The email did not give any direction on how to notify the bank of fraud. I had to search their site to find out how to report this. That in itself is a problem. Then, I was asked to mail my personal info to them to verify who I was. I decided to go to the local branch to have them verify me. While at the branch I was told that the bank was aware that this had become a problem and that former clients were not being verified in person. My question is, if you know that there is a large data breach with a credit bureau, why would you accept a SSN and an email as proof that someone is who they claim online? I was verified after giving them multiple pieces of information. I have asked them to close these accounts because they have verified that I did not open them, I am still to this day receiving emails and account statements on accounts that are fraudulent. I feel that Bank of America is not protecting their clients and/or potential clients as they should. Now, someone knows that they have correct information for me because this bank allowed them to open an account using my information.

Consumer Complaint: I had three credit card accounts with Bank of america opened in XXXX, I was always on time never had a late payment. In XX/XX/XXXX my account XXXX went from {$670.00} to {$9900.00} unbeknown to me at that time there was a payment made to the account from a unknown bank in the amount of {$9800.00} which at that point the balance went down to where I knew it should have been {$100.00}. The payment made from a unrelated bank was stopped and my balance then went back to over {$9000.00} I was never notified of this I was unaware of the charges payment and return until the next billing cycle which when I went to use that particular card it was unusable I called the bank to find out why. I was informed my account had been closed I couldn't believe it I asked why and they told me that the payment made was returned as stopped payment I had no idea what they were talking about when I was told the scenario I told them immediately that was not my charges nor my payment nor my account or associated bank. I wanted to dispute it and that why was i not alerted to such a large with drawl I never in 5 years had done a large with drawl i also asked why the red flag wasnt up when a payment was made from another state another unrelated bank and a account that was not in my name. Then in XX/XX/XXXX after all that had happen my other credit card they again closed my account again the same scenario happened after they knew that this again was out of character they allowed who ever to do this to that account too. It was a month later next billing that i was made aware of the actions that took place and the jump in my balance from {$330.00} to over {$11000.00}. I again disputed these charges and again wondered why they allowed this to happen again. In XXXX of XXXX my last account with Bank of America was closed without notice due to the same fraudulent actions. I was devastated I continued to make payments until the dispute was resolved. I want you to understand I had a credit rating of XXXX and I had made sure it stayed that way for the last 5 years prior to all this. I continued making payment on all accounts because I did not want my credit do be damaged. To my dismay I learned that the closing of my accounts by Bank of america had decimated my score, I called the customer service to ask why my payments of {$250.00} on all three accounts were not taking anything off the balance of cards that can not be used. I was told it was because of interest fees, over limit fees late fees ect. Now, mind you my card were not over limit when they closed them and there should not have been any late fees because I paid on the same billing cycle as always. I told them I wanted to settle they sent me to a program that was for hardship, after talking with the lady she took all my info and came back to tell me I didnt make enough money for a hardship, Huh? isnt that what a hardship is not enough money causing a hardship! I asked to speak to a manager I wanted to settle all three accounts I had my 401k still and asked what I could do to settle with a payoff amount,. The manager told me they can not do that and I have to go through a credit counseling program that negotiates and put the funds in a account until the full payment is achieved then they pay a individual account. I said then they will become marked as late and deliquent why can I not negotiate a settlement. He refused. So here we are now I have received a lawsuit from Bank of America they have hired a outside attorney XXXXXXXX XXXX XXXX I sent a validation of debt but have never received anything back I have filed for identity theft because my XXXX and my XXXX have all been compromised as well. I have put in disputes sent cease and desist letters on collection activity and reporting negative on my credit report until the identity theft investigation is done. They are still reporting on my credit negative, arks they are still pursuing a lawsuit under false pretenses they can not even validate the debt they are suing me for. I feel my rights as a consumer have been severely damaged my credit is wasted and Bank of America has definitely crossed the line and gone against the law in there actions. I have lost my significant other of 22 years and his children are now trying to make me sell my home for there share of its worth, because Bank of a america closed my accounts for no reason and since charged off the debt they have ruined my excelleny credit rating and because of that I can not get a loan to pay them out of there share. A lousy $ XXXX an amount that before Bank of America made this unfair decision I could use my signature to obtain the XXXX. Now I will be homeless in 90 days.

Issue: Fees or interest
Subissue: Problem with fees
Consumer Complaint: I opened a new credit card and had used it for the past year without issue. Upon receiving a billing statement after the first year, I was charged an annual fee. After consideration, I determined the annual fee wasn't worth the benefits I was receiving from the card. So, I called to cancel the card, citing the annual fee. This was done before the statement due date. The only balance on the card was the annual fee. Bank of America gladly closed my account, cutting off all access to information ( including statements, transactions, online log-in, etc ). Standard industry practice is to waive the annual fee for an account canceled within the grace period of the billing cycle the annual fee is posted in. However, Bank of America refused to waive the annual fee. After shutting me out of my account, they will only correspond by mail and I XXXX the US XXXX on a XXXX XXXX where mail takes XXXX weeks to be received. This means every communication I get from them is outdated. Of course, Bank of America devised a process where they would not confirm that my annual fee was waived, it had to be submitted to some other department for review who would not interface with the customer to answer. By the time I discovered that the annual fee was not waived, I had already been hit with two months of late fees plus interest on the annual fee, resulting in almost doubling the annual fee. After multiple engagements with Bank of America, which were all fruitless as no representatives were empowered to take action, I eventually paid the annual fee with all the charges and have no other recourse than to file a complaint with the CFPB. Bottom line : Bank of America terms and conditions promised me many things in exchange for the annual fee : earning XXXX XXXXXXXX mileage, a companion certificate, etc. They charged me the fee, but refuse to provide the promised benefits.
