Consumer Complaint: AS A XXXX XXXX XXXX PERSON IN AMERICA THIS IS SO SHAMEFUL .... NOBODY IS HELPING ME GET MY FUNDS BACK.. I've done everything I can and BOA is making me out to be a criminal. My Gov ID is uploaded to BoA, I feel they are discriminating against me because like I said previously nothing has been done. It's been ongoing... I'm calling everyday having to speak with representatives who don't care about my issue. VERY EVIL They sent XXXX in XX/XX/XXXX. That was it. Where is my XXXX???????? I'm saving up the money to SUE BOA prepaid cards for inhumane services and discriminative behavior. I have never felt more of a lesser human than today .... I've been through so much last year and this year because OF BANK OF AMERICA, my funds should have been returned a year n a half ago .... this is mentally draining and physically. I have medical issues that I took care of with my unemployment benefits... I've gotten so sick because of it but that's the lease of my worries. I'm still homeless and none of your employees have a care in the world.. they argue with me when I want to speak to a supervisor and advising that the supervisor can't help me anymore they a regular employee could. I'm in shock. Never in my life have I been treated this way.. I banked with XXXX XXXX, XXXX, XXXX XXXX and never had any issues regarding theft or anything for that matter. BOA is corrupt. I CANT BELIEVE HOW MANY TIMES IVE BEEN CALLED A LIAR BY A REPRESENTATIVE IN BOA WHAT IS GOING ON?????? I GAVE YOU POLICE REPORTS, IDENTITY LEFT DOCS, I GAVE YOU ACTUAL POLICE CONTACT INFORMATION INCLUDING WATCH COMANNDERS EMAIL, PHONE NUMBER, AND THE SHERIFFS EMAIL/PHONE NUMBER. I SENT THOSE OVER WHEN THE CASE FIRST HAPPEN back in early early XXXX. Have you not contacted the police yet? I spoke to woman from BOA claims in XXXX of XXXX and she said that they reviewed camera footage and can't make out the person to be me, which I've been reporting this whole time. I didn't pull money out. My card WAS STOLEN. My ID Was stolen. MY SS was stolen and bank of america is doing nothing about it Hello, I have filed 3 complaints with cfpb last year regarding bank of america not properly returning my funds to my account after giving police reports, identity theft docs and statements stating that my car was broken into when I was living in My car.. all my identification.. birth certificate, GOV ID, social Id.was stolen and was then later used to pull out funds that was already waiting for from previous fraudulent activities. They credited my account and money was stolen. I never received it. But got a letter stating case resolved .... money was missing. This claim has been open since XX/XX/XXXX and they have been denying the claim for XXXX up until today. I've been fighting to get this straightened out and back in XXXX of XXXX on the XXXX they stated it was denied once again. I asked for a reconsideration and they ended up putting the claim on an MRI, the claim has been pending ever since, no update or anything until XXXX. They credited my account XXXX $ but not XXXX They denied the claim for XXXX But gave me credit for another claim. I am beyond furious ... .. this is destroying my life. I need this money ASAP. I have been waiting soooo LONG and I have been very respectful and patient. I can't handle the XXXX XXXX I'm facing anymore ... .... I'm getting my hopes up only to find out my claim sis being denied. I can't receive mail. I'm homeless and I have health problems and alot of doctors appointments to go to ..... I live in my car and can't afford to take care of myself right now .... I'm currently having car problems and can not drive. It's one thing after another and nobody is helping me. I've giving police reports and all back in XXXX of XXXX .... it's XX/XX/XXXX now. And God is my witness

Consumer Complaint: We have been Bank of America customers since XXXX. We are XXXX XXXX living permanently in XXXX, however we also own a vacation property in XXXX, California that we spend the winters at. In XXXX XXXX XXXX we met with a Credit Specialist at the Branch in XXXX XXXX, California. We were wanting to arrange a line of credit or small personal loan as we were replacing the HVAC unit in the home and required approximately {$8000.00}. During our meeting with XXXX XXXX the credit XXXX, he advised that Bank of America does not offer XXXX XXXX XXXX or small personal loans. He did mention that their XXXX card had a promotion attached to it for qualified Clients. He proceeded to check our account and found that we did qualify for the promotion that gave us 0 % interest for 18 months. I asked him how it worked and he advised us that the amount is taken as a direct deposit advance and would show separately on our statement. While purchases would show as purchases. I asked how the payments would work as this was our operating account thru which we ran our everyday purchases. XXXX told us that as long as we continued to payoff the monthly purchases it would be fine and anything above that would be applied to the direct deposit advance if we wanted to start reducing the balance of it. XXXX also let us now that there was a 3 % transaction fee that would be collected at the time we took the advance. We thank him for the info and said we wanted to discuss it overnight. After thinking about it and feeling comfortable that we were given the correct and accurate information by XXXX, we went back the next day to put the arrangements in play. During this meeting again I went over the matter of paying off the monthly purchase charges ( which is supported by our account history of being the practice on this card since inception ) so as to avoid any interest charges. XXXX assured me that as along as I paid the purchases on the card during the statement cycle I would be fine. We went ahead with the direct deposit advance signing the paperwork and being given copies of it along with the disclosure statements. I have to admit that I didn't look very closely at the statements only to find the amount of purchases charged for the next couple of months as we were very busy and I had a level of Trust with the Bank of America. In XXXX I actually had some time to sit down and review the statements and was shocked and dismayed to see that interest was being charged on the account at a rate of 24.99 %. I called XXXX right away and explained my plight to him, he just said I couldn't paid off the right amount, he recommended I call the XXXX XXXX and speak to them as he didn't have the full access to our account that they did and they could help sort out the issue. I called them a couple of times and was left on hold for a significant period and then I hung up tried again and the same thing happened. We then were preparing to begin the trip home to XXXX and I left it until we got there and resettled. In XXXX I contacted XXXX again saying I was still having trouble and couldn't understand why this was happening when I was paying off the purchases as required. Again he passed the me back onto XXXX. I called and finally got to speak to a Representative by the name of XXXX, she took the time to listen to my dilema and brought my account up so she could see what was going on. XXXX went thru how the XXXX worked in details and explained clearly why we were being charged interest. It seems that payments to the account are applied as follows, the statement minimum payment amount is applied to the LOWEST interest rate portion and the remainder of the payment it them applied to the higher interest rate portion. So in effect if I made a payment of {$1700.00} to cover purchases made during the month but a minimum payment amount of {$150.00} was required that minimum pay't of {$150.00} was taken off the {$1700.00}. leaving me short of clearing my balance by that amount and therefore interest of 24.99 % would be charged on the full amount from the date of transaction. XXXX also explained that as the direct deposit amount remained outstanding This was not explained to me at all when we spoke with the Branch Specialist, why would we agree to doing this and paying that exorbitant rate of interest if we were made aware of how it was going to work. XXXX even stated to me that when they offer this product to their Clients they recommend that they use an alternate Vise card for everyday expenses while the Direct deposit amount remains outstanding so not to incur huge interest costs, even offering to qualify the client for another card if they don't have one available. The fact of the matter is, the product was not explained properly or in appropriate detail during our Branch meetings or calls and it is most likely that the Specialist recommending this product was financially compensated for selling us a product that did not in fact meet our needs. Given we are snowbirds owning outright our permanent home in XXXX and our Winter home in XXXX, with sufficient income to enjoy same along with an excellent credit history, why would we knowingly accept a product that we would be paying 24.99 % annually. When it was our understanding the only cost would be the 3 % transaction fee. It is for the foregoing reasons we are of the opinion the the Bank of America has not acted in good faith or with good Business Practices in regards to the operation of their VISA accounts.

Consumer Complaint: I have a fraudulent accounts on my credit report, which I reported it to BANK OF AMERICA, yet BANK OF AMERICA is not removing these fraudulent accounts. BANK OF AMERICA has no right to refuse to remove this fraudulent account because I am a victim of identity theft and I have filed a valid police report. According to FCRA 605B ( 15 U.S.C. 1681C-2 ) consumer reporting agencies and creditor shall block the reporting of any information resulting from identity theft no later than 4 business days after date of receipt, yet BANK OF AMERICA has refused to do this. The followings are the fraudulent accounts : BANK OF AMERICA XXXX opened XX/XX/2017 Balance {$36000.00} and BANK OF AMERICA XXXX opened XX/XX/2017 Balance {$49000.00} which were open at an address where I have never lived at and it has nothing to do with me.

Consumer Complaint: My mother passed from XXXX on XXXX XX/XX/XXXX, and I opened probate on my mother 's estate XX/XX/XXXX. During the 6 months for open claims against my mother 's estate, Bank of America ( BoA ) submitted a claim for the remaining balance of the mortgage for the amount of {$68000.00}, ( see attachment BOA Creditor Claim ). The amount of the claim is for a secured home loan for property owned by my parents since XXXX and currently occupied by me, my parents ' only legal heir. Page 4 of the claim states, " THIS CLAIM IS BASED ON AN ACCOUNT FOR GOODS AND/OR SERVICES IN THE AMOUNT OF {$68000.00}, EVIDENCED BY ACCOUNT NUMBER XXXX. '' According to 12 U.S.C. 1701j3 ( d ), The Garn-St. Germain Act of 1982, not only is the claim by BoA misrepresented, but this claim is also unlawful based on the exemptions I qualify as heir of this property. I personally contacted BoA regarding this claim and according to the customer service representative, they were unable to pull up any records regarding this claim against the estate yet BoA was represented in court regarding this claim on/about XXXX XX/XX/XXXX. I feel the misrepresentation of BoA 's claim is to force the sale of my home. The debt listed in the claim is not a credit card or a home equity line of credit debt, but a home mortgage loan currently in the name of my deceased mother. The fact BoA, as recently as XXXX XX/XX/XXXX, continues to misrepresent this claim of debt in open court is a clear violation of the law. I feel as a XXXX the business practices of BoA regarding this probate claim are not only unlawful but demonstrate a clear bias against my inheritance of this home as a XXXX veteran.

Consumer Complaint: On XX/XX/XXXX there was a transfer of XXXX} ( Entire amount of account ) from my account to another account that was not mine. XX/XX/XXXX - I submitted a claim stating that I had not made this transfer. I secured the account by : 1. Canceled the debit card and requested a new one. 2. Changed the password on my Bank of America account. 3. Changed the password on my email account. 4. Ensured that all contact information on account was mine. On XX/XX/XXXX another transfer of XXXX} was made to the same account that was not was mine. XX/XX/XXXX - I submitted a second claim stating that I had not made this transfer. Upon discussion with the Bank of America XXXX XXXX Customer Service rep it was discovered that an unlisted XXXX phone number listed for " one-time passcode '' for transfers was different and not mine as listed on my Account Information. This number was reconciled, and the account has been secured since that change was made. XX/XX/XXXX - The first claim was denied stating that I was still using the same email on the account. XX/XX/XXXX - I submitted an appeal for reconsideration stating that I secured my email account by changing my email password. XX/XX/XXXX - The appeal was denied without letter of explanation sent from Bank of America. XX/XX/XXXX - I submitted a second appeal for reconsideration. XX/XX/XXXX - The second claim was reconciled by Bank of America and XXXX was refunded back into my account. XX/XX/XXXX - The second appeal was denied without letter of explanation sent from Bank of America. XX/XX/XXXX - I submitted a third appeal for reconsideration. XX/XX/XXXX - I filed a XXXX Police Reports with my local police department XXXX XXXX XXXX XXXX for the money that was stolen from my account. XX/XX/XXXX - I submitted the police reports to Bank of America. The third appeal for reconsideration is still open for investigation for more than XXXX year. Every time I call there has been no update on the claim other than " It is still open for investigation. ''

Consumer Complaint: BOA double charged me on a month I had a large balance, and I've been unable to get my money back despite a series of long calls with the company and various promises made. My BOA credit card is on autopay, to cover the full amount each month, from my checking account at a different bank. At the beginning of XXXX, I got a notice the payment couldn't go through because of the balance in my checking account. I fixed the balance, and then sent in payment manually through credit card website ( still taking money from the same bank account ). A couple days later, BOA took the same payment AGAIN : {$4900.00}! I called to ask to get my money bank in my bank account, starting beginning of XXXX, and despite many calls and being handed around between employees and departments, I still don't have my money back. My credit card now account shows an almost {$4000.00} credit, and they *still* took more money out of my bank account to pay my XXXX balance. They keep telling me different things, but the conflicting advice almost doesn't matter because it all results in the same thing : I'm out the money they took from my bank account without my permission, and scrambling to pay my mortgage and coop fees, and my estimated taxes, and other bills, for the second month in a row. Today I called again ( having been promised the money back in my bank account by last Friday at the latest, but of course it is still not there on Monday ) and was told it would take 30 days more to get it. Previously, I was told it would somehow take three billing cycles, to get my money back. Funny, when I sent money to them, it went through almost instantaneously! Whatever BOA says in response to this, I am absolutely not going to believe it until I see the money actually back in my bank account.

Consumer Complaint: on XX/XX/XXXX i contacted XXXX XXXX. out of XXXX XXXX to provide me with XXXX dollar loan. they did send me XXXX that night and my flip phone indicated i had XXXX extra in my account. my available balance said i had XXXX plus i my small balance. the scammers said that money was theres and i had to return it to them if i tried to keep it, they would contact the local police dept. and have me arrested for attempted fraud charges. so i asked how to return it and they mentioned i had to buy gift cards. i knew buying gift cards was a flag, but the money was in my account and the bank said it was available. so i did it. long story short, the bank showed me three checks, XXXX and XXXX pay to the order of XXXX XXXX XXXX and was endorsed by XXXX XXXX, not my legal financial name. i told the bank that the person sending the bank those 3 checks were commiting fraud because those checks were not mine, nor endorsed by me. the bank said that didnt matter, ouch! in todays modern computer technolgy signature endorsements did not matter. double ouch, a new on me.
