Issue: Closing on a mortgage
Subissue:
Consumer Complaint: Due to a failed business with a fellow XXXX XXXXXXXX, I entered into a five-year XXXX XXXX bankruptcy in XXXX. I was ordered by the bankruptcy court to not make any payments to creditors, to include my three Bank of Americas mortgages. Bank of America also changed all of my account numbers and blocked me from online portal access. The bank told me this is standard operating procedure for mortgagors that go into bankruptcy. A few years into bankruptcy the bankruptcy judge orders me to refinance my home. Being in bankruptcy, no lender would touch me. After being told no by 68 different lenders, a shark lender offered me a high-interest, interest-only loan. This was my one shot to make Bank of America whole and part ways. Given that I didnt have Bank of America online portal access to check my accounts, I had to rely on my real estate attorney who was managing the loan refinance process. This is where the bank error occurred that created this entire new mess. My attorney had requested a payoff from Bank of America. The bank responded that I only had two mortgages with the bank and proceeded to send her two payoff amounts. I immediately challenged the attorney ( see the attached documents ) but she said the bank stated there were only two mortgages and only sent two payoff amounts. This made sense since Bank of America only had two liens on the property. Everything seemed to match up. Anyways, long story short, the attorneys and title professionals proceeded as-is with the two payoffs and I successfully refinanced the property. It wasnt until I exited bankruptcy in XXXX of this year ( XXXX ) that Bank of America started to report me being late on the third mortgage. Which, apparently, still existed. This is when I realized that the bank and my attorneys were in-fact wrong and that a third mortgage still existed. I've requested relief from Bank of America and was subsequently denied ( refer to the included documents ). Bank of America completely failed to send the HELOC payoff documentation to my real estate attorney. Thus, causing her to not include it in the mortgage closing documentation.

Consumer Complaint: On XX/XX/2023, I received an email from BoA saying an SafeBalance account was opened under my name and email. This is the second time it has happened to me, it back in XXXX or XXXX of this year. The first time, I was able to call BoA fraud department and was able to resolve it. But this is the second it has happened to me with my name and email, it means that they did not update their " check '' or " verification '' process. For completion or done state, I would like this account closed and get their process updated. I have not banked with BoA nor I have any plans in the future.

Consumer Complaint: Six months ago, Bank of America opened a savings account associated with my existing account without my permission. I immediately called and had the account deactivated. My BoA username and password were changed, and two-factor authentication was added. This week, BoA opened ANOTHER savings account without my permission. I have not called on this account because it seems like it is someone with BoA, not an outside scammer, that is opening the accounts.

Consumer Complaint: Today I received an email an account was attempted to be open in my name at Bank of America. It was for a Bank of America Advantage SafeBalance Banking Account. This is the second attempt is less than a year. The first attempt was XX/XX/XXXX. The second attempt was today XX/XX/XXXX. I do not wish to bank with Bank of America and I continue to have issues with fraudulent attempts to open accounts in my name with them. When I try to call I have no account info so Bank of America will NOT assist in confirming accounts with my name and info are NOT opened or in use.

Consumer Complaint: The presence of a derogatory rating on my account is deeply concerning to me. I am worried about the impact it may have on my credit, as it has already resulted in the denial of a recent loan application and an increase in the interest rates on my existing credit accounts. I want to emphasize the significant financial and emotional distress this negative rating has caused me and will continue to cause until it is resolved.

There have been two fraudulent bank accounts opened with my identity through Bank Of America, first on XX/XX/XXXX, and now again on XX/XX/XXXX. Bank of America has closed both accounts, but since I have everything frozen and can't seem to prevent it, I can't rule out this being fraud committed by Bank of America.
