Issue: Problem caused by your funds being low
Subissue: Non-sufficient funds and associated fees
Consumer Complaint: On XX/XX/2020, I was charged 4 times NSF fee ( {$35.00} each time ) for the same transaction. The transaction was attempted two times on XX/XX/2020 and two times on XX/XX/2020 and for every attempt, the bank charged {$35.00}. Ive been advised that this is ilegal and the bank should have only charged me once for NSF for that transaction. Therefore, NSF total charges were {$140.00} and I should have only been charged {$35.00}. I contacted Bank of America and they stated that they couldnt refund the fees.

Issue: Applying for a mortgage or refinancing an existing mortgage
Subissue:
Consumer Complaint: I applied for a Qualified Assumption with my mortgage lender, Bank of America, in order to get my ex husband off my mortgage as per the terms of my divorce. I was told my application was denied do to high Income to Debt ratio. I questioned this because I only have a mortgage and car payment, I do not have any other debt, my credit cards are paid each month in full. My car payment is {$270.00} and my mortgage payment is {$1600.00}. My income each month ( salary plus alimony ) is {$6100.00}. According to my calculations my IDR is 32 %. Totally within the acceptable range. I have never missed a mortgage payment and my credit score is stellar. I was told that once an underwriter makes a determination I can not appeal it. They suggested I try to refinance to get my payments lowered. My issue is, I already paid off all my interest and I am currently paying down the principal with only {$120000.00} left and 6 years to pay off my mortgage in full. I do not think I should have to start paying interest again for the next 20-30 years just to get my ex husbands name off the mortgage. ( His name has already been taken off the title. ) I feel that my denial is unfounded. And to be honest, I feel that it was made because the bank stands to make more money if I refinance.

Consumer Complaint: In the month of XX/XX/2023, I paid the full credit card balance ( previous balance listed on my statement ) prior to my due date and Bank of America still charged me interest on what they referred to as a " Residual Balance ''. When I phoned their customer service department to question this charge, I was told that I would essentially need to overpay my credit card account to avoid purchase finance changes, as they no longer have a grace period for purchases. However, my monthly billing statement states, " PAYING INTEREST - We will not charge interest on Purchases on the next statement if you pay the New Balance Total in full by the Payment Due Date, and you had paid in full by the previous Payment Due Date. We will begin charging interest on Balance Transfers and Cash Advances on the transaction date. '' I told the reps that this language is misleading and deceptive, and there's no way for a consumer to know that it's necessary to call-in to request a pay-off amount in order to pay-off their credit card account, which is what the reps told me -- I should have called in to request a payoff amount opposed to simply paying my previous balance. I have had this credit card for XXXX and when I opened this account, I'm certain a XXXX grace period was included in my T & C and I don't recall received any XXXX that would state differently. The BOA reps suggested I review my initial disclosures.

Subissue: Transaction was not authorized
Consumer Complaint: We had a Bank of America checking account opened in XXXX as a custodial account for one of our then XXXX XXXX who had XXXX XXXX XXXX and XXXX XXXX XXXX. He had XXXX XXXX XXXX surgeries. The account was owned by his dad XXXX XXXX XXXX as representative payee and primary caregiver. His mother was his power of attorney. His XXXX checks, stimulus checks, settlement checks and any other monetary benefits for his needs and care was deposited and withdrawn. The account was paperless billing with mobile app on both parents phone and all information was up to date. In XX/XX/XXXX, we sold our home after our son needed a more reliable and safe home and area for his health and social care and life. We deposited the funds into the account and used what was needed and saved the rest for a future home purchase. We had other accounts that had large deposits with different banks, also set up the same way with paperless billing and mobile app. Starting on XX/XX/XXXX through XX/XX/XXXX, there were multiple withdrawals in varying amounts from {$1.00} to {$190.00} with a daily total of $ XXXX from one merchant XXXX We did not give consent, authorization, permission of any kind for merchant to access our account and for Bank of America to transfer funds from our account to apple.com for unauthorized and unrecognized transactions and purchases. We never received any text, frozen card, fraud alert, NO SARS report, no annual statement, no fraud letter, no phone call to account holder or emergency contact. We went into the branch in XXXX, XXXX to make a withdrawal for escrow for a home and was told that the account had been force closed with a negative amount. We were horrified. No one would give us a statement except to call fraud department. No fraud alerts, no mobile alerts. Nothing. I wrote down every fraud representative name, claim number, dates. Everyone apologized, agreed Bank of America was at fault but they would not give us our money back, no provisional credit for total amount. Three fraud department supervisors name XXXX, and XXXX, and XXXX attempted to mail out multiple checks for the total of our loss with no interest. Even though we had updated our phone number and address in the system and it was confirmed, the bank mailed the payments to our old address when account was opened. They claim that they remained the checks again but we received nothing. No letter after XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX We repeatedly ask for a provisional credit with interest immediately, we asked for a chargeback immediately, no one from any department has mailed us any letter or correspondence. They just took our money and stop communicating. We had XXXX immediate family deaths so we had to wait a few weeks for us not to have a XXXX or XXXX XXXX in our XXXX. We have lost everything. We are homeless, we list our vehicles, we lost our storage full of furniture and our life possessions. My husband and I have been married 33 years with XXXX children. Is our son with the serious XXXX XXXX had lost his parents he would have had funds to live and have a house and car. Our money was also in the account to provide for his care and our expenses on his behalf. His stimulus checks, we lost everything. The Bank of America ignored all the regulations of laws and rules of Regulation E, they never gave us a solution. We have a appointment On Tuesday, XX/XX/XXXX to again try and resolve this matter over XXXX? years old and receive a immediate payment from the bank that day. We have suffered enough. Bank of America allowed XXXX to daily withdraw thousands of dollars everyday from our account until it was depleted and no one tried to fix it, stop it, report it. We have been indigent and have lived in squalor for XXXX years individually and as a family. We have all the documentation finally and a paper trail how Bank of America has partnered with companies with AI software to not decline transactions. We need immediate action and resolution. Bank of America are like financial domestic terrorists preying upon the vulnerable and turning a blind eye. Please help make us whole again. We want our money back of course with interest daily but some of the homeless and health and life experiences we can not out a price on those traumas. Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: This is regarding the same alleged debt as the previous reports. I was called by a XXXX XXXX XXXX on XX/XX/XXXX, XXXX, twice on the XXXX, XXXX times on the XXXX and once in the XXXX regarding it. When I talked to them they refused to give any contact information other than their website RCApay.com and their phone numbers were all spoofed so I did not report it at the time. After that I was contacted by XXXX XXXX XXXX. Twice on XX/XX/XXXX and once on the XXXX and XXXX. This is the only one that I was able to ever get an actual address for and I sent a dispute letter by registered mail. They never replied. With every one of these I have received no mail correspondence in spite of verifying the address and requesting further information regarding this alleged debt. The only thing that I have been able to determine from all of the harassment is that it apparently originated from XXXX they XXXX XXXX XXXX and went to collections in XXXX. Which brings us to the current complaint against XXXX and XXXX, who contacted me on XX/XX/XXXX. They claim to be a law firm that will be pursuing legal action against me. I tried to tell them the same thing that I have told every other one of them. All I want is documentation of the validity of this debt that I do not recognize and I would be willing to discuss paying what I legitimately owe. He immediately resorted to threats of court. When I brought up the statute of limitations issue with the entire thing and the illegality of that threat he then lied about the statute of limitations, trying to claim that it is XXXX years in Illinois when it is XXXX for credit cards. Even at XXXX years it would still be well past that from whenever the last payment was made. He did nothing but spout off random rubbish, demeaning comments, and threats. Insisting that there was no obligation to even respond to a debt dispute letter because three other companies had the debt previously. He refused to acknowledge the fact that those other companies would not even give me an address.
