Consumer Complaint: I purchased two items from XXXX using my AMEX credit card. One was to be delivered on XX/XX/2022, and the other to be delivered on XX/XX/2022. Both of these packages had signature confirmation, so I figured everything should be fine and USPS ( the carrier ) should get everything in order before handing the packages off. Both statuses were updated to " Delivered to Agent for Final Delivery '' which I had never seen before, but after looking it up, it's used for when someone else accepts your packages, i.e., apartment complex, business, etc. This was weird since I live in my house alone and nobody is accepting packages for me. I waited in case the delivery driver made a mistake, but I did not receive it at the end of the day. I reached out to my neighbors and my local post office to see if they were there and they weren't. I contacted my local post office to get a proof of delivery, since this package had signature confirmation and it was delivered to an " Agent, '' I figured I'd be able to find out who received my package. Instead, I found that the " Actual Recipient Name '' and Signature on the proof of delivery were not real at all. The names weren't even names and the signatures were just circles. I've attached both proof of delivery 's for these packages. When I contacted XXXX ( the merchant ), I was told that the tracking numbers showed as delivered, so I was out of luck. With this, I contacted AMEX since the merchant wasn't helping me to resolve the issue. I created the disputes and I thought everything should be fine. However, both the disputes were closed in the merchant 's favor with the merchant providing the same proof of delivery with the fake names and signatures. I brought this up to AMEX again and was told that I should contact the merchant instead. I'm trying to understand how the proof of delivery provided is being accepted as proof when the names are not even names and the signatures aren't real at all and USPS accepted those and handed the very high valued packages off to whoever received them.

I had an American Express account that was closed without my express written authority. After reviewing my account, the Affiant notice there was a billing error that occurred in the throughout entirety of the account being open. Affiant is curious to know as to how this may have occurred knowing that American Express is honest and would ensure my account does not have any fraudulent activity. As you may be aware that the my social security number also known as a credit card as mentioned in 15 usc 1602 ( L ) was used to fund this open-end credit plan from my Beneficiary Trust account. According to 15 usc 1692J ( a ) It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in aconsumerthat a person other than thecreditorof suchconsumeris participating in the collection of or in an attempt to collect adebtsuchconsumerallegedly owes suchcreditor, when in fact such person is not so participating. 12 CFR 1022.43 - Direct disputes ( a ) General rule. Except as otherwise provided in this section, a furnisher must conduct a reasonable investigation of a direct dispute if it relates to : ( 1 ) The consumer 's liability for a credit account or other debt with the furnisher, such as direct disputes relating to whether there is or has been identity theft or fraud against the consumer, whether there is individual or joint liability on an account, or whether the consumer is an authorized user of a credit account ; This is considered fraud and there is not statute of limitation on fraud against a consumer. According to 15 usc 1666d Whenever a credit balance in excess of {$1.00} is created in connection with a consumer credit transaction through ( 1 ) transmittal of funds to acreditorin excess of the total balance due on an account, ( 2 ) rebates of unearnedfinance chargesor insurance premiums, or ( 3 ) amounts otherwise owed to or held for the benefit of an obligor, thecreditorshall ( A ) credit the amount of the credit balance to the consumers account ; ( B ) refund any part of the amount of the remaining credit balance, upon request of the consumer ; and ( C ) make a good faith effort to refund to the consumer by cash, check, or money order any part of the amount of the credit balance remaining in the account for more than six months, except that no further action is required in any case in which the consumers current location is not known by thecreditorand can not be traced through the consumers last known address or telephone number. Affiant had a balance that exceeded {$1.00} several times over the history of having this open-end credit plan opened. American Express gave the false believe that I was responsible for this debt, which in fact I am not. According to the 12 USC 411 The said notes shall be obligations of the United States and shall be receivable by all national andmember banksand Federalreserve banksand for all taxes, customs, and other public dues. They shall be redeemed in lawful money on demand at the Treasury Department of the United States.The Secretary of the Treasury shall pay interest due or accrued on the public debt. Also 31 usc 3123 ( b ) As the Secretary considers expedient, the Secretary may pay in advance interest on the public debt by a period of not more than one year, with or without a rebate of interest on the coupons. American Express has created the false believe that I the Consumer are obligated to pay this debt using Federal Reserve Notes or Floating Rate Notes, which is false and is considered extortion under 18 usc 1961. The United States is obligated to tender payment and it is Federal Law that when my credit cardsocial security number was used, it fully funds my account. Affiant has not received any disclosure separate from my billing statements 21 days before the statement date. American express also reported negative and false information to the consumer reporting agencies XXXX, XXXX and XXXX pursuant 15 U.S. Code 1681a - Definitions ; rules of construction ( c ) The term consumer means an individual. ( d ) Consumer Report. ( 1 ) In general.The term consumer report means any written, oral, or other communication of any information by a consumer reporting agency bearing on a consumers credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living which is used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing the consumers eligibility for ( A ) credit or insurance to be used primarily for personal, family, or household purposes ; ( B ) employment purposes ; or ( C ) any other purpose authorized under section 1681b of this title. ( 2 ) Exclusions.Except as provided in paragraph ( 3 ), the term consumer report does not include ( A ) subject to section 1681s3 of this title, any ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; ( ii ) communication of that information among persons related by common ownership or affiliated by corporate control; or ( iii ) communication of other information among persons related by common ownership or affiliated by corporate control, if it is clearly and conspicuously disclosed to the consumer that the information may be communicated among such persons and the consumer is given the opportunity, before the time that the information is initially communicated, to direct that such information not be communicated among such persons ; ( B ) any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device. Pursuant to 15 U.S. Code 1681b - Permissible purposes of consumer reports ( a ) In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other:2 ) In accordance with the written instructions of the consumer to whom it relates. ( 3 ) To a person which it has reason to believe ( A ) intends to use the information in connection with a credit transaction involving the consumer on whom the information is to be furnished and involving the extension of credit to, or review or collection of an account of, the consumer. American express did not have any authorization to report any information to nonaffiliated 3rd party. None of the consumer reporting agencies work for American Express or have a controlling interest in the company so how did they get my information with out my authorization. 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information ( a ) Notice requirements. Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information, unless such financial institution provides or has provided to the consumer a notice that complies with section 6803 of this title.b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option.15 U.S. Code 6821 - Privacy protection for customer information of financial institutions U.S. Code ( 2 ) by making a false, fictitious, or fraudulent statement or representation to a customer of a financial institution ; ( a ) Prohibition on obtaining customer information by false pretenses, It shall be a violation of this subchapter for any person to obtain or attempt to obtain, or cause to be disclosed or attempt to cause to be disclosed to any person, customer information of a financial institution relating to another personAmerican Express also did not give me the disclosure to opt out of having my private non public information furnished to the consumer reporting agencies so why was my information furnished to the without my permission. American Express clearly did not follow the laws set in place by congress to protect the consumer. Causing my consumer credit rating to fall significantly causing me no to be able to use my my open end credit to obtain goods and services for personal use. I am highly stressed and anxious because of this issue and would like a fair resolution.

Consumer Complaint: My credit was frozen and American Express still issued a credit card to a fraudulent person in Florida. I have no clue who this person is but American Express gave me his information. Despite my attempts, American Express refuses to close the credit card even though I personally do not have an account with them. This is fraud! This person was allowed to charge up to XXXX dollars even though they said they froze the account until he provided the proper identification. He never provided such identification since he doesnt have my DL or anything like that but since he made a small payment, they allowed him to continue to use the card. I have called many times and they say they will investigate but it always comes back denied. I have a police report and this person used my information to open other accounts which I had no issues getting closed since it was obvious fraud. This should never have happened in the first place since my credit was frozen since I have had issues in the past with fraud.

Consumer Complaint: On XX/XX/2022 I went to XXXX XXXX near my work & purchased a " SERVE '' by American Express card that I loaded with {$20.00} & paid a load fee of {$1.00}. When he tried to make a purchase it kept telling him that the transaction could not be completed. We called SERVE on the tele number on the card several times and they told me to go back to the store of purchase which was XXXX miles each way from our home & said they did not scan it correcty. But the store called their card company & was able to verify the purchase, date of purchase & the load amount. I was told it was an issue with the card issuer/Bank. So we called the bank SERVE several times again and was finally told to send them a photo of the Receipt from the store where ppurchased, a photo of the front & back of the card that was scanned at the store & copy of my drivers license. All which I emailed the same day on XX/XX/2022 to the email they provided to me for their " Activation Acceleration Dept '' of XXXX. They assured me they would respond with a resolution within 24 hours & thats been 3 weeks ago. I have tried to get a supervisor on the phone today for 4 hours & either they tell me they can not access my account & have to transfer me to another dept & then just disconnect my call or straight up hang up on me. This is not just about the money, this is more about principle and fair business practices & big companies like American Express should know better than to steal from customers & they need to make things right immediately! Consumer Complaint: On XX/XX/2022 I started having issues with my American Express Gold Card, without my knowledge or consent they reduced my credit card limit from {$10000.00} to {$3000.00} causing my credit balance to be very near it's limit. Around the same time by AMEX XXXX XXXX kept taking out the balance due from my automatic payment when should have had it set at minimum payment due. I called and spoke to multiple customer service reps and was told that my card will be set at minimum payment. When my next payment was due it again tried taking out the balance due causing my bank account to return the payment and I was charged multiple return fees of {$29.00}, totaling {$140.00} in fees. I again called AMEX to inquire why the issue was continuing to happen. I was basically told that it was my fault for not having enough funds in my account. Around the same time, I was also dealing with the credit limit reduction, I was told if I could pay an extra {$650.00} for the month of XXXX that they would consider increasing my credit limit again. The stress that the return fees were causing me and not being able to get a clear answer or solution from American Express I decided to pay off the XXXX XXXX to get the balance to XXXX, I paid {$790.00} on XX/XX/2022. I spoke with another customer rep to see if AMEX would be able to take in consideration that since I just paid one card off, and I wouldn't be able to make the {$650.00} payment to the Gold Card to have the credit limit increased. I asked if they would help me since I wouldn't have the money to make that payment and I was told no because both card are not the same and they are not able to assist me. At this point I have had no luck with any help from American Express and then XXXX, 2022 they cancelled both of my credit cards, without my knowledge or consent. I was told because I was late on payments, and that my credit balance is very close to it's credit limit that they made the decision to cancel both cards. I have been on time with my Gold Card, never missed a payment, with the blue card the issues were addressed with AMEX but never resolved to the point that I just paid the card in full. I can not express how much stress and anxiety these issues have caused me, I lost my job due to covid and I am finally working and trying to catch up with bills and they canceled my cards and have put 2 negative inquires on my credit score. If American Express did not reduce my credit limit, I wouldn't be near the cards credit limit and if they would have resolved the minimum payment issues when I called, I wouldn't have been late on payments. I tried to reach out to them with these issues and did not help me but instead canceled my cards, which is going to cause credit issues for me down the line, I feel very unfairly treated and bullied.

Consumer Complaint: American Express is violating my rights per my previous cease and desist. The alleged debt collector is still attempting to collect a debt, which I requested in the Cease and Desist submitted on XX/XX/22 by reporting my current balance to the credit furnishers ( XXXX, XXXX, and XXXX ). American Express is also limiting my usage on my open ended line of credit, I am unable to utilize my extension of my open ended credit obtained using social security card that American Express is claiming I owe them, that's the clearest definition of identity fraud. This is causing stress in my personal life. Violations include 15 USC 1692g, 15 USC 1666b, 15 USC 1602L. This account is prepaid and should never be reporting to the credit furnishers with a balance, or as late for any reason.
