Consumer Complaint: Hi My name is XXXX XXXX, The company name is Ally Financial Account number is XXXX There were complaints about this company. I paid this from XXXX through XXXX payment XXXX a month XXXX down payment. The total amount add up to XXXX. In XXXX I had financial problems I filed bankruptcy. The car was almost paid off my husband the veteran I was stressed out. I didn't add the payments until now 10 years after the bankruptcy the car was paid off back in XXXX. The payments was already paid for ownership for this vehicle. Last Friday I got a call from Ally Financial and he said, he was surprise I took the call, I told him I paid the car off I didn't need to hide. I went back in books My XXXX showed that I made payment from XX/XX/XXXX XXXX up until XXXX that total XXXX down payment was XXXX Ally had complaints because I received this letter from CFPB DATED XXXX XXXX ALLY FINANCIAL COMPLAINT this is just another one I paid the car off and they talk reprocessing my vehicle after i paid the car. I wrote show proof of payments.

Consumer Complaint: Pursuant to 12 CFR 1006.30 a debt collector may not furnish information regarding a debt to a credit reporting agency without consumer 's consent. However, in addition to consistently furnishing information regarding this alleged debt, on XX/XX/XXXX ALLY FINANCIAL reported a late payment in my name to XXXX ( see attached ). Also, on XX/XX/XXXX I requested that this alleged debt be validated by ALLY FINANCIAL. Note that under FDCPA Section 809 ( b ), ALLY is not allowed to pursue collection activity until this alleged debt is validated. Be advised that in Boatley v. Diem Corporation, No. Civ 03-0762 ( D.C. Ariz. 2004 ), the court ruled that reporting a collection account is, indeed, considered collection activity.

Issue: Applying for a mortgage or refinancing an existing mortgage

Consumer Complaint: A rate was locked at 2.375 % to refinance my home with Ally bank. All steps were followed for data collection and an appraisal was conducted by an outside third party. The appraisal report came back filled with a number of statements that were false ( appraiser stated we spoke a number of times, requested specific information be included, etc ). He came to our home the day of the appraisal, he walked through our home, and then left and we never spoke again. I find this to not only have sabotaged a refinance due to a low rate not wanting to be honored but I was also charged the {$550.00} for the appraisal yet no one will explain to me why its acceptable to supply a report that has false information in it. When dealing with such important things such as someone's mortgage I feel that ethics is a very important items to uphold and when a bank can accept false information I do feel its not only wrong but unethical.

Consumer Complaint: I had transferred a car loan from one lender to another in XX/XX/XXXX from Ally Financial to XXXX XXXX XXXX. In the process, I no longer needed GAP insurance and was supposed to get a refund. My mail was broken into on XX/XX/XXXX and the check was stolen. This was in the middle of a natural disaster in Texas and did not become aware that the check until XX/XX/XXXX. I contacted the lender, Ally Financial, who first accused me of assisting someone to cash the check and refused to help me. I filed a complaint with the XXXX which cause Ally to reach out to me and asked me to file an affidavit with me and XXXX XXXX XXXX who cashed the check on XX/XX/XXXX. I have been attempting to get a status of this and when I can receive my money but Ally refuses to contact me or return my calls.

Issue: Problem with a lender or other company charging your account

Consumer Complaint: Ally Financial ( aka Ally Invest, aka XXXX XXXX ) failed to perform its fiduciary duty to me and also stole money from my brokerage account. I have been in dispute with Ally Financial trying to get my money back that was stolen from my brokerage account as inactivity fees ; a total of {$200.00} of which I only received {$50.00} refund. Ally Financial still owes me the remaining {$150.00}. I accuse Ally Financial of the following : 1 ) Stole money from my brokerage account. 2 ) Failed to perform their fiduciary duty to me as my de facto brokerage firm. 1 ) I initially opened my brokerage account with XXXX in XXXX. There was no inactivity fees in the agreement. At the time, I was aware of Trade King ( now Ally Invest / Ally Financial after XXXX acquisition ) in that it charged inactivity fees and had decided not to do business with it. In XXXX, XXXX was acquired by XXXX XXXX ( XXXX ) and it became my de facto brokerage firm. I did not have any agreement with XXXX. I was not able to move my account out of the firm because it was the Great Recession and I would have incurred a big lost. Also during the merger, XXXX and XXXX ' CEOs jointly sent out e-mails to XXXX account holder promising to " keep the same ... products and services that attracted them to XXXX to begin with. '' ( Refer to attach document Doc1 for e-mail printout ). However, XXXX broke that promise by stealing money from my account yearly from XXXX to XXXX as inactivity charges. I have been in dispute with Ally Financial to recover my money. 2 ) I have been contacting Ally Financial to recover my money but the firm was not interested in helping me. It has failed to perform its fiduciary duty to me. In XX/XX/XXXX, I did a web chat with agent XXXX and he agreed to give me a refund of the inactivity fee from 4 years, that would be {$200.00}. However, I found out some time later that only {$50.00}, one year of fee was refunded. I asked for 4 years in my original chat, so I went on web chat again, and was connected with manager XXXX XXXX. He told me that XXXX did not mean what he said and that he only agreed to give me one year 's worth of fee that was {$50.00} instead of the {$200.00} that I asked for. He said that XXXX could have been more clear, but then did not rectify the problem, and instead continue to say that company policy only allowed for a one time refund. XXXX ended the chat with while I was still inquiring about the money. That was not customary business practice. I accused Ally Financial of failure to act in my best interest. The firm and its agents did not honor their words with me. All in all my account was hit with more inactivity charges than commissions for the service. Consumer Complaint: I called in to ask to explain my interest charges varies up and down so drastically even when I pay extra. The supervisor explained the daily rate and how it is calculated. I the asked why does there portal state I do not have a payment due for 2 months. I thought that was very odd and very confusing. He stated I can pay but so not have to. I then asked why would that be. It feels they state this so I wouldn't pay for 2 months and would be charged {$280.00} in interest charges in XXXX. This message that is presented to me was made to confuse me and make me feel as if I am ahead of schedule. This feels like a very misleading tactic with no benefits towards the consumer. If they would leave my bill the same I would pay it as required by our agreement. This actually happened back in 2020 where I saw only {$100.00} was due. Now I understand they simply charged me more interest on the {$220.00} I didn't pay that month.
