Subissue: Reporting company used your report improperly
Consumer Complaint: I received a copy of my credit report and I am disputing some items that need to be deleted. I have listed the account, the opening date, and the account numbers, when possible, below. The reasons why these items should be deleted are indicated below : Pursuant the Fair Credit Reporting Act, these disputed items must be reinvestigated or deleted from my credit record within 30 days. Throughout the investigation period, these items must be removed from my credit report as the reporting of items prior to debt validation constitutes collection activity. In your investigation results, please render the names, addresses, and telephone numbers of individuals you contacted during your investigation. Under the U.S. Code 15 1666b- Grace Periods ( b ) If an open end consumer credit plan provides a time period within which an obligor may repay any portion of the credit extended without incurring an additional finance charge, such additional finance charge may not be imposed with respect to such portion of the credit extended for the billing cycle of which such period is a part, unless a statement which includes the amount upon which the finance charge for the period is based was mailed or delivered to the consumer not later than 21 days before the date specified in the statement by which payment must be made in order to avoid imposition of that finance charge. Under U.S. Code 15 1635 b- Return of money or property following rescission ( b ) When an obligor exercises his right to rescind under subsection ( a ), he is not liable for any finance or other charge, and any security interest given by the obligor, including any such interest arising by operation of law, becomes void upon such a rescission. Within 20 days after receipt of a notice of rescission, the creditor shall return to the obligor any money or property given as earnest money, downpayment, or otherwise, and shall take any action necessary or appropriate to reflect the termination of any security interest created under the transaction. Ally Auto reported to the credit bureaus late/non payment, which is a violation of the U.S. code XXXX I, XXXX XXXX did not give my written consent for these accusations to be reported on my consumer report. No consent is identity fraud and its also unauthorized use. Late payments are showing up on the XXXX CREDIT REPORT. Im commanding it to be removed asap. Ally Auto applied debt to payment, which is also a violation. Attached to this dispute letter is a copy of the law.

Issue: Problems at the end of the loan or lease
Subissue: Problem with paying off the loan
Consumer Complaint: I'm going to do two things today 1 ) give you the first complaint number which conveniently for the lender falls in line with exactly what the are doing which is taking of the customer because the CFPB dropped the ball - left your rules open ended for all Closed loans and let Lenders dictate unfair terms to the very people your suppose to protect so here that is XXXX. 2 ) I did also file a complaint with another federal entity. At the end of the day Ally is banking literally on holding my money for 60 days, it matches your policy exactly. Ironic. Who knows I am suspecting interrupting a XXXX dollar loop hole isn't popular. Lots of other people are hurting by your choice to just not complete your job. Anyway haven't heard a thing from Ally other than an updated lean statement, but yet my money sits in their accounts alomst a month already. Imagine how that money is being leveraged. Anyway I do suspect you are doing this job for the right reasons but when your first response is to put in the party who is taking advantage of the consumer- doesn't that just not seam right? Thanks for your time!

Consumer Complaint: This was a XXXX lease through ALLY Financial that was paid in full with no late payments. I was contacted sometime after the vehicle was turned in with a claim that there was " scuff marks '' on the rear fender. This minor damage was not done by me but by the dealership ( I witnessed the vehicle being driven around town after I turned it in ). After several weeks of harassment and constant calls by ALLY FINANCIAL I agreed to pay a lower amount in order to stop the constant phones. At no point in time did the topic of a " settlement '' come up and in fact they considered the matter closed after we agreed to a final amount ( even though the damage was not done by me ). FYI - my credit score at the other two credit bureaus is XXXX & XXXX.

Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: A company called ALLY Financial has repeated called my home and left a message for me to contact them in reference to someone else who allegedly owes them a debt. I do not know this person who allegedly owes this debt nor have I ever done business with this company or this person. I do not know who they are. I feel that I am being harassed by ALLY Financial with whom I have never had an account with nor done business with, nor do I know the person that they are contacting me about. It seems that they are running a scam or phishing.

Consumer Complaint: Ally Bank closed my account with no notice and has not sent me a refund for the money I had inside ( ~ {$3000.00} ). They claim to have sent a notice ahead of time, but I have a log of every mail delivered to my address and determined their claim to be untrue. I called them asking for my money back, and they said that they did not yet mail a check. I asked them if they could call me back and provide a tracking number, and they said yes. It's been several days, and they have still not sent my money.
