Subissue: Problem making or receiving payments
Consumer Complaint: I have been a customer of XXXX for a number of years. During that period Ally has consistently added cookies from outside organizations, trackers, and cross-trackers. I have refused to allow the use of these cookies and trackers to access my personal banking activities and they have consistently refused to bring this situation under control. Over this weekend Ally refused me access to my Bill Pay function and continues to do so putting me in the position of either allowing access to their cookies and trackers, or not being able to pay my legitimate bills from my available funds. Attached is both a copy of Ally 's statement of refusal of access, and a copy of search results from The XXXX 's XXXX search that indicates the number of cookies, trackers and other forms of intrusive spyware on Ally 's web site that are far in excess of the average number of such found on other websites.

Issue: Struggling to pay your loan
Subissue: Denied request to lower payments
Consumer Complaint: My complaint is about Ally 's unwillingness to help their customers when they are having issues making a payment. Let me preface this by stating I have perfect credit, I've always made my payments on time for all my bills. Unfortunately I was laid off my job a few months back and I continued to make my lease payments, I've been paying on this lease for about a year and a XXXX so I'm half way through the lease. I called Ally customer service and asked for an extension which the person I spoke with said they'd grant and everything was good. The following month I get an email stating my account is delinquent, I call and speak with collections who states they have no notes to show I ever called. They said they can offer me a 2 month extension, but the fee was {$800.00} dollars .... {$800.00} is more than a car payment and this is just a fee not even a payment. I don't have the money to make the payment is the issue and the company wants to charge a very excessive fee. Absolutely unfair business practices and predatory lending preying on those that are already struggling asking for assistance. I XXXX XXXX the vehicle, it has less than XXXX miles on it and has equity, but I can't even sale the vehicle because Ally wants to charge MSRP to anyone that is not the owner of the car. I asked about a lease buy out and they said it would be almost $ XXXX dollars, I only owe $ XXXX on the remaining lease payments. I spoke to the executive response unit after making a complaint and they were basically just another collection agent telling me how I agreed to the lease terms and could offer no assistance or empathy. I'd never do business with Ally again and don't suggest you to either.

Issue: Getting a loan or lease
Subissue: Fraudulent loan
Consumer Complaint: Ally Bank approved the financing of my auto loan from the XXXX XXXX XXXXXXXX XXXX in XXXX XXXX XXXX, Texas after the promissory note was signed at the dealership for full faith credit payment of said goods purchased. Under the FDIC Hold in due process 6000 Rule 433.2 ( a ) Take or receive a consumer credit contract which fails to contain the following provision in at least ten point, bold face, type : NOTICE ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF. RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER. 16 CFR Part 433 Staff Guidelines on Trade Regulation Rule Concerning Preservation of Consumers Claims and Defenses ( Holder in Due Course Rule ) Rule Summary The Preservation of Consumers Claims and Defenses [ Holder in Due Course Rule ], formally known as the " Trade Regulation Rule Concerning Preservation of Consumers ' Claims and Defenses, '' protects consumers when merchants sell a consumer 's credit contracts to other lenders. Specifically, it preserves consumers ' right to assert the same legal claims and defenses against anyone who purchases the credit contract, as they would have against the seller who originally provided the credit. ( I was not provided full disclosure, and my credit was not credited to my account. ) First, the seller may execute a credit contract with a buyer which contains a promissory note. In the event that the promissory note is assigned to a credit company, the credit company takes it free of any claim or defense which the buyer would have against the seller. This is true unless the buyer can prove that the credit company is acting in bad faith or with notice of actual seller misconduct. Second, if a local statute prohibits the use of such promissory notices in credit sale transactions, the seller may incorporate a written provision called a " waiver of defenses '' in the text of an installment sales agreement. A waiver of defenses is the consumer 's written agreement that his installment purchase contract may be treated like a promissory note in the event that it is sold or assigned to a credit company. ( I was not provided full disclosure, and my credit was not credited to my account. ) Ally placed a lien for payments on this loan when the dealership was paid in full faith per the consumer credit contract and the signed promissory note. My attached Certified XXXX Search 11 shows no lien was ever placed on the goods in question. I'm not able to access my online statements or contract, I did send Ally Bank a request for a copy of my contract or statements.

Issue: Managing the loan or lease
Subissue: Billing problem
Consumer Complaint: My truck is and has been paid every month. I have copys of confirmation numbers for each payment along with the date. In XX/XX/2022 after providing proof of payment history to the lender and credit reporting companies ally continued to say I owed about 4 payments ( even though I gave proof of payments from the start of the loan ) I requested several times my letters of extension during COVID just so I could match up my payments with extension and that my loan was not past due all along being changed interest, late fees and misc charges. I disputed the account information and payment information more than 4 times. All along killing my credit from on time payments % about 96 % to less than 80 % making it impossible to refinance it and make a home purchase. Not one person or company can explain. I decided to make 4 payments + in XX/XX/2022 just to get the account updated thinking it would give me time to get this loan corrected with out any further damage to my credit. And have continued to make my payment every month. This company has now managed to make a past due amount of almost {$2000.00} again exactly what happened in XXXX. Again copys of every payment every month being made and has never corrected my credit reports from the last time.

Issue: Struggling to pay your loan
Subissue: Problem after you declared or threatened to declare bankruptcy
Consumer Complaint: I filed a XXXX XXXX bankruptcy on XX/XX/22, initially, I had signed a reaffirmation with Ally bank because I was hoping to still be making enough money to support the loan. I realized in the next month it was not looking good for me financially so on XX/XX/22 we filed a notice of rescission of reaffirmation. I have not heard from Ally Financial, despite reaching out to them on several occasions, and on XX/XX/22 a surrender letter was filled out and sent to them. They requested the location of the vehicle, which was supplied to them same day as well as the facility gate hours, and to date ( XX/XX/22 ) it has not been picked up, I have not been contacted, and they have not updated to show it was surrendered. I have made several attempts to get my credit report updated but they refuse to update it and still show all months are past due and the amount it owed.

Consumer Complaint: Recently, the last month or two, Ally Bank has been very difficult to reach. I have banked with this company for over 10 years and they have always been immediately available or with wait times less than 10 minutes. However yesterday ( XXXX XXXX ), I wanted to replace my lost debit card. The first call cut off after 47 minutes of waiting, the second after 50 minutes of waiting. This morning ( XX/XX/XXXX ) their estimated wait time, at XXXX am, was 75 minutes At least today, they offered to call me back. It has been over 30 minutes and I am still waiting. I realize that this is not an emergency situation. However, if I was traveling or some other dire occasion, what would I, or any other customer, do? There is a place on their website to 'lock ' your card. Shouldn't there be a place to request a lost or stolen card? I am sure there could be enough safeguards for that. At the very least their call time response needs to improve drastically. And dropping calls is not on my end, my phone never drops calls. I plan to find another financial institution in which to place my money.

Consumer Complaint: For about a week, my bank, Ally Bank has held a negative balance of XXXX in my account for no apparent reason. I tired to call the bank and tell them twice, but both times i was told they would check it out and make a case and i would be contacted again if needed. Nothing has changed in 3-4 days since i contacted them. My account is still negative. I have not gotten an explanation for this and whenever i try to talk to customer service the wait time is ridiculously long every time. There is no way i owe this much or have a negative balance at all. Im getting extremely fed up with this bank. Bad customer service as well as terrible mobile banking experience as ive been locked out of the app many times and only way to get access back is to call and wait 30-55 mind every time, its unacceptable.
