Consumer Complaint: The Set Up In late XX/XX/XXXX, I was selling my car. A buyer online offered to buy it for {$4000.00}. He agreed to send me a certified check from a bank in the purchase amount plus an amount to pay the transport person. The buyer sent the check for {$5900.00}. I was to keep the {$4000.00} and send by XXXX the {$1900.00} to the transporter. I thought this was strange, purchasing a car without seeing it and then having me give the money to the person to move it. But, I knew I would do nothing until my bank ( U.S. Bank ) told me the check cleared. I deposited the check remotely using my U.S. Bank app. On XX/XX/XXXX, within XXXX hours, U.S. Bank notified me the funds were fully available/check had cleared the clearing house. I then made the transfer of the {$1900.00} based on my bank telling me the funds were available. The XXXX Sting U.S. Bank told me the money was available. I would not have sent the {$1900.00} by XXXX had U.S. Bank not done that. They blew the whole clearinghouse system process and caused my reliance. The XXXX Sting The BuyeXXXX contacted me on XX/XX/XXXX, that a family tragedy had happened. They needed the remaining money back, minus {$500.00} for my troubles. I became suspicious and refused saying I would not XXXX any more money. I needed to consider what was going on. I thought I was being used in a money laundering scheme. I began to investigate the bank on which the check was written and it no longer existed. It was purchased by another bank around XXXX. The defunct bank was called " XXXX Bank XXXX XXXX XXXX. '' I called U.S. Bank as soon as they were open next to report the fraud. They said it was likely a fraudulent check. I replied " not so '' because U.S. Bank had already noted it available for use/the check cleared. The bank conducted an investigation based on my complaint about the fraud and the banks negligent behavior. The bank determined on XX/XX/XXXX that the check was fraudulent, docked my account, and sent me a returned deposit notice. On XX/XX/XXXX, more than XXXX days after beginning the investigation, I received the notice that U.S. Bank would not take responsibility for their error. I had been told by their fraud department that if they took more than XXXX days they would give the money back.

Consumer Complaint: This is regarding the original complaint submitted to CFPB for XXXX and XXXX. I am providing additional evidence of deceitful business practices by US Bank. The bank responded to the complaint dated XX/XX/XXXX. It stated on the front cover incorrectly that " The state of FL is an electronic holding state. A paper title has been requested ; please allow up to 6 weeks for the request to be completed. '' I have contacted the Florida XXXX XXXX XXXX collector 's office, XXXX XXXX, with a money order of {$85.00} in order to obtain the title in XXXX of 2020. Please see the attached response of the Florida XXXX collector response, note a typo of date, it should be XX/XX/XXXX, not XX/XX/XXXX. US Bank 's response is contradictory to the response of the XXXX collector XXXX in Florida.

After I figured out that who ever stole my bag was using my card and seen the fraudulent charges i called it in stolen. I made a police report. They sent me some forms in the mail I got them and i filled those out and signed the forms and faxed them in. & the same day I called to check if they received those forms they told me that they had denied my dispute claim and would not give me any sort of reason as to why. I dont understand how they denied it considering the charges are from a town 3 hours away from me. They basicly denied me and said sorry your XXXX.

Consumer Complaint: I went to US Bank to close my XXXX XXXX account in XX/XX/XXXX and followed up in XX/XX/XXXX. When I gave my ID to the teller she told my grandmother account was closed already but I have a charge off amount that I need to pay. I told the teller have a have charge off balance with them over {$300.00}. I told the teller I closed my account by in XXXX with a XXXX balance. The teller goes to tell me the account was opened in XXXX, Kansas. I told her that was odd because I have lived their since XXXX. The tell goes to tell me to call the fraud department for US Bank. So I called the charge off department and the fraud department tell them know it was not me that opened that account in XXXX, Kansas because I haven't there in over 20 years. I even asked how did the account get open with out my ID the fraud department couldn't answer the question. So the lady that I spoke to said that she will file a police report that day. And as of today I have not heard back from US Bank. I had for me to open account with a bad check account that I didn't open. The information show up on Checksystem.

Consumer Complaint: By court order on XX/XX/XXXX, US Bank was ordered to return an amount that they wrongfully ( electronically ) took from a customer 's savings account in the amount of {$6200.00}. US Bank claimed that they honored the court order by sending ( via mail ) a check in the amount of {$6200.00} to the customer at his home address in XXXX, but was never received. Upon demanding an explanation of why funds have not been received, we were finally able ( almost a year later ) on XX/XX/XXXX to obtain a copy of the cashed check from US Bank. Examining the copy received from US Bank we found the check was fraudulently endorsed and paid to the order of another person for cash at a XXXX in the state of Ohio. We explained to US Bank that the customer, who is XXXX years old, a XXXX XXXX XXXX Veteran and needs assistance walking, did not travel to Ohio and present the check for cash at a XXXX. To date, and after repeated request, US Bank has no restored the funds to the customer 's account.

Consumer Complaint: this is to provide more information to the investiagtors regarding this fraudulent application. I have attached the most recent response from elan financial. They state that I sent in an identity theft victim 's affidavit to them but I never lived at the address they claim this form was sent from. I XXXX this form and it is a generic form that anyone can send in. It is my understanding that many credit repair companies use this form and is used by many for identity theft. The phone number XXXX is not my number and if it is under my name then someone has opened it fraudulently under my name. I respectfully ask that you review this information and close this fraudulent account. If there is anything else you need to help resolve this, please let me know. I need this account closed out because you are reporting this account with my social and allowing access to my current information to the identity thieves by your continued reporting of this. I do not want more accounts opened using my social.
