Consumer Complaint: I have an outstanding balance on my mortgage and with the XXXX association of my home. There was an auction scheduled on my home prepared by the XXXX association for XX/XX/2023. I currently have an application with XXXX program filed a month ago thats been in expedited status and is under pre-approval. XXXX requested records information on the loan to complete and finalize processing. XXXX also reached out to the servicer to request postponing the auction due to my application was in place and steps away from being funded. The servicer has not responded yet and my home was auctioned off to a gentleman on the XXXX. The gentleman is willing to omp-out of the bid he made on my home but funds needs to be received. XXXX is only waiting on the response from the servicer with the records they requested to release the funds.

Consumer Complaint: According to the Fair Credit Reporting Act ( FCRA ), 15 USC 1681 section 602 ( a ) states " there is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer 's right to privacy. XXXX, XXXX, and XXXX are credit agencies and I am the Consumer. It is my lawful right to make sure my information is kept private and is not shared. 15 USC 6801, which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers ' nonpublic personal information, '' supports my claim. TD BANK USA/TARGET CREDI is a financial institutions by definition under this title. 15 USC 1681 section 604 ( a ) section 2 states " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer repot under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates ''. The financial institution, TD BANK USA/TARGET CREDI, along with the consumer reporting agencies, XXXX, XXXX, and XXXX, did not and do no have my consent to furnish this information nor did they have or do they have my written consent. Any and all consent to XXXX, XXXX, XXXX, and TD BANK USA/TARGET CREDI, whether it be written, implied, verbal, nonverbal or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " a financial institution may not disclose nonpublic information personal information to a nonaffiliated third party unless -- - the consumer is given an explanation of how the consumer can exercise that nondisclosure option. TD BANK USA/TARGET CREDI never informed me of my lawful right to exercise my nondisclosure option. Along with that, 15 USC 1681C ( a ) ( 5 ) states " except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of he following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' These accounts are adverse items they are reporting again without my permission which is against the law. 15 USC 1681 ( b ) states " It is the purpose of this subchapter to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this subchapter. The financial institution inaccurately reported the closing date of this account as XX/XX/XXXX, when in fact, the closing of this account took place months prior in XXXX. 5 USC 552 ( a ) ( b ), which is the Privacy Act of 1974, states " No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of the individual to whom the record pertains ''. Again, these financial institutions and credit reporting agencies did not and do not have my written consent. 15 USC 1681s-2 ( A ) ( 1 ) states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate ''. 15 USC 1681e states " every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX, and XXXX are not maintaining reasonable procedures. 12 CFR 1016.7 states " a consumer may exercise the right to opt out at any time ''. I am opting out of these reporting services.

Consumer Complaint: On Friday, XX/XX/2022, I was in the XXXX of XXXX, XXXX doing some shopping. I withdrew XXXX Euros from an ATM machine. Realizing I needed more money to leave tips for the housekeeper, etc. at the villa we rented ( we were departing the morning of XX/XX/XXXX ), I attempted to withdraw more funds from the same machine. I performed the action and attempted to withdraw another XXXX Euros, but the machine wouldnt expel the cash and the alert on the screen of the machine stated that I had reached my limit of withdrawing funds. Later that evening while my family and I were at dinner, I attempted to withdraw funds ( XXXX Euros ) from another machine in XXXX. That machine also would not disperse the cash and another message was on the display screen stating that I had reached my maximum daily withdrawal. I was under the impression that the reason I couldnt withdraw the funds at the machine earlier in the day was because that particular ATM had a limit and I passed it. I didnt realize that my bank account was limited to a daily maximum for withdraw. When I returned to the US, I checked my account balance and noticed that my account had been debited for the two attempts I made in XXXX. I called Customer Service and made my complaint. The complaint was denied. I called again to dispute the decision, and my account showed a provisional credit. I assumed the matter had been settled. Upon checking my balance again, I saw that one of the provisional credits had been reversed. I would like to reiterate that I did in fact ATTEMPT to withdraw those funds while I was in XXXX. However, the machines DID NOT DISPERSE THE CASH. I am not and never was in possession of the {$790.00} that was debited from my account.

Consumer Complaint: Between XX/XX/XXXX and XX/XX/XXXX, I was victim of fraud on my account. 32 transactions totaling {$8700.00} were charged on my account without my authorization. I was not called or texted to verify the transaction. I can provide utilization data download from my cellphone provider to show that I was never contacted by TD Bank to authorize the transactions. On XX/XX/XXXX I contacted TD Bank after realizing that unauthorized charges were debited from my account. After putting the claim, I received a provisional credit of {$5300.00} on that day and a credit of {$420.00} on XX/XX/XXXX. Not all charges were captured correctly on my first conversation on XXXX and the initial credit received did not cover all fraudulent transaction. I therefore contacted TD Bank again to open a claim for the missing transactions. On my second conversation on XX/XX/XXXX transactions were added to my claim equaling {$3000.00}. On XX/XX/XXXX of the 32 provisional credits I obtained were reversed. On XX/XX/XXXX I visited my local branch and put a new claim for the 12 transactions that were denied a credit. On XX/XX/XXXX, my account posted the 12 credits provided were once again reversed.

The home at that address is owned by an extended family member and because of this I was alerted to the communication. We promptly communicated to XXXX that : ( 1 ) the debt was not owed by me ; ( 2 ) I had never had a credit card issued by TD Bank or Target Card Services ; and ( 3 ) I had never lived at XXXX XXXX XXXX. XXXX indicated that they would note that the address was incorrect and that the debt was not owed by me. On XX/XX/XXXX, another letter was sent to XXXX XXXX XXXX related to this debt on behalf of Target Card Services and TD Bank. This letter was not sent on XXXX letterhead, but rather only identified Target Card Services and TD Bank. We called the number listed on the letter ( XXXX ) and again informed them that : ( 1 ) the debt was not owed by me ; ( 2 ) I have never had a credit card issued by TD Bank or Target Card Services ; and ( 3 ) I have never lived at XXXX XXXX XXXX. They again " made a note on the account '' but also asked that we return the letter as " Return to Sender -- Wrong Address. ''

Consumer Complaint: Nordstom/TD Bank is in violation of the FCRA 623. On XX/XX/XXXX, I put them on notice in regard to the errors in their reporting. This letter was sent via USPS priority mail. As of today, XX/XX/XXXX, I have yet to receive a response and the errors are still reported. The account with was opened in XXXX. TD Bank does not start reporting of the account 's payment history until the first delinquency event. This means all positive payment history prior to the late payment is not reported. This is a violation of the FCRA as the account must reflect accurate and COMPLETE information. I find it suspicious that the creditor can report any negative history, but for dates on which payments were made on time, it is reported as " no data available '' even if those on-time payments occurred in the same year as late payments. Additionally, TD Bank is reporting two accounts that are the same account but have different account numbers. Last week, I spoke to a representative in the credit department that stated that they were the exact same account. The second account is reporting positively to the credit file but is also reporting a balance that I do not owe. This information is inaccurate and despite my calls, and disputes through XXXX as well as my dispute directly to this creditor under FCRA 623, my rights have continued to be violated. The creditor had 30 days to respond to my FCRA 623 dispute and failed to do so. The law is clear in that they are required to delete the account under federal law. Clearly, that time has surpassed. I have attached the original letter sent to the address listed in my credit file.
