Consumer Complaint: The company filed a forcloser on me over a year ago and I hired an atterney to dispute the XXXX XXXX the company requested a dismissal of the case but the judge is still waiting on the final closer of this case.during this time the company has reported false information on our credit reports.This company has received more than fair amount for the loan but now refusses to give me a lean release .My atterny has given them until the XXXX of XXXX to give us the lean release.They in the mean time are reporting us as 30 days late on a closed account every month .I have documents of a letter written by them ststing they wouldnt report on our credit but they have been reporting me to this day.

Consumer Complaint: Shellpoint falsified to XXXX XXXX and XXXX XXXX XXXX XXXX XXXX that I did not qualify for a covid modification because my loan was more than 60 days past due on XX/XX/XXXX. I spoke to XXXX XXXX and the representative said that this means 2 payments. I was not more than two payments delinquent on XX/XX/XXXX. Yet, Shellpoint is playing games with my payment history and the confusion about 30 days translating into one payment. Background only on how we got here.-I successfully completed a trial modification that Shellpoint withdrew for unethical reasons because I paid the amount on their statements that differed with the offer letter. Then, Shellpoint falsified to XXXX XXXX that I did not make all three trial payments. Shellpoint was supposed to have sent me an approval letter on XX/XX/XXXX according to my single point of contact XXXX XXXX. But, he said his superiors, in which XXXX XXXX is his supervisor, overruled him and asked for another trial modification. Shellpoint claimed it was what XXXX XXXX approved, but XXXX XXXX said the decision as 99 % Shellpoints and XXXX XXXX had not been given the facts favorable to me. But, Shellpoint has mischaricterized what happened as though I failed to comply with the terms of the modification when in fact Shellpoint sent me different modification amounts on my official monthly statements, which I paid. I asked for clarification and Shellpoint refused to provide it. - End Background

Consumer Complaint: In case number XXXX, Shellpoint falsified documentation to XXXX XXXX. Shellpoint falsified that my payment on XX/XX/2021 was for my second XXXX trial payment in unethically make it appear as though I did not complete the trial modification. This complaint is about their falsifying information to XXXX XXXX. The reason they did it is because after I successfully made all three trial payments they claimed to have returned the third trial payment. XX/XX/2021, I paid {$1000.00}. The amount on the offer letter. XX/XX/2021, I paid {$990.00}, the trial modification amount on Shellpoint 's official statement. I asked Shellpoint to clarify the difference. Shellpoint refused to respond. But, Shellpoint cashed the check and did not say it was short. XX/XX/2021, I paid the {$1000.00} plus the {$22.00} difference for XXXX since Shellpoint never responded. After I was able to make the payments that they did not think I could make, then they went to plan B. For paying their statements and making up the {$30.00} difference, Shellpoint revoked my trial modification. In an attempt to hide how predatory and unethical they are, they falsified to the XXXX XXXX that I did not make all three trial payments.

Consumer Complaint: Shellpoint became the loan servicer on XX/XX/XXXX [ Ex. 1 at p.2. ]. Shellpoint did not provide timely notice of transfer of servicing to the borrower at the address listed in the mortgage documents. Instead, on XX/XX/XXXX, Shellpoint sent a notice to an unknown address ( XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, NM XXXX ) [ Ex. 1 at p.1. ]. Shellpoint knew the actual property address was as identified in the same notice at Property Address : [ Ex. 1 at p.2. ]. Thus the borrower did not receive notice that servicing was transferred to Shellpoint. 12 CFR 1024.33 ( b ). Shellpoint posted the specified address for Notice of Error and Information Requests on its website [ Ex. 2 ]. On XX/XX/XXXX, Shellpoint received the Borrowers Notice of Error at the address it specified [ Ex. 3 ]. Shellpoint did not provide an acknowledgement of receipt within 5 days. Shellpoint did not respond at all to the Notice of Error. Notwithstanding the aforementioned failures, the Borrowers Notice of Error asked Shellpoint to investigate the following additional 13 errors identified in the full complaint attached hereto. The borrower request written accounting for each error.

Consumer Complaint: My mortgage was transferred from XXXX to XXXX mortgage. Neither company or informed me until I received an email from XXXX that they didnt receive my XXXX payment. I pay all my mortgages XXXX weeks earlier and I am paid up until XX/XX/2022. I called and emailed XXXX, how did I know I could even trust them when I was never informed? I explained situation they said they would investigate. They wrote back saying there was nothing they could do bc fannymae is struck but theyd try!? Im paid up so I m very upset. I called NewRez she said Newrez wired money to them 3 days ago. She also said Newrez made a mistake and deposited my XXXX payment for XXXX toward escrow. This was Newrez mistake. They said the would try to send to serving ti first x but most likely wouldnt be able to since not their loan anymore. They said XXXX just had to call them and they would verify to fix. I called XXXX and they refused fo call they said I had to send bank statements. Hi m getting run around with both companies. Not acceptable since neither informed me of change, Newrez deposited my check incorrectly, and not only do I pay on time but XXXX weeks early. Im not going back and forth anymore. XXXX and Newrez need to resolve this ASAP.

Consumer Complaint: Has been an ongoing problem for over a year with them we file for XXXX relief and then were expected to pay it all back in XXXX lump sum which we did not have obviously. they said that it was being worked out and we should hear for them very soon that was back in XXXX the bottom line is we just want to refinance our house with a different company and pay them off and be done with them but whats holding us up is there reporting that were delinquent on our payments to this nightmare of an ordeal if they can remove that we can pay them off they would be done with us and we could start off on a new loan and get on with our lives

Consumer Complaint: During the first shut down I kept getting letters from the mtg company that I was in covid relief. I kept my emails that told them NO I AM NOT because I am paying, and on time, I didn't need it. Then Covid shut down the world. I couldn't work my second job which I rely on. So several months later I called them back and said, can I get one month of assistance please, I am going to need it after all. They said we can give you 3. I was able to make payments immediately and notified them to take me off of forbearance / deferment. Then in XXXX of XXXX they send a man to my office at work with a stack of papers to sign, like 8 font. They said this is your refinance paperwork so we can roll the 3 months back into your loan. Your payments will go up. I said that's fine. I then had one month of a higher payment, and my payments went back to normal, I thought it was odd but didn't question it at the time. Now I moved to Florida and am selling the house. The title company said " What is this {$5200.00} 2nd mtg? '' I said what are you talking about. She shows me. I call Shellpoint! They said oh that was our program at the time, you should have read your paperwork, we filed a partial FHA claim and put a lien on your house for that amount. WHAAATTTT? First, why am I just now told of this. I KNOW there was NO mention of this at all, ever. I was told it would be rolled in and then my final payment date would change. I asked Shellpoint for copies of the transcripts of communication and a copy of what I signed. My house closes in 3 weeks. What do I do? I called a local lawyer here, she said it was loan modification fraud - that they filed wrong and that I would need a Texas Lawyer. I call one, they agreed and said {$2500.00} please. I'm a teacher, I don't have that kind of money. Help. please. And while I was getting the paperwork together for this complaint I found out they did not apply my payments to my loan!!!! omg!!! Now what do I do???? I am printing, documenting, comparing. It's nuts. They didn't apply my payments. Then XX/XX/XXXX is showing my payment and some other payment in payment history, but the statement doesn't reflect that and I have no idea what that other payment is. What do I do? I called them and they won't help. When I go to their site all messages have been deleted. My statements are no longer able to download. I am taking pictures. look on XXXX statement, I made a payment XX/XX/XXXX ... .statement doesn't show that. I actually sent it on XXXX, but they didn't apply until XXXX. That is my one and only " late '' payment the whole time.
