Consumer Complaint: I applied for a loan modification and was denied based on the wrong income. ( see attached ) Due to a calendaring oversight, my appeal -- which was based solely on the servicer 's error -- was one day late. The letter was dated XXXX XXXX, and I was supposed to reply within 30 days of the date of the letter. I did n't receive the letter until XXXX XXXX. The servicer refused to consider my appeal on XXXX XXXX ( due on XXXX XXXX ) even though it was their mistake in the first place. I provided income documentation and proof of the rental and boarder income I receive. One portion of the income is from boarders who co-occupy my portion of the building I live in and own. This is the only income I was given credit for, {$2000.00} a month. The income from the rest of the building, {$4900.00}, is currently paid to the court-appointed foreclosure commissioner. Between the date of the foreclosure judgment and the foreclosure sale, the commissioner told my tenants they were to pay him. No sale date has been set, and the foreclosure was on hold while my loan modification was being reviewed, but the commissioner kept the rents. The servicer did not give me credit for the rents, even though I provided proof from the commissioner that he was receiving the money. See attached. I do not think it is fair to deny me a chance to be considered for a loan modification, because of a one-day oversight to make an appeal I was making based only because of the servicer 's mistake on my income. I am represented by an attorney and my attorney is helping me file this complaint.

Consumer Complaint: A package was submitted for a loan modification with XXXX XXXX Loans, XXXX XXXX, 2015. An modification offer was received from XXXX XXXX XXXX, 2015. The documents were signed and returned to XXXX as requested. The loan was transferred to Select Portfolio Services ( SPS ) XXXX 2015. Select Portfolio says that they will not honor the agreement because it was not signed. XXXX says they received the signed documents but did not have time to process and execute because the loan had to be turned over to SPS. Select Portfolio Services now has the loan in default and says it has to be cured by XXXX XXXX, 2015 or foreclosure proceedings will begin. We do not have {$4500.00} that they are requesting to stop the foreclosure action.. We have made on time monthly payments as per the agreement signed with XXXX. All we are asking is that SPS honor the agreement from XXXX XXXX Loans. Select Portfolio says they need to get a copy of the signed agreement from XXXX. We want to save our home. Please help!

Consumer Complaint: I have received a third debt validation letter thru regular mail from a XXXX XXXX, XXXX, debt Collector, Foreclosure Mill, dated XX/XX/XXXX on behalf of Select Portfolio Servicing as it relates to a claimed debt. My property is also being dual tracked. So while being given XXXX days to respond to this XXXX notice of debt validation, SPS through XXXX XXXX has also filed XXXX foreclosure documents on my property with a sale date of XX/XX/XXXX. I DEMAND THAT SPS and XXXX XXXX XXXX, STOP ANY AND ALL FORECLOSURE PROCEDURES IMMEDIATELY AGAINST MY PROPERTY. I have warned SPS and XXXX XXXX now on XXXX occasions that they 're servicing and perpetrating a fraudulent loan that SPS acquired from XXXX XXXX XXXX. SPS as a debt collector has NO Agency relationship with XXXX Bank, who claims to be Trustee of a XXXX XXXX XXXX. In a recent XXXX Deposition with SPS, SPS representatives, admitted under oath, that they ca n't prove chain of title past the last servicer, in my case that servicer would be XXXX XXXX XXXX. In XX/XX/XXXX, you can research that the Consumer Financial Protection Bureau stepped in on XXXX for fraud with consumer loans. Among the violations was manufacturing and robo signing documents and passing this FRAUD to other debt collectors. This is the same XXXX who SPS acquired loan and manufactured an Assignment using proven robo signers to Fraudulently attempt to foreclose on my property. Select Portfolio Servicing does not have any legal standing to collect any debt or to order any foreclosure proceedings against my property. I do not owe Select Portfolio Servicing any money. I do not owe XXXX Bank any money. I do not owe XXXX XXXX XXXX any money. I have never signed any documents with Select Portfolio Servicing, XXXX XXXX XXXX or XXXX Bank for any of these companies to be able to claim any debt against me. Let me be perfectly clear, I Dispute Any Debt supposedly owed to Select Portfolio Servicing. I Dispute Any Debt supposedly owed to XXXX Bank. I Dispute Any Debt supposedly owed to XXXX Bank as Trustee. I Further Dispute XXXX Banks ' Standing as Trustee for XXXX XXXX Mortgage Loan Trust XXXX according to XXXX XXXX XXXX Law and such XX/XX/XXXX Assignment to a closed Trust. I Dispute that this loan was even included in such said Trust. SPS is knowingly representing in a fraud and I have more than enough proof. Over the last XXXX years, I have corresponded repeatedly with XXXX Bank, loan servicer, XXXX Bank & Trust, Trustee and Select Portfolio Servicing, loan servicer, each time reminding them all that XXXX and now SPS is fraudulently servicing a loan and does not possess legal standing to order a foreclosure. Despite the overwhelmingly incriminating evidence I have gathered and have shown to XXXX, XXXX Bank XXXX XXXX XXXX as Trustee for XXXX XXXX Mortgage XXXX XXXX XXXX, SPS, XXXX and XXXX and various local XXXX attorneys that XXXX has hired to respond to my requests. I have had to point out to each of them on several occasions that : - The Assignment and Security Deed and other documents are different and altered, thus making the Security Deed null and void. This original Assignment was not only not recorded into public records, it was never actually obtained by XXXX XXXX Mortgage or XXXX Bank. It was stated by XXXX XXXX Mortgage that the note and Security Deed went directly to the trust at the inception of my loan. That is not the case. To this date, XXXX Bank never received my note or Security Deed, nor has any authority to foreclose on my property. XXXX Bank, in a XX/XX/XXXX law suit filed by XXXX Bank VS. The FDIC and XXXX, admits that they ( XXXX XXXX are not " Successors of Interest '' for XXXX XXXX Mortgage Loans. PLEASE DEMAND THAT SPS and XXXX XXXX Stop This Illegal Foreclosure For XX/XX/XXXX.

Consumer Complaint: Loan moved on XXXX/XXXX/15 to SPS. Escrow analysis done. I received letter stating check was cut and sent under separate cover dated XXXX/XXXX/15. I called XXXX/XXXX/15 and asked where check was. They could not locate it and I asked them to replace it. They informed me it could take up to a month to get a new check and said everything was taken care of and the process was started. I received a phone call from them over the weekend, they left a message that I could not understand. I called back on XXXX/XXXX/15. They wanted me to wait to place the stop payment until the end of the week because the check was n't mailed until the XXXX. I told them I would not wait. The request for the stop payment should have been placed on the XXXX to start the research process. I received the check dated XXXX/XXXX/15 at my home on XXXX/XXXX/15 with a postmark on the envelope of XXXX/XXXX/15. When I called today they stated that the check dated XXXX/XXXX/15 was no longer valid and another check was over-nighted to me on XXXX/XXXX/15.

Consumer Complaint: The bankruptcy was discharged in XX/XX/XXXX which included the house and the property was removed from my name in XX/XX/XXXX by XXXX XXXX XXXX. In the past week I have received 3 letters and 2 phone calls stating that I am delinquent when the house is owned by someone else and has been for 5 years. I have no credit with XXXX XXXX XXXX. When speaking with a person from XXXX XXXX XXXX, they said the mortgage was closed XX/XX/XXXX, yet I received phone calls after that conversation.

Consumer Complaint: I have been experiencing some financial hardship and contacted my loan servicer who is acting in behalf of XXXX XXXX XXXX bank. I have audio recorded evidence that the servicer has been engaged in " dual tracking '' and also has purposely caused delays since I have requested a modification. I am less than 60 days behind having made a payment recently. I was sent a default notice by the servicer twice. I have contacted the servicer and they say they are looking into what modification programs I might qualify for while at the same time continuing with forclosure procedures. They have violated the CFPB 's rules that require that a minimum of XXXX days delinquent before they can proceed with any type of foreclosure process. They are " dual tracking ''. They are trying to delay the process by saying they have not received all of the paper work. I can prove they have attempted this by the audio recordings I have of the calls I have had with them.

On XXXX XXXX, 2014 I was on a spiritual retreat when at XXXX I received a call from the XXXX Police Department informing me there had been an electrical fire at my home. My first though was my XXXX year old son and making sure he was OK. So since that time my son and I have been in temporary living quarters. I 'll make a long story short. XXXX performed well keeping their agreement as my insurance provider. When I received the XXXX draw of {$57.00} XXXX I thought to myself ; we should be able to get back into the house before XXXX. In the first few weeks the performed well finishing the roof, the soffit and the fascia. The inspector came and his estimate was 27 % which I vehemently disagreed. I thought it should have been more like 33-34 %. The next draft was for $ XXXX and quickly was exhausted. This was in XXXX .I went ahead and requested another inspection because a great deal of these funds were already owed to the sub -contractors. I 've had XXXX extensions since the inception of the loan. Instead of moving the XX/XX/XXXX, it will now be more like XXXX. I 've had back to back inspections as the XXXX was completed XXXX weeks after I requested the funds. What I 'm finding out is how lengthy the process can and has been. I 've now been waiting almost XXXX months for check and the frustration, stress and absolute anger ca n't be defined. I should not have to beg for these funds Period. The same forms I sent in XXXX months ago are being requested again. The waiver of lien, the contractors ' license number and his tax information. This has been the most traumatic event I 've ever dealt with in my entire XXXX years on this earth. Why did we proceed thus far without the information. What if this was you or your wife dealing with this? I 'm sending this to the world ; no one should have to deal with this XXXX. I do n't wish this XXXX ordeal on anyone. I 'm sure SPS holds these funds as long as possible to earn any type of interest. Will you pay me interest? Please intervene and help me get back home. I 've had a XXXX in the past few years. This has been the most wicked and XXXX experience of my life.

Consumer Complaint: I would like to place a complaint against SPS concerning my modification process, appeal, denial, practices, policies and procedures. For the last year in a half I have submitted XXXX modifications with SPS. Concerning some of the modifications, they have lost completely or miss placed paper work which have prolonged my modification and caused me undue burden stress and strain and resulted in me owing more on my mortgage and therefore getting further and further behind. I was instructed by sps not to make a payment until all the issues concerning my mortgage were resolved and that they would cease and desist all foreclosure activity during the modification process. SPS still continued with their foreclosure activity during my modification and request for information. I 've made several request to SPS for information concerning my mortgage, that have went unanswered and during these periods on two separate occasions, SPS has forwarded my mortgage file to an attorney to proceed with foreclosure. I filled a appeal of my denial for modification and sent in supporting evidence on why the values that they used were in correct when determining my homes value, i further explained that my home is and ADU XXXX affordable dwelling unit XXXX and it is governed by the counties rules and regulations listed in the deed. I have sent in QWR 's and have requested documents verbally which has been recorded and documented by SPS and myself specifically about my mortgage file, service file, and request for information. SPS has ignored nor answered many of the request that i have put forth. Some of the request if they were answered did answer the specific questions in the letter 's I sent. I have attached supporting documents that will provide a time line of what has happened.
