The Lender effectively forced me to default on my mortgage in order for a partial release to be considered, at a time when my payments had never been a day late or a dollar short. ( Please see synopsis on page XXXX and page XXXX letter A et seq. ) 3. The Lender disallowed, IN ERROR, a partial release that would have ultimately satisfied the entire mortgage. The Lender has disallowed excellent offers that would have satisfied more than the principal balance owed at the time. The Lender has made it difficult for me to defend myself in this case, After agreeing to a settlement ( deed in lieu ) which included, but was not limited to, my relocation, the Lender then failed to uphold the conditions of that agreement. Thus I was burdened with a move, and now have to come from out of state, request and be granted time off work, incur the travel costs- ( e.g. plane tickets, car, lodging, meals, pet care ) and difficulties of trying to work without an office/ printer etc. all to address a process which would have been resolved had they upheld the conditions of the deed in lieu. Furthermore, they locked me out of my home so I could not even stay in my own home while this process unfolds. They have further exacerbated the difficulties by telling me a motion was marked ready, and only after my informing them of my ticket purchase, time off work and plans to come up from Georgia did they notify that the motion would not be marked ready. 7. The Lenders failure to respond to and /or counter excellent offers directly resulted in several realtors refusing to re-list or show the property, ( letters attached ) making it far more difficult to sell. ( Please see synopsis and page XXXX letter XXXX et seq. ) 8. By locking me out of the property, which they assured me they would not do, they also prevented the property from being shown by the sole realtor I could get to show the property. ( Please see synopsis and page XXXX letter H et seq. ) 9. The Lender has allowed the property to deteriorate ( e.g. allowing pipes to freeze and rupture ) after agreeing to maintain it, while simultaneously locking me out of the property, ( and also telling my caretaker to remove his equipment from the property, then failing to replace him ). Because I relocated, in substantial compliance with the agreement of the deed in lieu, I am no longer there to mow/maintain the property, and its subsequent deterioration has made it yet more difficult to sell. Please see Synopsis, and page XXXX letters G, H et seq. ) The damage they allowed has rendered the primary residence uninhabitable. 10. The Lender has failed to respond to multiple requests that would have secured a full resolution of the mortgage debt. I have just written a long letter to SPS that thoroughly explains some of what I have been through in the past XXXX years. I accepted the XXXX modification in 2011 because I felt I had no choice. XXXX dragging out the modification process for XXXX months has no reasonable explanation. The modified amount of {$550000.00} was quite high. There are many details contained in the XXXX page letter that will give you a very good picture of what I have gone through.

Consumer Complaint: I had a mortgage with XXXX XXXX/Select Portfolio Servicing and never did receive a proper loan modification. I suffered a XXXX XXXX among other things in XXXX. It forced me to get behind on my payments. XXXX XXXX filed suit foreclosure on me in XXXX. I was making payments up until XXXX. The home has always been in my name. My daughter lived with me and paid rent and utilities ( documented ) because I was older and than she had some problems of being XXXX becoming a victim of XXXX forced her to move out for safety reasons. I felt behind and became sicker. XXXX XXXX along with Select Portfolio and their attorneys XXXX XXXX XXXX sued me and what they did is highly illegal. I started receiving court papers. They named my daughter as a co-borrower and my daughter was NEVER listed on the mortgage as it is clearly stipulated. They added her name in court lawsuit and the lawyers back dated a Mortgage Summons to XXXX and the case was not filed until XXXX. I was paying my mortgage but felt extremely behind because of severe illness and XXXX on my daughter. XXXX XXXX, Select Portfolio Servicing and XXXX and XXXX started sending my daughter lawsuit threats adding her to a foreclosure that she had nothing to do with. I recently called Select Portfolio Servicing and their Sr Rep told me that my daughter was no where on the mortgage or as a borrower of any sort, so XXXX XXXX, Select Portfolio Servicing and XXXX XXXX XXXX lied! They forged my daughter 's initials on papers and committed fraud and deception on my daughter and me by backdating court documents that are untrue. They purposely omitted the fact that my daughter only paid rent and they omitted all rent receipts. We have recently relocated due to health reasons and safety reasons but a family member is at the house until sold. I am working with XXXX for a Short Sale and when I have tried to talk to Select Portfolio Servicing because XXXX wo n't talk to me, they do n't want to hear about a Short Sale. They have my house scheduled for aution on XXXX XXXX, XXXX. I have filed in court Appearance and Answer to Complaint on Foreclosure Mortgage and indicated my daughter 's name is illegally on these court papers and she is not the borrower and that I am trying to do the best I can in selling this house in a Short Sale. Please help me because they are commiting fraud, deception, forging my daughter 's initials/signatures back dating documents, to XXXX and XXXX illegally and ignoring any communication I try to do. I want to press charges as my rights and my daughter 's rights under the FDCPA and FCRA are clearly violated.

Consumer Complaint: XXXX years ago I began to suffer financially due to a downturn in XXXX. I contacted my mortgage servicer, SPS, and requested that they modify my mortgage so I could keep up with the payments. They made me fill out paperwork and told me they would review for loss mitigation options. They came back stating that all I qualified for was a repayment plan because that is all the owner of my mortgage would allow. The owner of my mortgage has since gone out of business and the rules to loss mitigation have now been moved into the master servicing agreement held by XXXX XXXX. Their master servicing agreement allows for modifications. I have been calling SPS frequently and each time I call I get a different answer as to whether I can get a modification or not. Each loss mitigation representative i speak to says i qualify then they come back and say I do n't. Some dont know they answer and some are completely unable to speak about what the servicing agreement allows. My interest rate is 6.99 % and they could have helped me when this all started. Now my loan is close to foreclosure and I Need a modification to stay in my home. I have asked my son to come live with me in order to help with the bills and he has agreed so I can afford a modified payment but SPS refuses to help. All I am asking is that they adhere to the terms allowable in the master servicing agreement and modify my loan to an affordable monthly payment.

Consumer Complaint: In XX/XX/2015, I submitted paperwork for a short sale offer on my home, this would be my XXXX time submitting an offer due to the XXXX XXXX offers being declined because the amount offered was not sufficient according to the mortgage comapny, and due to the mortgage company taking unril XX/XX/2015 to approve the short sale offer of XXXX, the buyer backed out of the deal. So on XX/XX/2015, I contacted the company and advised them to close the sale out and also advised them that my agent and I had found another buyer who agreed to the same terms, and everything on the HUD documentation and the proof of purchase and my agent sent it to the mortgage comapny on XXXX XXXX. I contacted the mortgage company on XXXX, XXXX and the old short sale offer is still not closed and now they have had my new paperwork for the new buyer since XXXX XXXX, and it has not even been looked at or reviewed. My home has been appraised XXXX times and its solely because they take so long with the process that it causes them to expire. And for the appraisal to expire it takes 90 days. Someone at the company is dropping the ball and may be costing me a chance to get out of this home and close this deal. I was advised that it only takes XXXX business days to close out an old short sale offer by an agent. So why has my XXXX short sale offer not been closed? If they had done that, then on XXXX XXXX, my appraisal would not be expiring, but now it is. I really think I am being mistreated because of my inability to pay.

Consumer Complaint: My home has been in foreclosure too long due to my servicing company Select Portfolio Servicing , Inc . I have been trying to apply for the Home Affordable Modification Program since XX/XX/XXXX. I have turned in numerous documents requested by the specialist that is assigned to my review. Every time I call the assigned specialist there is no answer and when I speak to someone else they state I need more documents. I call once a month for an update in regards to the review and ask if there is a for sale date. I received a legal advertisement for prevention of sale date on XX/XX/XXXX so I immediately called Select Portfolio Servicing and asked the representative and she stated no sale date. Then on XX/XX/XXXX I receive Notice of Cancellation of Foreclosure Sale Date from the Circuit Court of XXXX County. When I addressed this to Select Portfolio Servicing representative she stated there was never a for sale date. I have uploaded the legal advertisement and court document mentioned.The representatives at Select Portfolio Servicing give false and misleading information to delay the modification process and keep the home in foreclosure. I have spoken with a total of XXXX different representatives there and they are deceptive and seem to be uneducated in what they do. For instance my last call was in regards to missing documents and I asked what was needed. The representative responded with XX/XX/XXXX tax return thats all that is needed. I told her the last representative yesterday said XX/XX/XXXX tax return and XXXX form. The representative responded with yes that as well. At this point I have been forced to file complaints with the CFBP, Florida State Attorneys Office and the HOPE hotline for the HAMP program in regards to the unprofessional delay in processing my paperwork for a modification The delay from Select Portfolio Servicing in regards to the modification has made me ineligible for the XXXX as well based on a conversation with a representative from there. The representative with the XXXX stated I was ineligible due to the fact that my arrears are over XXXX and my home was in foreclosure too long. As of today I have sent Select Portfolio Servicing a whole new complete packet by certified mail, fax and over there website. I have also requested in writing that my review be escalated. I also need your company to answer a question for me. The manager at Select Portfolio Servicing stated that they have an underwriting department that my paperwork will go to when all documents are received and if I have to appeal the decision after the review the appeal will go to the same underwriting department for review again. I was under the impression that if it is an appeal then a XXXX party underwriter has to process the review. So my question is can the same underwriting department with in the servicing company look at a possible modification of the loan after denying it once already?

Consumer Complaint: On XXXX XXXX, I received a letter from my Select Portfolio Servicing dealing the events in regards to the loan servicing of my loan. What they indicated was as follows. My taxes were sold and were not paid because they felt it would be a loss etc. What they did not indicate is in XX/XX/XXXX I was in a active Special Unemployed Loan Modification and I faxed and spoke with them in regards to not being able to make my XXXX installment payment. Reason was it was a delay in my XXXX benefits on XXXX XXXX. According to the RESPA Guidelines Program for loan servicing amendments. The SPS was suppose to do any means possible to assist me in stating in my home. I did have a hardship and SPS failed to extend my hardship being unemployed per RESPA Guideline and additional 60 days which would be me at XXXX XXXX doing the time they received notice of my unemployed hardship, On XXXX XXXX why were my taxes sold when SPS new I was in a active modification and within my 60 day grace period for unemployed borrowers protection per RESPA loan servicing rules for Loan Servicing Guidelines for Unemployed borrowers. I was also in a active foreclose case filed in the United States District Court for the XXXX District of Illinois XXXX Division docket number XXXX XXXX which had never been dismissed when my taxes were not paid by SPS. As of today 's date the case still has not been dismissed against me. I was lead to believe that SPS was working with me since I was trying to save my home. My PI payment was {$870.00} per month and my Loan Mod payment was around {$1200.00} per month. Why that did not cover my taxes which would have protected me from loosing my home. I do n't understand the life of me. I was under the impression by entering into this modification I would be fully protected not to loose my home. SPS voluntarily to pay {$290.00} of escrows per my statement attached. However they failed to pay the other tax years. SPS has made a ERROR on the RESPA amendment to the loan servicing guideline that President Obama put inplace to assist borrowers like myself. Now I have lost my home. I have been talking with the tax buyer they are willing to sale me the home but their are no programs for me to be approved for a loan to buy my home back at this time. If SPS had not made the ERROR in the RESPA loan servicing. I would have still been able to save my home with all the great programs President Obama have to help borrowers like myself. Please see attach documents and assist by calling the tax buyer paying off my taxes per notice SPS received on a {$95000.00} federally related mortgage conventional loan that taxes were not paid because of the economy per SPS. That was no EXCUSE.
