Consumer Complaint: I, XXXX XXXX am submitting a complaint regarding my mortgage involving Select Portfolio Servicing , Inc due to breach/violation in my mortgage modification contact I signed in XXXX with XXXX XXXX XXXX, Attn : XXXX, FL XXXX on XXXX/XXXX/XXXX ( 2 YR contract XXXX - XXXX ) ; In my modification contract states " As of the modication effective date, a buyer or transferee of property will not be permitted, under any circumstances, be assigned to, or assumed by, a buyer of the property. '' This agreement has been violated several times. By Select Portfolio Servicing, XXXX XXXX XXXX, XXXX XXXX, division of XXXX XXXX XXXX XXXX, XXXX ; Also, Select Portfolio Servicing has excessively increase my mortgage interest rate since my mortgage modification contact has been completed. I have submitted my complaint twice via USPS on XXXX/XXXX/XXXX & XXXX/XXXX/XXXX with delivery confirmation # XXXX XXXX XXXX XXXX XXXX with approximately XXXX pages of supporting documents that was signed for and delivered XXXX XXXX/XXXX/XXXX XXXX Consumer Financial Protection Bureau at locations : XXXX, Iowa XXXX & XXXX and with the supporting documents. Please search for them. Note I never signed anything ( contract ) with any of these financial institutions but XXXX XXXX XXXX Also, as of XXXX/XXXX/XXXX Select Portfolio Servicing Inc has been trying to force me into signing my home my home over to them.

Consumer Complaint: Select Portfolio Services claims in their response to my complaint XXXX that XXXX made a " Protective Advance '' when they paid off XXXX XXXX. What were they protecting? I was not under threat of foreclosure from XXXX. Also, where in my mortgage document with XXXX XXXX ( the original mortgage holder ) does it even mention " protective advances '' or anything like them? No matter what SPS tries to call it, it was a cash out refinance, entitling me to both disclosures of disbursement of funds and the right of recision.

I have been trying for 3 years to modify my mortgage, butTime after time I am met with a request for further details and paperwork. I do not want to lose my home but I am not able to fight SPS Servicing alone. They have also refused to issue me any information regarding who actually holds my mortgage note while threatening foreclosure via mail and with notices left on my door. Consumer Complaint: In XXXX 2015 and in an earlier Qualified Written Request ( QWR ), both Congresswoman XXXX ' office ( via XXXX XXXX XXXX ) and I inquired in writing about who in fact is claiming ownership to my loan and under what authority was Select Portfolio Servicing ( SPS ) given the right to service the questionable loan. In a letter dated XXXX XXXX, 2015, SPS again did not provide written proof of their financial or legal interest they are claiming they have in my property. Upon researching recorded documents at the XXXX County Recorder 's Office, the Mortgage-Backed Security ( MBS ) SPS cited in its correspondence ( XXXX XXXX Trust XXXX ) as connected to my home ( XXXX XXXX XXXX, XXXX XXXX, CA XXXX ) does not exist within any records submitted to the XXXX XXXX XXXX Recorder 's office. It does not appear on any documents connected with my residence. More important, this MBS ( XXXX XXXX Trust XXXX ) does not exist within the records of the Securities and Exchange Commission ( SEC ).

Consumer Complaint: I have been working with SPS on a Deed in Lieu of foreclosure since XX/XX/2015. I signed the intent to vacate agreement on XX/XX/XXXX and vacated the premises on XX/XX/XXXX. As of today, I have not received the Relocation Incentive as promised and noted in the agreement. I continue to get erroneous status updates. The latest is that the check has been issued and is awaiting Manager 's approval. This was the update on XX/XX/XXXX ... .when I called today, they informed me it was manager approved on XX/XX/XXXX but they are unable to tell me when the check will be sent. I am without a place to stay because I have been waiting on the incentive to put down on a new place. I simply need the check to move on with my life. I feel like I am being taken advantage of by the bank since I surrendered and vacated the property on XX/XX/XXXX. I call almost everyday and I get conflicting responses.

Consumer Complaint: I have submitted various complaint on a problem I am having with my mortgage company and up until today they have not given me a glimmer of hope as to what they will be helping me stay with my home, at this moment I have no idea what I 'm going to do I am in total disbelief that there is n't someone higher then them to help me out, Once again I was under the impression that if they would n't give me a solution you 's would help me get to the main source, I have a foreclosure date of XX/XX/2016 what am I going to do, I received a call from a XXXX XXXX were he told me that nothing can be done because the foreclosure day was going to be soon and they did n't have time to start the paper work this was Monday XXXX/XXXX/16 and you tell me that from then until XX/XX/XXXX there is n't any time or is it that he does n't want to help I told him I was going to see what can be done and without any further word he just hung up and that 's it. I do n't want to continue complaining to you. Please help me find a solution to this because I 'm at a point that I think I 'm going to go crazy. Once again thank you and I hope something can be done.

Consumer Complaint: I have written numerous QWR 's requesting the account owners name and address including the name and phone number of a contact person.This account was put into " REO '' status XX/XX/XXXX. SPS continually responds to the request naming XXXX XXXX as the account owner but not including an address or contact information. In the latest response to my letters requesting validation of debt. The foreclosing attorney now says XXXX XXXX XXXX is the owner of the note but SPS continues to respond in writing stating XXXX XXXX 's ownership of the account. XXXX stated in their response to the QWR that I sent them, saying, this property had been foreclosed on in XXXX XXXX? When speaking with SPS over telephone. The various relationship managers say that XXXX is their client ( the servicer ) and that SPS is SubServicer, and that XXXX is the owner of the Note. But written correspondence SPS continually states that XXXX XXXX owns the account as trustee for the holders of XXXX XXXX XXXX Trust. SPS 's definition of an account owner includes owning the note. XXXX denies any affiliation with this note or account at this time. Currently there is a foreclosure sale scheduled for XXXX XXXX, XXXX. The preforeclosure letter dated XXXX XXXX, XXXX I received from the foreclosing attorney states ; SPS is their client and has directed the firm to commence with the sale for XXXX XXXX as owners of the mortgage and trustee for the holders of the XXXX XXXX XXXX Trust. SPS refuses to acknowledge the account being placed into " REO '' status maintaining ownership of the account by XXXX XXXX and refusing to provide me with the necessary contact information for the current note owner or owner of the account. There are several issues that need to be addressed : XXXX is the chronological timeline of correspondence and my attempt to get correct answers concerning the current owner of this Note. 1 ) The hiring of SPS as SubServicer XXXX XXXX 2 ) The foreclosure sale of XXXX XXXX, XXXX as stated by XXXX. 3 ) Foreclosure shows up in XXXX report XXXX XXXX XXXX XXXX The account is placed in " XXXX '' status XXXX XXXX. They say that my home is up side down I have cased in all of my retirement fund trying to save my home the mortgage was at one point {$3000.00} dollars a month. I have been in this fight since 2006 Iam now with Sps servicing since last year it 's seems like they are not trying to help me get a modification me and my daughter and son have sent in every documents that has been required to be sent to them they come back to say that they do n't have all the information I have faxed I have sent it overnight that cost me money that I do n't always have Iam XXXX years old all the money that I ever had in my life is in my home. Iam now living on XXXX income I have worked XXXX jobs all my life me and my husband. All Iam asking for help and to be in the modification programs the mortgage is to. High. to keep and save my home. Consumer Complaint: Select Portfolio Servicing XXXX Inc., aka SPS charges a fee to pay your mortgage online of {$15.00}. In addition, when you do pay this fee SPS does not show it on your mortgage statement. They should not be allowed to charge someone to make their mortgage payment and if they so they should be required, in writing on the statement, to acknowledge that such a payment was made that did not go toward your mortgage or escrow.
