Consumer Complaint: XXXX XXXX turned our account to Select Portfolio Servicing in XXXX between XXXX of 2016. No explanation why our account to Select Portfolio Servicing.SPS Office has no idea what they were doing to read the system. I answered the system to accept the monitor on recording our conversations. SPS told me that they will not accept our personal check toward the Principal. They requested us in writing to ACH Withdrawal and I faxed them and they were supposed to add Property Tax into Escrow has not set up. I faxed again to requested the ACH withdrawal {$800.00} and set up on due date every XXXX of month. Since We were with XXXX XXXX. Select Portfolio Servicing, did not set up and without us knowing that they went ahead withdrew on XXXX of XXXX XXXX which i was charged by my bank and my bank overdrawn fee refund back in. SPS Office admitted mistakes on recording and supposed to credit it back in our acct. They withdrew {$700.00} on XX/XX/XXXX not following my instruction that i requested {$800.00} on XXXX each month. They keep asking me to send in writing to request again. I was so angry with them keeping asking in writing. I faxed few times to them for requested to withdrawal on due date and extra money to principal and escrow account. Select Portfolio Servicing Office these people do not know what they are talking about and I feel these people has no knowledge about our account history with XXXX XXXX. I was supposed to receive the lower interest by XXXX from 6.4 % to 6.1 %. SPS has no idea what I was talking about and they do n't even have no clue and said that the system shows. I feel there is something is not right and I do not know why XXXX turned our account to other companies that are working under the XXXX?? I believe there is a lawsuit against XXXX and I feel someone needs to investigate this company Select Portfolio Servicing.I want this solve the problem with them.

Consumer Complaint: I recently received a letter from XXXX, XXXX, XX/XX/XXXX, that my home mortgage had been transferred to Select Portfolio Services ( SPS ) and would be effective XX/XX/XXXX. In the letter from XXXX, they stated that all contract agreements about automatic payments would not change with the new service provider ( SPS ). On XX/XX/XXXX I contacted SPS ( I spoke to XXXX ) because my mortgage payment did not come out of my payment account as scheduled. SPS ( XXXX ) stated that my payment would come out on XX/XX/XXXX due to backlog on updating new accounts and another on XX/XX/XXXX to bring us online with the E-Pay contract we had with XXXX. Today ( XX/XX/XXXX//XXXX ) when I called SPS, the recording stated that this company was a " DEBT COLLECTOR ''. I have never been late with my payments to XXXX, so why a " DEBT COLLECTOR ''? I then spoke to two people ( XXXX, and his manager ( XXXX ) who told me that they did not have to honor the XXXX contract ( which was E-Z Pay, consisting of payments every other Tuesday of each month with the 3rd payment on months that have 3 Tuesdays going direct to principal ). I asked why they had not taken out my XX/XX/XXXX payment today as stated that they would and was told by XXXX that because I was ahead on my mortgage payments that they would not take any payments out until I owed. The whole purpose of the E-Z pay with XXXX was to stay ahead on payments. XXXX said SPS would honor those terms, SPS says they do n't have to, that it was not in the contract. It was optional at the time of the XX/XX/XXXX contract with XXXX to make the E-Z pay part of the contract. Once we all agreed on that option of the contract, we were led to believe that it would remain part of the contract, even if the contract was transferred. Now both XXXX and SPS are telling not only us, but other customers ( I was told this by XXXX ( 0n XX/XX/XXXX at XXXX hours ) ) that if it was an option, it is not considered binding by law. I have since in the last few hours learned from looking up customer complaints that SPS appears to be fraudulent in it 's practices. I firmly believe that once the optional agreement of a 3rd payment during the months that have a third Mon/Tue should be considered a part of a binding contract. I also want to know why XXXX was allowed to send my mortgage contract to a " DEBT COLLECTOR '' as stated clearly on SPS phone system when you call when we have not been late on our mortgage payments. That is a slap in the face to those of us who make our payment not only on time, but ahead of schedule. THIS IS FRAUD by both XXXX and SPS.

Consumer Complaint: I 'm finally very happy to report that there finally, finally appears to be a healthy exit plan for all parties concerned for my property located atXXXX XXXX , Ca. XXXX. I 'm currently in a Chapter 11 BK and due ONLY to a very recent surge in local housing prices for XXXX the selling of this property should make all parties whole AND most important actually leave me with a bit of a profit too ( which I will invest into an IRA which was the original purpose of buying this property to be sold in this chap 11 BK ). So my complaint has more to do with wanting to be included in any sort of class action or government lawsuit which may ever take place against SPS and their deceiptful biz practices. In attempting to get a good faith review for loss mitigation I spent over a year of endlessly trying to get my RMA to the " complete '' stage for review but in the end concluded that their whole representation of trying to " help '' distressed homeowners with these loss mitigation programs is a pure sham ( and as I finally learnt this past fall in looking over various studies on the effectiveness of the programs it 's clear that there is virtually no " help '' going on but certainly plenty of exploitation ). Here 's how the scam works. Let 's say if after a good faith, full review of my initial application determined that I needed to turn in 6 different documents to deem my application " complete. '' OK, that would be great ... but in my case NEVER happened and I 'm not alone. Instead they would ask for let 's say 2 of the 6 doc 's and I 'd turn them in - always with 2 follow up calls - one with their basic service rep 's ( usually young people ) and the other with a supervisor. The calls were to confirm what had been turned in and what STILL needed to be turned in. Using the above example when they 'd come back with let 's say 2 more of the 6 that were originally needed to complete the RMA and I 'd ask them " what necessitated those?? Why did n't you ask for those last time?? '' there was NEVER an adequate answer and there was NEVER some new fact or new piece of information ( ie some sort of change ) that warranted the request. In other words these doc 's could have and should have been requested all along. But the fact is if SPS does not request ALL doc 's necessary in good faith combined with the fact that some of these doc 's do have expiration dates such that if one passes that date then the doc already submitted then needs to be re submitted, then it becomes mathematically impossible to complete an application - you 're simply at no single point actually informed in good faith as to ALL the doc 's needed. what 's more, I 've included an typical example of SPS 's written letters and if you look at the final grey box there is always the number XXXX you are to call for " clarification on what is needed. '' So you can see by its own definition " clarification '' is not something SPS is willing to provide IN WRITING. You must call them and time and time again in my case the instructions I was given verbally did NOT match that which I was receiving in these letters. Fortunately I recorded hundreds of these conversations so that there is no question that this is systematic fraud and deception. I am not asking for any sort of investigation now on my part now because I 've currently got a viable exit plan through my chapter 11 BK, however, if there are any lawsuits against SPS for these sorts of wrong doings in the future I definitely want to be included in those legal actions for I deserved a good faith review of my RMA. The chap 11 BK is expensive and onerous and it could have and should have been avoided. TRUST ME - THEY WILL BLAME IT ON ME BECAUSE AS WE ALL KNOW BY NOW ... IT 'S SOMEHOW ALWAYS THE HOMEOWNERS FAULT. I 'M SURE THAT WILL BE THE SPS RESPONSE.

Consumer Complaint: Select portfolio servicing bought my loan a few years ago. Everything was fine until XX/XX/XXXX. XX/XX/XXXX I filed insurance claim, insurance company sent check in my name, husbands name, and select portfolio servicing, we endorsed it sent to mortgage company to endorse so we could get our roof fixed. It is XX/XX/XXXX and we not only need a roof but now we have black mold and structural damage as well. It is even leaking down my walls now. We have bought several tarps to try to stop it until we got the check to fix it but there have been so many storms and they just shred the tarps. Also, I am XXXX to black mold as I found out last year when it put me in the emergency room getting XXXX to stop XXXX and XXXX on my face, eyes, and throat and now I have been suffering from sudden XXXX and XXXX as the black mold is in my bathroom which is in my bedroom where I sleep and although I keep the bathroom door shut, you can still smell it when you walk in my room really bad. The select portfolio loss draft department @ XXXX had me make an account on insuranceclaimcheck.Com so we could send info back and forth and I could keep up with the status of my insurance Disbursement process. I made the account and then I couldnt access it, at first, they said I could n't access it because I was 2 months behind on my loan now that I am completely caught up they are telling me that I ca n't access it because I live in a modular home and that people who live in modular homes are not privy to follow their insurance check status via the sight. Since I could n't access the sight to send information, I asked them to fax me the Lein release paperwork on XX/XX/XXXX and it is now XX/XX/XXXX and I have yet to receive that fax, luckily, I got tired of waiting and asked them to just mail it on XXXX and received it on XX/XX/XXXX, I then faxed it back on XX/XX/XXXX and waited for a response which there was none. I called around XXXX because they were supposed to be working on it and I was told they would fix the website so I could get in and check since my account was caught up. My account was still not fixed today on XX/XX/XXXX and that is when I found out about their discriminatory practices of people who live in modular homes. I just want to fix my roof. I have lived here XX/XX/XXXX years and would like to remain here until my XXXX day but even though I paid my insurance they will not release my check so I can fix my roof and I ca n't live with the black mold and their constant lies to keep me from being able to fix my home. What can I do and how do you fight such a big company. My measly {$6000.00} check is nothing to them and barely enough to fix my roof much less the damages that have come from fighting with them for 4 months while my house is sustaining worse damage everyday and I am getting XXXX from the mold but it 's still needed in order to do the repairs. Someone please help, I also have grandkids that come here to visit and they do n't need to be around this mold. I can not deal with this anymore, I have been laughed at, lied to, misled, and discriminated against by this company and their loss department to the point that I just ca n't deal with them anymore and have decided to contact a lawyer.
