Consumer Complaint: After filing for Bankruptcy XX/XX/XXXX, SPSERVIING and XXXX XXXX, where on my credit report as a history and showing that I have a mortgage account. It is now XXXX, XXXX XXXX. According to XXXX Credit Reporting Agency, SPServing requested that they be taken completely off my Credit Report a couple months ago. Also, stating that they no longer use XXXX services to report credit history. So, why now? Why me? Why did they have to take it off? I'm in a chapter XXXX. Its not required that they report! But, it is their to show history and that I have a mortgage for anyone that I maybe trying to rebuild credit with. So, how can a Credit Bureau show " Full Disclosure '', " Fair Credit Reporting '' when a company decides to just take them selves completely off the Credit Report? This is deliberate. Its no accident. XXXX the money. SPSERVING needs to do whats right. If they don't want to spend money, then get out of the business. Saving money on morality is not the right thing to do. Especially when they know how the economy works and not reporting it, is the same as me not reporting damage to my house and then selling it. If I apply for credit and their not on my report, that is not full disclosure. This company needs to stop being so greed, XXXX, evil and heartless and times. They need to put them selves back on my credit to show history and anyone else 's report they decide to take them selves off of.

Consumer Complaint: I recently bought a home XXXX XXXX XXXX XXXX XXXX was the mortgage company. They transfered service to SPS on XX/XX/2018, the day my first payment was due. I paid XXXX XXXX on XX/XX/18 but they didn't credit the payment, now SPS is harassing me for the payment. Instead of working this out between themselves they have harassed me. It is not my fault. SPS has the worst reputation for mortgage servicing. I have no confidence in either of these companies to step up to the plate and fix this matter. I paid on XX/XX/XXXX by cashiers check from my account at XXXX XXXX XXXX XXXX. Amount {$1500.00}. I am submitting proof.

Consumer Complaint: Im still having issues and have very big concerns regarding my home and Select Portfolio Servicing. They have placed my home on a foreclosure sale and has not yet removed the sale due to my loan modification in review. SPS has all my loan modification documents needed for a review they are reviewing it but still have the foreclosure sale when asked Select Portfolio Servicing they say its still active. How if im in review they still have the sale up. Im really worried about them selling my home. They have been jumping me around for a very long time now with my loan modification. I can not get a loan modification without them threatening me with a foreclosure sale date. I still to this day can not get a loan modification they always denying my loan modification. Please help me with this I have sale on my home XX/XX/2018 I am out of options I do not know what else to do for them to stop the sale and give me a loan modification. Please help me please I need someone to talk to about this. They are violating my Home Owner Bill of Rights and I need the sale stopped imminently for my modification to go through. This is way too long over two years now and I can not get an offer. Im ready to pay my mortgage but need help setting up and receiving a loan modification.

Consumer Complaint: Foreclosure Due to Denial Loan Modification Requests Trustee : : XXXX XXXX, XXXX Trustee for XXXX XXXX Series Trust Loan # : : XXXX Current Mortgage Servicer : : SPS Select Portfolio - Loan # XXXX Our current mortgage servicer is ( SPS ) Select Portfolio Servicing, as of XX/XX/XXXX as a result of a transfer by our former servicer, XXXX XXXX XXXX. ( Please note : We have had 6 mortgage servicers dating back to XXXX ) on our Non-Agency Securitized Mortgage since originated in XXXX with XXXX XXXX XXXX XXXX. Since XXXX, we have been " denied '' participation in all Mortgage Modification Programs on 54 occasions even though our circumstances and financial status deem us eligible. 52 of the denial letters have indicated the reason for denial by all past and present servicers in loan modification denials signed by XXXX XXXX, XXXX Trustee indicating " the loan investor/ Loan owner ( XXXX XXXX-XXXX Mortgage Pass through Certificate investors and trustees ( XXXX XXXX XXXX ) does not authorize/permit loan modifications '' In our most recent attempt to apply for any/all available loan modifications through SPS have also not been successful and we have been " verbally '' told that it is due to language in the Pooling & Servicing Agreement ( dated XX/XX/XXXX ) restricting modifications, the PSA is a document that was filed with SEC almost 14 years ago and has never been updated. ( Note : : XXXX XXXX Trust last filed documents with the SEC in XXXX ). SPS indicated in XXXX of XXXX that they saw no language in the PSA prohibiting loan modifications on our mortgage, and have repeatedly encouraged us to apply for Mortgage Assistance to save our home of which we complied with completed application submissions on 13 occasions with SPS our current Loan Servicer. We have had 6 Mortgage Servicers to date and have applied for Mortgage Assistance 56 dating back to XXXX at the continuous encouragement by all Mortgage Servicers. Despite our pleadings for assistance, none of our Servicers to date have complied with our request to contact the investor/loan owner on our behalf for an exception or waiver permitting a 1 x loan modification. We have also made over 47 attempts to XXXX XXXX, XXXX directly for assistance with this matter as they are referred to as the Trustee & Master Servicer of our mortgage which we now understand was a faulty securitization scheme in XXXXThey have indicated that they do not have contact information on the actual investors/loan owner, yet XXXX XXXX XXXX XXXX as trustee and " Master Servicer '' per the XX/XX/XXXX Pooling & Servicing Agreement ( attached (. Consumer Complaint: The company servicing my loan is Select Portfolio Servicing. I have had many issues with this company during the servicing process dating back many years. I am trying to get information from them the Mortgage Trust they are attempting to collect on. The trust is held by XXXX XXXX XXXX XXXX, being serviced by Select Portfolio, yet the payments apparently are being dispersed by XXXX XXXX. All of these banks have recent court rulings againt them as far as Mortgage Trusts are concerned. My mortgage is part of the XXXX XXXX XXXX XXXX held by XXXX XXXX. I am attempting to find information on the actual trust. Through my own research I can find no information on this trust past 2006. I have searched FDIC site as well as many others. I have talked with people at XXXX XXXX that should have direct knowledge of the trust and they referred me back to XXXX XXXX who supposedly disperses payments for the trust. XXXX XXXX could tell me nothing. When I talk to Select Portfolio and try to gain information on the trust they seem to know nothing about it as well. I have verbally requested info on this over 30 days ago and spoke with the Ombudsmen office today and still got nowhere They have accepted me into a payoff plan, which they only gave me less that a month to accept, I told them I needed the information on confirmation that the trust actually exists before I can start making payments. It is only common sense that you don't pay things when you have no idea where your money is going. Deadline to accept the plan is this Monday the XXXX and they will now extend it for me. They have also set up a foreclosure date even before they knew if I was going to accept the plan or not. The foreclosure date is for XXXX XXXX.

I very much appreciate the assistance I received even though there were few corrections that I had to bring to my servicing company 's attention. One issue I have been dealing with for 2 years and can not get any answer is my borrower 's incentive clause which is included and signed for by both parties in XX/XX/XXXX. The original documents include these terms. 1. I will accrue a monthly benefit equal to {$83.00}. 2. They will apply my accrued monthly benefit to my principle balance after the first through the fifth anniversaries of the month in which my trial period is executed XX/XX/XXXX. The yearly amount that should be applied beginning on XX/XX/XXXX and again on XX/XX/XXXX is {$1000.00} for a total of XXXX after 5 years, not any amount has been applied or was I ever given a reason why. I have been transferred to 3 different companies ( XXXX XXXX XXXX, XXXX XXXXXXXX XXXX and currently XXXX XXXX XXXX ) I have been told numerous times it would be corrected by all parties involved and never done. I also have a incentive after the 6th year which would apply an additional {$5000.00} to my principle

Understand i owe money but its not to the trust it was not placed into or XXXX XXXX. SPS. said the Appraised the home for XXXX I can short sale it for that. to do a Loan mode its XXXX with XXXX down. REMIC trust of XX/XX/XXXX, specifically, XXXX XXXX XXXX, that no longer exists, investors ( beneficiaries ) sued and won their lawsuits. There are no beneficiaries due money. My mother passed on in XX/XX/XXXX. I was added to the General Warranty Deed in XX/XX/XXXX. In XX/XX/XXXX, my mother was already deceased for 3 years. Its upsetting and criminal that an unknown Social Securty is linked to my name and home. Im not able to verbally communicate with SPS since my Social Security Number doesnt match their records. They transferred my home over to their REO section to sell. I previously filed bankruptcy because of identifying theft. My home was listed as an asset and was not contested. I have a Florida Homestead Exemption for Veterans. I contacted XXXX XXXX, XXXX. as trustee, and they claim no knowledge or interest in my property. I have no account or anything due them. I was told to report this scam.
