Consumer Complaint: I went to XXXX XXXX for a consumer credit transaction who then extended my credit to Santander bank. They furnished a contract obligating me to pay certain fees. Among these fees was a finance charge that did not include insurance which I had pay separately from the finance charge which is illegal under TILA 15 U.S.C 1605 ( C ). They also violated 15 USC1605 ( a ) which states the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges. The finance charge does not include charges of a type payable in a comparable cash transaction meaning {$1600.00} in cash they received as a down payment was also illegal. This constitutes fraud which voids any contract. 15USC1692 ( h ) states if any consumer owes multiple debts and makes any single payment to any debt collector with respect to such debts, such debt collector may not apply such payment to any debt which is disputed by the consumer and, where applicable, shall apply such payment in accordance with the consumers directions. They have never presented proper paperwork or any paperwork for that matter of my right to rescind this transaction pursuant 15USC 1635 ( a ) ( b ).

Consumer Complaint: Due to the continual inaccurate and false information by Santander to my 3 credit bureaus I have been denied a mortgage, have had to pay higher interest rates on other loans, and have lost thousands of dollars. I had an auto loan with Santander in XXXX and the car was total loss on XXXX XXXX due to intoxicated and uninsured driver who illegally hit me from behind. Santander is inaccurately reporting 3 different things to all three bureaus. I have reached out to them and submitted disputes with no response or corrections. from them. They currently have numerous other complaints on your website and with the XXXX. Also Santander Consumer USA settled with the Consumer Financial Protection Bureau over allegations that the ban sent inconsistent information about consumer auto loans to credit reporting agencies between XX/XX/XXXX and XX/XX/XXXX. They have had lawsuits through the attorney generals office due to their inaccurate practices.

Consumer Complaint: I entered into a lease agreement with Santander by way of XXXX on XX/XX/XXXX, of which I fell into default on, and my vehicle was repossessed. This made me an eligible consumer of the Santander class action lawsuit in XXXX of XXXX. I received a restitution settlement for {$260.00} XX/XX/XXXX via XXXX, however, the vehicle is still showing twice on my credit report ; once as a charge off of {$8800.00} and another time through a 3rd party collections agency that Santander sold the account to called XXXX XXXX. The charge off for Santander is not set to be removed until XX/XX/XXXX and the account with XXXX XXXX, of which I did not sign a contract with, will remain until XX/XX/XXXX. I received restitution from the lawsuit and have disputed this with both Santander and XXXX XXXX numerous times and it's gone unchanged. These negative items have caused me to be declined for pre-qualification for a home loan and also a loan with my credit union.

Consumer Complaint: XXXX XXXX, I received a call from Santander Consumer USA.1 ( XXXX ) XXXX explaining that this call was monitored and recorded and is an attempt to collect a debt owed, after sending an affidavit of truth to them on XXXX XXXX explaining the inaccurate debt amount and furnishing and sharing information of my personal information to a third party after charging off my account and than reverting it back to its original account to Santander Consumer USA XXXX after speaking to a representative about if the letter was sent to the correct address, I was placed on hold and referred to Santander Consumer Legal team where I was told to fax or mail the affidavit over via fax number XXXX. Instead of the affidavit of truth, an affidavit of rescission was sent explaining the violations in my original contract where my right to rescind the contract was violated, my debt was paid for as a consumer credit transaction and not a loan. As a consumer i am not responsible for this debt and instead compensation for violations are being sought after.

Consumer Complaint: I purchase a vehicle at XXXX from XXXX XXXX, California around XX/XX/2015 and got a loan through Santander Consumer USA for approximately {$14000.00}. I have been making payment of {$390.00} ( sometimes a bit more ) since XX/XX/2015 to date. The issue is I have not really seen a difference in the balance of my loan, which is currently at approximately {$11000.00}. I know there have been times when I fell behind on payments and I have requested extensions throughout the six years that I have been paying for the vehicle, but I feel that for the amount of time I have been making payment I should still see a significant drop in the balance and I do not see that. I reached out to Santander Consumer USA a while ago to see if I could refinance the loan to reduce my interest rate which is at 26 % and I was told they do not do that. Recently I reached out to Santander again asking them to look into my loan being that I don't see a difference in the balance. The representative when over the loan history with me and explained that because I have fallen behind in payment and have requested several extensions most of my payments have been applied towards interest. I explained to him that I have been paying {$400.00} for the last six years, which equals to approximately {$24000.00}. How can I pay such a large amount of interest towards a {$14000.00} loan, even if I have fallen behind in payments this can not be. Of this {$24000.00} only about {$3000.00} have been credited towards the principal. I don't know what my options are at this point and would like some help in resolving this issue, and I can not afford an attorney to look into this matter. I just feel at this point my loan balance should be considerably low considering the length of time I have been paying. Your assistance in this matter would be greatly appreciated. Consumer Complaint: Santander consumer reported my car loan as delinquent and over 90 days late as of XXXX. I had just made two payments about two weeks prior to them charging off my account. They did not notify me that the account was going to be charged off and lied saying I was late on my payments which I never was. I have proof of payments showing I was not delinquent. I have tried to dispute on my credit report and have called the company but they continue to lie and say that they already charged it off as a bad loan so there is nothing they can do. Santander consumer has already had numerous lawsuits doing this same thing to other people. I will be filing a suit against them if this is not taken off my credit report.
