Consumer Complaint: Portfolio recovery brought a debt out from capital one that I have not known about. When I contacted them they didnt have this in the system but they had one from a XXXX XXXX XXXX XXXX XXXXXXXX dollars from back in XXXX I have knowledge of any of these debts and according to FCRA SEC623 enforce FACTA 312 if your unable to perform a reasonable investigation then the company is required by law and FCRA to remove the negative info. This has been on my credit report longer than 120 days and I need this removed immediately

On XX/XX/XXXX Portfolio RecoveryXXXX XXXX has reported a Credit Card with a balance of {$840.00} which has been opened by someone fraudulently without my knowledge. Ive disputed this card several times without any Change. When I asked XXXX to validate this account they said it was a validated by XXXX XXXX because they said it was mine. Without a letter of validation that shows the card is actual mine that I filled out a a application and signed for the card. The statement made by XXXX XXXX should have No bearing on the decision of XXXX. Basically XXXX is taking XXXX XXXX word over mine which is discrimination. Without any proof to verify this account belongs to me it should be removed. Ive asked for a letter of validation over 60 days ago and yet to receive anything. Please remove this account from my XXXX Credit Report.

Consumer Complaint: I am writing to complain about a collection account that appears on my credit report. The account is for {$610.00}, original creditor XXXX XXXX. I have never conducted any business with Portfolio Recovery Associates, nor have I signed any contract with them. I believe that they are illegally using my information without my consent. I first became aware of this collection account when I recently checked my credit report. I have never received any bills or correspondence from Portfolio Recovery Associates, and I have never made any payments to them. I have done some research and I believe that it is illegal for a debt collector to report a debt to a credit reporting agency if the debtor has not been given proper notice of the debt. The Fair Debt Collection Practices Act ( FDCPA ) requires debt collectors to send a debt validation letter to the debtor within five days of first contacting them. This letter must include the name of the creditor, the amount of the debt, and the date the debt was first incurred. I have not received any debt validation letters from Portfolio Recovery Associates. Therefore, I believe that they are illegally reporting this debt to my credit report. I demand that you immediately remove this collection account from my credit report. I also demand that you send me a debt validation letter. If you do not comply with my demands, I will be forced to take further action, including filing a complaint with the Consumer Financial Protection Bureau ( CFPB ). Consumer Complaint: In accordance with the Fair Credit Reporting act. The List of accounts below has violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. I told the XXXX, XXXX and XXXX to reinvestigate these accounts : Account name : XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX, However, they stated everything was complete and accurate. But how is that possible if the open date, date of last activity and much more is incorrect. According to 15 USC 1681 I ( 5 ) they are supposed to modify accounts that isnt reporting correctly. 15 U.S.C 1681 Section 602 A. States I have the rights to privacy 15 U.S.C. 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish an account without my written instructions 15 U.S.C 1681c. ( a ) ( 5 ) Section States : no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item or information, other than records of convictions of crimes which antedates the report by more than seven years. 15 U.S.C. 1681s-2 ( A ) ( 1 ) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. Also they arent even in compliance with metro 2 credit reporting. I have evidence to prove my case.

This Debt collector is not a party to the Contract nor are they a signature to the agreement/Contract that was purchased by their corporation therefore PORTFOLIO RECOVERY ASSOCIATES XXXX possess no valid claim to the debt stated in the Contract to be owed by the Principle, XXXX XXXX XXXX XXXX This Corporation has violated the Fair Debt Collection Act also violated multiple Consumer Rights Laws by contacting XXXX XXXX XXXX Mail or Phone. This XXXX has violated the FAIR CREDIT REPORTING ACT by reporting fraudulent debt owed to the XXXX XXXX XXXX, causing financial harm to Consumer.
