Consumer Complaint: On XX/XX/XXXX, I sent a written request to XXXX XXXX XXXX informing them of two accounts reporting incorrect information on my credit report. I attached to the letter, a copy of my report and detailed the information that was incorrect on both accounts. Specifically, both Portfolio Recovery Associates ( XXXX ) and XXXX XXXX XXXX ( XXXX ) are employing the commonly used tactic of " re-aging '' collection accounts to circumvent the FCRA and allow the account to be reported for more than seven ( 7 ) years. I notified XXXX of this illegal tactic and instead of actually conducting an investigation into the accounts, XXXX used an algorithm-based investigation and generated an automatic decision showing the accounts as " Verified and Updated. '' However, the collection agency did not provide the information requested nor did they update any incorrect information. The collection agency simply re-submitted identical information ( still incorrect ), provided no supporting documents, and XXXX validated the information. This is completely unacceptable. For consumers to trust and rely upon the Credit Bureaus, the Bureau has a duty to objectively investigate consumer disputes. XXXX conducted NO investigation and simply verified inaccurate information.

It was covered by XXXX XXXX and resolved with the original credit grantor, namely XXXXXXXX XXXX The bank has requested the return of this account as it was incorrectly listed as a collection account before the merger of XXXXXXXX XXXX The debt collector is aware of these things and has been trying to collect monies that are not owed. I have requested proof on several occasions to validate the origination of the bill, how this was assigned, the bill of sale, and receipts to validate the debt. I asked for the arbitration clause from the agreement to be sent so it could be applied to the insurance agency where the payment was remitted for theft. The company has refused to send me anything and keeps reporting inaccurate information to the credit bureau, impacting my job clearance. This debt collector keeps running inquiries against my name and social where it was not given to them to do so or conduct any business.

Consumer Complaint: Dear CFPB, My name is XXXX XXXX XXXX XXXX, and I am writing to demand the removal of an inaccurate collection account from my credit report and compensation for my time and effort in disputing it. The account in question is from PORTFOLIO RECOVERY and XXXX XXXX XXXX. and it is showing on my credit report without my consent. I have no contract with PORTFOLIO RECOVERY nor XXXX XXXX XXXX. and have given no consent for them to use my name, likeness, or credit data. Furthermore, this collection account violates the Fair Credit Reporting Act ( FCRA ) as per Section 607 ( a ) ( 1 ) and ( 2 ) of the FCRA which requires credit reporting agencies like XXXX to ensure that the information they report is accurate, complete and up-to-date. Also, Section 615 ( a ) ( 1 ) states that no person shall furnish any information relating to a consumer to any consumer reporting agency if the person knows or consciously avoids knowing that the information is inaccurate. Additionally, this violates Section 621 of the FCRA which states that any person who willfully fails to comply with any requirement imposed under this title with respect to any consumer is liable to that consumer in an amount equal to the sum of any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00}, as the court may allow. Furthermore, this violates 15 U.S.C 1681 et seq, particularly 15 U.S.C. 1681i and 15 U.S.C 1681j which states that credit reporting agencies must follow reasonable procedures to ensure the maximum possible accuracy of the information concerning the individual about whom the report relates and any person who fails to comply with any requirement imposed under this title shall be liable to the United States for a civil penalty. Furthermore, this collection account was fraudulently bought and sold, which is a violation of the Fair Debt Collection Practices Act ( FDCPA ) and the Rosenthal Fair Debt Collection Practices Act ( XXXX ), which prohibit the sale or purchase of a debt that the seller or purchaser knows or should know is not legitimate. This also violates the prohibition of any form of deception or fraud under the federal laws such as 18 U.S.C. 1341 ( Mail Fraud ) and 18 U.S.C. 1343 ( Wire Fraud ) I demand that you immediately investigate this matter and take necessary action to remove the illegal collection account from my credit report and also compensate me for my time and effort in disputing it. Consumer Complaint: Portfolio Recovery will not provide the original contract. They send fictitious bills with random amounts. I have several screenshots of error messages on their website when I am trying to see this account. I have sent several emails without a response. I would have no problem paying them if I owed like I did on XXXX previous accounts but this one I do not owe. Also, I have screenshots showing no debt owed from PRA website during the time that they are stating I owe. How are they substantiating the debt if currently I can not access said account of an error and previously it said I didnt owe. CFPB please help!

Consumer Complaint: I noticed Portfolio Recovery Associates on my credit report and I've never had a XXXX XXXX and Portfolio Recovery Associates is claiming I owe {$800.00} based on last report. However, when I contacted them, the information they have does not match and they are unable to share or provide ANY information linking me to this account. This is 100 % against CFFB policy and they should be fined for trying to collect a debt that is not owed. In my complaint, they send a credit card statement with someone else 's address in California ( and I live in Florida ). Also, despite responding to the complaint they have refused to remove the fraudulent attempt to collect a debt without validating the debit. I hereby request once again the below information. Portfolio Recovery has REFUSED to provide the below : Please provide the following : Agreement with your client that grants you the authority to collect on this alleged debt. Agreement that bears the signature of the alleged debtor wherein XXXX agreed to pay the creditor. Any insurance claims been made by any creditor regarding this account. Any Judgments obtained by any creditor regarding this account. Name and address of alleged creditor. Name on file of alleged debtor. Alleged account number. Signed agreement, and application/contract that validates the agreement between XXXX XXXX and XXXX creditor. This was never shared, so it's evident this is fraud. Detailed view of what the debt is for, including a signed receipt for any goods & services you're trying to collect this debt for. Address on file for alleged debtor. Amount of alleged debt. Date this alleged debt became payable. Date of original charge off or delinquency. Verification that this debt was assigned or sold to a collector. Complete accounting of alleged debt. Commission for debt collector if collection efforts are successful.
