Consumer Complaint: The contact person is XXXX XXXX XXXX, and XXXX XXXX. My home went into foreclosure, The amount of approximately XXXX was paid. I have performed to the contract. I also have personal knowledge of the transaction. I requested a cancelled check, or any documentation verifying, that the amount contained on the promissory note, etc. was withdrawn from the bank 's reserves, and not, I repeat and not given to us, my wife and I as a loan that was generated by us through our signatures. I request a sworn affidavit under the penalty of perjury, of the facts. the wet signature of the original promissory note. The claim presented to the insurance companies and the satisfaction paid to the mortgage company when the foreclosure was filed. We also request a sworn affidavit of the movement of the promissory note, ( security ) who sold it, who it was sold to, and the proceeds generated. Also, why have not my wife received any proceeds, as we are a third party investor. Is it not our promissory note? I request copies of the 1099A,1099C 1096, IRS forms , and the 1066. I requested the XXXX reports, to verify, that asset backed securities 2006-1 is not contraband. That it was actually entered in the trust. A sworn affidavit, that we sat down, had a meeting of the minds, agreed on the terms of us " funding this ourselves and paying the alleged mortgage company for a loan that never was. If this can not be agreed upon in the requested sworn affidavits, on the market deliberately held from us as 3rd party investors. I also sent a security to the Trustee indenture, XXXX XXXX that was kept, XXXX XXXX XXXX, the securities in the form of presentments, that were sent to XXXX XXXX, that have yet to be returned. No instruments were credited to the account. I demand you investigate them for fraud, XXXX, Money laundering, unjust enrichment, financial conspiracy. They know exactly what they are doing. They have declined every form of discharge, even though just like all mortgages, satisfied at closing.

They offer all sorts of flimsy reasons, but they have so far refused to acknowledge the change in tax rates properly.

Consumer Complaint: I fell behind in making my mortgage payments and have been repeatedly applying for mortgage modifications. I appealed a decision denying my application for a modification back in XXXX. That appeal was denied, but without addressing the primary reason for my appeal. When the XXXX denial appeal came in, I already had another modification application pending and I received that decision dated XX/XX/23 last week. I had until today ( XX/XX/23 ) to appeal and I filed my appeal today via email. The problem is this, and the mortgage company keeps doing it over and over : The mortgage company is performing a XXXX XXXX XXXX ( " XXXX '' ) calculation and the calculation is wrong for two reasons. One, they are not using my income in performing the XXXX calculation, despite the fact that their own explanation of how they calculate XXXX says that they are " required '' to input certain information when performing the calculation including the accountholder 's income. Then they turn around and say, but it you were denied, it may not have required an income calculation as part of the review and approval process. They can't say in the explanation of NPV calculations that they are " required '' to use my income and then turn around and say, well no, it wasn't required. Second, they are relying on a third party XXXX XXXX for the value of the home. The XXXX XXXX is based solely on comparable sales in my neighborhood and nearby communities, and a single photo of the outside of the home. They've valued the home at {$420000.00} which is actually laughable at how inflated it is. Our home would be lucky to sell for {$320000.00}. The reasons for the lower value are explained in my appeal. I have a right to ask for a full appraisal and I did ask for that in my appeal.

Consumer Complaint: The Customer Service for PHH Mortgage is exhausting and not helpful. Any time I communicate with them they mail me a document which takes 10 days, when I mail it back and it takes another 10 days. Nothing is ever able to be resolved on the phone or via email. From the very start, I wanted to recast my loan with the proceeds from selling my previous home. I finally got a hold of a human to talk through that process because the initial inquiry mailed me a response that made no sense and was not helpful. Fast forward to wiring them XXXX, they immediately applied the payment to my loan balance but were not able to tell me what the new payment would be until 10 days later. They presented the Principal and interest amounts but nobody at the bank could answer basic questions such as LTV ratios, interest payment amounts vs other calculations. I did research on my end of what I thought they payment should be and I am unable to reconcile anything and frankly do not trust the bank if they can not be transparent with me. I finally got frustrated enough that I would not receive any better information so I inquired with them again that I wanted to move forward but noticed that I still had PMI even after applying XXXX to my principal, this put me way below the thresholds to have PMI. The person I spoke to was immediately spooked and realized they may have misguided me in the process, so then they told me we could not recast the loan until we took care of the PMI and they could recalculate the Recast. I was very explicit in that phonecall that I did not want PMI getting in the way of recasting and saving close to XXXX of monthly interest. Fast forward to today and sure enough I made my XXXX mortgage payment and paid that extra interest. Still trying to sort through the PMI. I mailed the signed document for the XXXX appraisal and the major improvement form, of which there were none because I just moved into this house. I am removing PMI because I am applying XXXX to the principal, they are simply not listening to me when I talk with them. I received an email this week that my XXXX $ was applied to my account.. They took my Check for the XXXX appraisal and treated it as a payment and then they said I did not send in the forms for removing PMI. It was in the same envelope as the check!!! Here I am XX/XX/XXXX, still do not have PMI removed, and going to make another Mortgage payment without recasting the loan so they have my XXXX and I am paying the higher interest than what I should with the recast. I am exhausted just writing this complaint.

Even this year up to XXXX had sent the paperwork XXXX times for which they keep saying they not received it or couldn't read a XXXX file. I even send some in multiple formats and ways such as certified mail and fax. I had to prove even the address of the home as Phh even had the wrong address as the home sits on a XXXX not an XXXX. Recently as i had people trying to help even to look to sell the property since it seems like a way to help, but ive had someone take a video of the entire inside of home without permission and we got XXXX shortly after this was done. I tryed to get a lawyer enen, but they want so much money upfront just to even talk about the matter. And evey people that ask me who the mortgage is with i say phh, XXXX they say " oh that company '' they all know them for ther bad reputation, service and handling of these matters. I guess because they are part of ocwen. Even i tried to contact the company that hold the mortgage XXXX they are owened by XXXX XXXX in texas. And they are of equality no help all they do is hang up on you. And i tried many times. I even called XXXX XXXX as they are listed as the trustee and had them do a check on it and they had no record of it. I ask phh to speak to a higher manager or even the foreclosure department and i was denied as they said they have no such thing. So what supervisors and reps run the entire company. I did do know they have such department but they refuse to help. They say " helping homeowners is what they do, '' they better think again on this. They even said the its not about the money but in the end that's all it's about. I even ask if i could talk to president or ceo or even the secretary to them i was told i had to go through there lawyers to talk to them. Its just a big run around with them. In the documents i sent you will see they are charging almost XXXX for late charges and even on there monthly notice it says {$45.00} for late charge. And even there appraisal could be taken into question. What is a human life worth in this world and this question i can even answer its just depends on how you look at it to XXXX its priceless but here on earth it's worth {$10.00} XXXX. All ive been trying to do in the so many attempts is to resolve this in best possible way. To save my home for my mom thats now XXXX XXXX XXXX and soon will be XXXX XXXX XXXX XXXX XXXXXXXX XXXX, me and my pets as i rescued them from XXXX. Either from starvation or being burned alive and covered in oil. I see people are cruel to each other and dont want to help each other. Even i tryied to ask for help in many different ways and form from government to even local everyone is tapped out. Even the housing is tapped out but yet there are so many homes left empty, because investors bought up all the homes and rather sell them for a huge profit and influence the market with the banks all helping then to do so. Even people that come to look at the property to buy want it as cheap as possible and this whole thing of banks selling homes for cheap to investors but not even try to ask if the homeowner would like to buy the home first for the cheap amount as they have this home starting at {$1.00}. Even i said id give them the dollar to call it done. As with even home now that has gone in to this type of process needs so much fixing up even mine does.

I made all my payment on time every month. My last payment was not accepted by XXXX they stated that due to title they weren't able to finalize my modification. My advocate called XXXX and they had advised her that that due to title issue they were not able to give me the XXXX agreement. I was not informed of this by mail as they claim that a letter was sent to XXXX which i never received. There is nothing on my title that is derogatory that would stop them from giving me my XXXX modification. My husband XXXX XXXX passed away XX/XX/XXXX. Which the deed reads XXXX XXXX and XXXX XXXX XXXX, XXXX wife in title. When XXXX people take title as husband and wife they are immediately considered XXXX XXXX XXXX XXXX XXXX XXXX. As soon as XXXX person dies, the entire property gets left to the other person in " tenants by the entirety '' XXXX passed away XXXX, which leaves the entire property to XXXX automatically with no need for probate. This has been confirmed with the XXXX XXXX and multiples attorney. I just want to move forward keep my home and continue to make my mortgage payments as agreed in the trial modification.

Consumer Complaint: I missed only 1payment and called PHH mortgage. PHH mortgage told me that they would help me with a loan modification. Still I sent a payment on XX/XX/XXXX, even though I wasn't making enough because of a commission job. So I receive documents through my email about the loan modification to fill out. I fill them out and sent these 11 documents to their email address. I called PHH they stated that they have received the 11 documents on XX/XX/XXXX said that they are reviewing to call back in 5 business days. So we called back on XX/XX/XXXX PHH stated that the 2 check stubs was not legible. Stated that the forbearance plan has ended so can we pay XXXX dollars. I was shocked that they lead me to believe that they would help me being a Veteran that have served my country. So I find out that due to what PHH mortgage did, brought my credit score down that I couldn't even borrow the money. I resented the documents. They stated that on XX/XX/XXXX they didn't have the documents and ask do I want to talk to another relation Manager in more days. So on XXXX the agent spoke with us and said that the check stubs are not clear. So I stated that Iam just starting sending the payments. The agent stated that if I send the payments that they would send them back. Made another appointment on XX/XX/XXXX at XXXX.and said my check stubs that I went to the post office to send was still not clear. So now our home they said is going into foreclosure on XX/XX/XXXX. VA XXXX XXXX loan specialists sent them a cancelation for 60 days. And they still wouldn't give us this grace that they cause. So they didn't even honor the VA. See IRS PUBLICATION 1635 ( REV. 2-2014 ) Catalog 14332X, pg 7 ; 1. Definitions : Trust : A trust is an arrangement through which trustees take title to property for the purpose of protecting or conserving it for the beneficiaries under the ordinary rules applied in chancery or probate courts. A trust is a legal entity created under state law and taxed under federal law. A trust may be created during an individuals lifetime ( inter vivos ) or at the time on his or her death under a will ( testamentary ). People for PHH MORTGAGE CORPORATION have made false claims to be the holder in due course of the Note and Mortgage, when in-fact the Note and Mortgage have been separated. Consumer Complaint: Below is some of the secure messages I sent to PHH. I have attached all documentation exchanged via their secure system. I also sent 17 pages of documentation showing why PMI did not belong on my account- with acknowledgement from a previous lender in XXXX removing PMI. XX/XX/XXXX I evaluated the most recent Escrow Analysis ( s ) from the previous lender - there were three separate escrow analysis that were generated in XX/XX/XXXX with wildly different results and then PHH acquired the mortgage. This, at best, appears to be a mistake. I have attached all three escrow analyses. The first one from XX/XX/XXXX appears most correct as it indicated a new mortgage payment of {$2100.00} due to increases in property taxes and insurance. As for the PMI payments that have been withdrawing from my account, these should have never occurred and I never approved them. XXXX XXXX mortgage never had PMI on my account as I have not had mortgage insurance since XX/XX/XXXX. Any PMI payment you have paid is erroneous and should be credited back to my account. Please see an email from a previous loan servicer that removed PMI due to loan-to-value. XX/XX/XXXX I am incredibly frustrated with this situation and the lack of follow through by PHH. Last Friday I received an " attempt to collect a debt '' from someone who had not read our file and didn't understand the situation. I explained it and they connected me with someone from the escalation department who acknowledged our ongoing evaluation from PHH. Yesterday I received an " early intervention '' letter that says our account is in default. The most recent communication in this chain is that the person managing our account, XXXX would contact us with an update within 2 business days. Today is the third business day. This is absurd. I have been the way to initiate ALL communication with PHH to address the issues with our account. PHH erroneously or predatorily added PMI to our account in XXXX and apparently began distributing money from our escrow account without notifying us until XXXX, AFTER I began the process of challenging the new payment amount and provided 17 pages of documentation as to why it was incorrect to have PMI. A lender can not simply decide to add PMI after acquiring a loan without notifying a borrower and having agreement. This needs to be resolved by Friday XX/XX/XXXX or I will begin the process of reporting to the XXXX and filing a complaint with the CFPB. My account needs to be made current and whole by PHH with payments set to reestablish in XXXX. Any PMI payment that has been paid from my escrow account needs to be reimbursed into my escrow account. A new escrow analysis needs to be performed and agreed upon by me and PHH. Any collections actions need to be halted immediately. I called to speak with PHH customer service today and was very underwhelmed because I was simply referred that I need to follow the process to have PMI removed. The business behaviors reflected on my account appear to be unethical and predatory- I request expedient resolution by way of a new Escrow Analysis with correct property taxes and insurance taken into account, no PMI included, and a plan to reimburse my escrow with the previously paid out PMI. I will pay the amount I paid last month for the mortgage and consider any additional amount showing as outstanding or late payment to be erroneous and to be removed by PHH once the errors are addressed.

Consumer Complaint: PHH Mortgage is refusing to release a check to my contractor for repairs made due to water damage to my home. My insurance company issued the check after their review of the damages and the costs of the repairs. PHH continually shuffles me around to different people who all tell me they want some form ( adjusters worksheet ) which I have been assured by representatives from both my contractor ( XXXX ) and my insurance company ( XXXX XXXX ). This has gone on for the past few months. I can not understand why they are withholding the check from my contractor nor will they say anything other than they must have this form which I am sure has been sent to them at least XXXX times. There is clearly a practice wherein PHH stalls in that they do not return call nor make promised return calls after they " follow up '' I have to believe that PHH would like to get rid of my loan since I have a very favorable 2.5 % fixed rate XXXX year loan. I am an XXXX XXXX XXXX veteran and suffer from XXXX and this situation is causing me great stress and sleepless nights. I fear I will have to try and find an attorney an expense that I can not afford since according to my local bar association this is not a case wherein an attorney will take the case on a contingency. Further PHH tries to intimidate me by every call being answered a notification that it is an attempt to collect a debt. Since they are the ones who are holding the money it seems more than disingenuous on their part. I do believe other seniors and veterans should be warned not to become involved with PHH. Lastly I have never been late in making a payment to them for as long as they have held my morgage.
