Consumer Complaint: I am responding to the recent settlement with Wells Fargo. Wells Fargo wrongfully and fraudulently filed a foreclosure actionXXXX XXXX against me in XXXX. They fairly quickly voluntarily dismissed the case but it took 8 months, court appearances and a great deal of distress. Then in XXXX of XXXX, I attempted to make my mortgage payment online and they wouldn't accept it. I called customer service and the representative asked me to sit down and then proceeded to inform me that they didn't want my money, they wanted to foreclose. Wells Fargo shortly thereafter filed another wrongful foreclosure action against me. That case was finally dismissed in XXXX of XXXX. Three years of stress/damage to my credit report/Slander of Title in the Official Public Records of XXXX XXXX XXXX XXXX ( they didn't even get my name correct on the complaint ). The stress of being served with surprise lawsuits against me, the continual threat of the loss of my home of 23 years and going to court has been overwhelming and has damaged my mental and my physical health.

Consumer Complaint: PHH incorrectly reported that I was delinquent for 30 days. This was right around the time that they sold the loan to XXXX. I have proof that all my payments were on time with them. Even though they show my payments being on time they reported incorrectly to XXXX that I was late in XXXX 2022, and they reported to XXXX that I was late in XXXX of 2022. They have been unable to correct the issue and to do so in a timely manner. My credit score has been negatively affected by XXXX points and is affecting my ability to obtain a loan.

Their repeated requests are unreasonable and not legal according to my new lender XXXX XXXX Bank. I have a loan approval that has expired due to the continued incompetence of all involved at both the payoff department and XXXX department at PHH mortgage. Contact information XXXX, XXXX, XXXX. They are illegally requesting the appraiser falsify the appraisal report to show the home is a three bedroom, where it is currently showing as a two bedroom simply because of hallway access to a bathroom. An addendum is attached to the appraisal explaining the two versus three bedroom discrepancy.

XXXX XXXX took over the loan servicing in XXXX XXXX XXXX bought it in XXXX at XXXX. With XXXX Waived XXXX They took the Wavied and turn into Defferred ... because they say payments was late in XXXX the modification was 2 years not XXXX and have been charged so many fees it's ridiculous.

I found out by one certified letter addressed to her and a second certificate letter addressed to Occupant about the Reverse Mortgage.But because I was not named on the original loan application, she couldnt talk with me. I tried to explain to a representative of PHH the situation and that I was trying, unsuccessfully to find a lawyer ( between XXXX and XXXX ) to file an Affidavit of Heirship in order to sell the house to pay my Mothers outstanding debt. I have just now found a lawyer. We will meet this Tuesday ( XXXX ) to file an Affidavit of Heirship to be able to move forward with the sell of the house to pay the outstanding loan XXXX XXXX

Consumer Complaint: Hello this is XXXX XXXX XXXX. My issue is not with the debt of the mortgage as the mortgage is paid off. The attorney will answer by saying he does not have to answer questions as the debt was paid off over five years ago. The issue is the attorney from XXXX XXXX who represents Ocwen loan servicing did not consider my request to not email me as I have vision defects from XXXX XXXX. I asked the attorney to call me in future and this did not happened. I was sent letters in large font I did not request. Under the Americans with XXXX XXXX I asked for him to accommodate me. This was a burden to him. Another occasion he hung up the phone on me and my XXXX XXXX representative. I contacted the ombudsman at Ocwen about my treatment from the attorney not considering my request for a phone call. I do not use email often or computers because of my vision and headaches. Ocwen ombudsman has never called me back after my complaint about the attorney. I am choosing not to use the attorneys name as I would not want to embarrass him. Under the XXXX act I had rights and never got any opportunity from the attorney how I would like communication.

When financing my mortgage payment, calculations were computed assuming that I would NOT be paying escrowed property taxes. My mortgage servicing company has been withholding taxes in escrow since I bought my house in XX/XX/2022. I contacted my mortgage servicing firm XX/XX/2022 with the required documentation to demonstrate my permanent exemption. XXXX continued to escrow taxes, and my payment didn't go down. Originally, XXXX told me that I should expect a refund within XXXX business days. I called in XXXX, and I was told that it might take a bit longer. I called in XXXX, and they said that I had to request that I receive a refund from my county, because some of the funds were already transferred to the county, and that they were unable to not charge me escrowed taxes, but they would refund the other funds they had escrowed that weren't sent to the state 'yet. ' XXXX continued to extract escrowed taxes for all of 2022, but promised to send me a check " the first week of XXXX. '' Now, XXXX is saying that they " can't '' provide a refund for ANY of the escrowed taxes, and that they are planning to continue to escrow taxes in the future, because the state 's documentation " doesn't work for them. ''
